PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Exemption from the Definition of
Subdivision.

south side of Carbondale off of

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in District A, the Carbondale Urban Area
of Influence.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description - The site is located adjacent to the
Carbondale city limits and is generally level
agricultural land.
B. Project Description - It is proposed to split a 38.5 acre
tract into two (2) parcels of 2.0 acres and 36.5 acres.
The two acre parcel contains the existing residence.
The existing residence has water service from the Town of
Carbondale and the larger tract would also be provided
domestic water by the Town if it is approved by the Town
Council. Access is provided via Meadowood Drive off of
State Hwy. 133. Ultimately, the 36.5 acre tract is
intended to be annexed into Carbondale.
III. MAJOR ISSUES AND CONCERNS
A. Prior to approval of an exemption plat, confirmation from
the Town of Carbondale that either water service will be
provided to the tract or the tract will be annexed.
B. Soils information indicates that the only limitations are
large stones.
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as
required by law for the meeting before the Board of
County Commissioners.
2. That the meeting before the Board of County Commissioners
was extensive and complete, that all pertinent facts,
matters and issues were submitted, and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed

exemption is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. That the applicant submit evidence of a domestic water
source for the proposed 36.5 acre tract, consisting of
verification from the Town of Carbondale that a water tap
can be provided or the property will be annexed.
2. That the applicant submit $200 in School Impact Fee for
the creation of one new lot.
3. That all representations of the applicant, either within
the application or stated at the meeting before the Board
of County Commissioners shall be considered conditions of
approval.
