HomeMy WebLinkAbout1.0 Application• 1 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under- signed Margaret C. Smith respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the division of 68.94 acre tract of land into three tracts of approximately 22.98 acres each, more or less, and which tract to be subdivided is more particularly described as follows: (leaal description - attach separate sheet if additional space is required) See separate sheet attached from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County Subdivision Regulations, for the reasons stated below: The subject property is situated between Highway 82 and the Roaring Fork River with single family dwellings on the east, northeasterly and west sides. A natural gas pipeline is located on aN easement through the property and telephone and electricity is readily available from the lines along Highway 82. The proposed division of the subject property is the highest and best use of the property consistent with the Zoning Resolution and Subdivision Regulations of Garfield County. In support of this petition the petitioner also submits the following: (a) Map drawn to scale showing proposed lot subdivision and access. (b) Vicinity Map. (c) Statement on source of domestic water. (d) Statement on method of sewage disposal. (e) 100 year floodplain information where live stream crosses or adjoins said tract. Based on cross-sections in the field, the 100 -year floodplain will cover an area approximately 500 feet north of the river to a depth of 1 foot. This is essentially a sheet -flow condition with broad, shallow over- land flooding occurring throughout the area. Minor development without extensive land filling can take place without raising the flood height over 1 foot. October 12, 1978 Mrs. Margaret Smith Carbondale, CO 81623 Percolation Tests - Margaret Smith Property, Garfield County, CO Dear Mrs. Smith: On September 27 we attempted to perform percolation tests on your property at the location shown on the enclosed map. We found the water table to be about 2' below the ground. The soil was a mixture of silty clay and large stones. It appeared that the irrigation ditches in the area were causing the high water table.
