' � � Mildred ?_.odor.f, Recorder BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO RESOLUTION NO. 78 - 7S WHEREAS, Donald R. Snyder has petitioned -the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30 -28 -101(10)(a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado adopted September 1, 1972 and amended April 14, 1975,.Sections• 1.02.17(d) and 3.02.01, for the division of a 14.8 acre tract -in three (3) tracts of approximately 7.43 acres hereinafter tract "A", 4.46 acres hereinafter tract "B", and 2.97 acres hereinafter tract "C", more or less, and said 14.8 acre tract of land is more particularly described as follows: Township 6•South, Range 91•West of the 6th Principal Meridian, Section 5 part of lot 9 2.31 beginning all of lot 9 E of a line running N/S beginning'500'•E of the NW corner of lot 9 also a• tract of meander land SE SE of Section 5 containing -12.5E acres beginning at NE corner of lot 9 thence S. 11° -of W. of river thence N. 67° of E. 300' thence following the CL of the river mely to the E. line of Section 5 thence W. 215 NL to the N. line of SE -SE thence N. to POB. Total 14.87 acres. WHEREAS, the. Petitioner has demonstrated to the satisfaction• of the Board of County Commissioners of Garfield County; Colorado, that he desires said • exemption for the purpose of re -sale of said tracts "A", "b", and "C". into single-family residential acreage; and • WHEREAS, the Petitioner has demonstrated to the -satisfaction of the Board of -County Commissioners of Garfield County, Colorado that there is a. reasonable probability of locating domestic water on ea•en of said tracts, that there is. adequete ingress and. egress to said tracts, that the location of septic tanks.. will be permitted by the Colorado Departent of Health, and that the requested division is in accordance with the general purposes and intent of the Subdivision • Regulations of the State. of Colorado and the County of Garfield and should, there- fore, be exempted from the definition of the terms."subdivision" and "subdivided land" as set forth in C.R.S. 1973, Section 30 -28 -101(10)(a) -(d), as amended;. NOW, THEREFORE, upon the motion of Richard C. !.Tolley,...seconded• by Flaven J. Cerise, and carried, said 14:8 acre tract of land is hereby exempted .from .:such definitions and said tract may be dividedinto three (3) Bracts of 7.43, 4.46, and 2.97 acres, more or less, all as is morc fully described above,' and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes andregulations; provided,. rop er. exemption is conditioned ti 0 uponthe ;Petitioner,i`obtaining a legal description of. said tracts "A" "B'' and "C" prior to any conveyance. hereof. " This exemption is further granted upon the conditions, and with the express understanding and agreement of the Petitioner that access to each of said tracts PAir.... trB�i arfd "C" be provided by proper easements connecting them to;Rippy Lane prior to conveyance, that the 100 year floodplain boundaries bE included in the legal description to be provided prior to conveyance, and further that no further exemptions to the Subdivision Regulations of the State of Colorado and the County arfield be allowed on said tracts. A copy of the instrument r instruments of conveyance, when recorded shall be filed with this resolution. Dated this 24th day of July, 1978.
