Faxed a copy of my letter of this date to Richard Witt for his review and
comment. He stated that they will comply and that he will contact the truss
manufacturing company about a roof system that will work for the garages.
The present truss system spans both garages and the area separation wall
does not continue through to the roof sheathing.
I told him that I will issue the permit conditional upon the letter and the
plan review notes and that he can work out the details about the trusses
prior to time for the installation of the trusses.

Subject: Townhome construction
Dear Richard:
Thanks for providing me with the information that you have on the history
of the construction of the Townhomes. I was able to locate some notes in
the historical file for one of the early permits. They indicate the intent and
direction that the department was taking in regard to the Townhouses.
Section 1710 of the 1991 U.B.C. also helps to provide clarification since the
language in this section is more or less directly the result of code changes
brought about, at least in part, by Paul Sheedy and T.J. Koymatsu of I.C.B.O.
The plans submitted are substantially in compliance with what was agreed
upon at the start of the Townhome project. However, in order to clarify the
requirements, provide for plan corrections and appropriate records I am
offering the following:
1. Garfield county will accept the language in the Declaration of
Covenants for Townhome units within platted development phases I,
II and III indicated as Section 3. Property Rights., Para. (a) Easement.
defined as "A blanket easement is hereby made, established, declared
and granted upon, across, over and under the entire property
(including any Common Space Parcel and each Townhome Lot) for
ingress, egress, installation, replacing, repairing and maintaining all
utilities, including but not limited to, water, sewers, gas, telephone,
cable television and electricity .... ". The acceptance with respect to
the Building, Mechanical and Plumbing code is limited to the
installation of the utility services only. The acceptance is not
intended to supersede any provisions of the National Electrical Code
as adopted and enforced by the State of Colorado.
2. Walls along the property lines will be defined as Area Separation
walls. The area separation walls between the Townhome dwelling
units and the garages may be constructed as either two, one hour fire-
resistive walls or as one, two hour fire-resistive wall. In either

selection, any air spaces within or between the walls must be fire
stopped as required under U.B.C. Section 2516 (f).
3. The area separation wall construction must continue to the roof
sheathing and not stop at the ceiling as presently indicated in the
plan.
4. Penetrations permitted in the area separation walls are only those
complying with Section 4304 (e) of the 1988 U.B.C. or Section 4304
(e) & (f) of the 1991 edition of the U.B.C.
5. 5/8 inch Type X gypsum wall board is to be provided for a minimum
distance of five feet where the framing elements are parallel to the
area separation walls. Where the roof-ceiling framing elements are
perpendicular to the area separation wall, the entire span of such
framing and elements supporting such framing shall be of not less
than one hour fire-resistive construction.
6. The sky lights in the Master baths are to be located no closer than
five feet from the fire-resistive wall.
7. The roof covering on the Townhouses are to be a minimum of a Class
B Roof Covering.
The plan review notes from this and future permit application will also
apply in addition to those listed above.

clarifying this issue have not been a considerable inconvenience to you. If

Subject: Area separation wall between the town house garages. Enclosure.
Dear Jerre:
Thanks for sending me the infonnation on the proposed construction of the area
separation wall between the garages of the town houses. If the walls and ceiling of
each garage is provided with protection by 5/8 inch Type X gypsum wall board I
will accept this assembly for the town house permit currently issued and the one that
has been applied for. The assembly as proposed with the gypsum wallboard
sandwiched between the vertical members of the trusses cannot be identified with
any listed fire resistive assembly that I am aware of.
If you propose similar assemblies on future applications for the town houses I would
suggest that your designers look into other assemblies that are similar but are listed.
I would suggest as a reference the Gypsum Association Fire Resistance Design
Manual. In this manual is a solid gypsum wallboard assembly (GA FILE NO. WP
1850) which may be incorporated into your present design and it is a listed
assembly. There may be others which are better suited to your needs but at any rate
assemblies that you use need to be listed and not ones that are made up to look the
