From: To: Kit Lyon • Date: 10/6/99 Time:15:17:31 • RELATIONSHIP TO THE SILT COMPREHENSIVE PLAN Page 3 of 5 This project is located within the three-mile statutory planning area surrounding Silt. It is located outside of the Silt urban growth boundary. The Silt Comprehensive plan identifies the subject property under the classification of "Agricultural Conservation PUD". The plan states that under a "conservation subdivision or conservation PUD" "the maximum average density is one dwelling unit per 20 acres with the remaining areas to be preserved in agricultural use or as open land. The maximum residential lot size is five acres, other than the agricultural use under a conservation easement this is to conserve a minimum of 75% of the agricultural land." "Areas outside of the Silt urban growth boundary will be primarily agricultural uses and d rural in character." Additionally, a policy under the land -use section of the comprehensive plan states "suburban sprawl will be avoided. The subdivision of rural agricultural areas outside the designated urban growth areas for the purpose of creating low density residential development on large lots of 2,10 or 35 acres will have undesirable effects including: changing the rural character of the area into one of suburban sprawl; making it difficult for adjacent agriculture uses to operate; placing residents in remote areas where urban services for road maintenance, transportation, recreation, police and emergency services, water and sewer, human services and schools are inefficient and expensive to provide; limits the type of housing available and increases the average cost of housing. Low density sprawl development unnecessarily burdens town and county financial resources often resulting in increased taxes in which urban areas subsidize low density developments." The goal under the agricultural section of the Silt comprehensive plan states "existing agricultural areas will be protected from encroachment by urban sprawl. Policies in existing agricultural areas will help agricultural landowners maintain their land in a productive state." Further, the plan notes "with in the three-mile planning area; agricultural areas on the land -use map are designated for productive agricultural operations and uses directly related to agricultural operations such as ancillary structures, housing for landowners and extended family, roadside vegetable and/or fruit stands for produce grown on site, value added processing of locally grown agricultural products, etc. Creation of large lot, low-density subdivisions in areas designated as agricultural will be discouraged. This development pattern will erode the critical mass of agricultural uses, increase conflicts with agricultural operations, transform the character of the rural area into suburban sprawl, increase the cost to the county of providing services and increase the level of services needed which may result in higher county taxes paid by county residents including those who live in the Town of Silt. For developments in the County within the three-mile area and outside the urban growth boundary, the town will recommend two alternatives: 2 From: To: Kit Lyon • Date: 10/6/99 Time: 15:18:26 • 1) An average density of one dwelling unit per. 80 acres, unless the new dwelling is directly related to the operation of the agricultural use, or, 2) An average density of one dwelling per 15 acres in a Conservation Subdivision or Conservation Planed Unit Development (PUD)." ISSUES AND CONCERNS. Page4of5 1. Conformance with the Silt Comprehensive Plan. The proposed development does not conform to the recommendations contained within the Silt Comprehensive Plan. The project includes no clustering of dwelling units in the design layout and is in conflict with the plan goals, policies and recommendations for agricultural land. 2. Impacts on County Roads and Access to the Project. Five residential single-family lots will generate approximately 50 single trips per day. An additional five accessory dwelling units will double that number to 100 single trips per day. This traffic will impact the county roads serving the project and will also impact the street system within the Town of Silt. The closest I 70 access to the development is the Silt interchange. This interchange is already impacted by municipal and county traffic both North and South of Silt that funnels to this interchange. The town and county should work cooperatively to develop a solution for this interchange. The proposed development should be required to contribute a pro rata share of the cost to an analysis of this issue. None of the lots of front on a publicly dedicated street. Access is proposed via a 75 -ft. easement. The application did not include any proof of legal access to this easement. The proposed road surfaces are gravel. The projected traffic from the proposed development and adjoining properties will ultimately result in the need fora paved road surface. The applicants should be required to pave the private road from the nearest county public road into the project. 3. Drainage Impacts. Drainage from Silt Mesa south of the Grand Hogback converges on the Town of Silt. This has resulted in significant flooding problems within the town. Silt has commissioned a comprehensive drainage analysis of these areas. Actions have been taken on the east end of Silt along 16th Street and through the Lyon Subdivision to mitigate some of these problems. The headwaters of these drainages are located north of Silt outside municipal limits. It is important that the town and county work together to avoid increasing any historic runoff from developed properties. If drainage problems are exacerbated, the cost to the county taxpayer will be increased. The county should require that surface runoff from this development not be increased above historic levels. Additionally, the applicants should complete a comprehensive drainage analysis to ensure that historic levels are maintained and preferably decreased with detention basins and other acceptable engineering methods. 4. Impacts on Adjoining Agricultural Lands. Continued development of the Silt Mesa area into small lots of three to five acres will draw additional population and 3 From: To: Kit Lyon • Date: 10/6/99 Time: 15:19:20 associated impacts into these agricultural areas. Silt Mesa contains some of the more viable agricultural land in Garfield County. Several years ago, Garfield county adopted a "Right to Farm" resolution in order to support preservation of agricultural functions. Development of this property into five additional parcels will increase the problems associated with trespass, dogs and complaints from non-agricultural residential users. 5. Wastewater Disposal Systems. Individual engineered mound systems are proposed for the development. These systems are necessary because of a seasonally high groundwater table. The long-term viability of these systems depends upon adequate maintenance by the property owners and maintaining the integrity of the systems. Failure of these engineered systems may result in contamination of groundwater supplies. 6. Fiscal Impacts. Studies by the National League of Cities, Urban Land Institute, American Planning Association and other credible organizations have documented repeatedly that suburban development in rural areas generates more costs to a local government than it returns in revenues. Demand for services and Garfield County continues to increase as rural areas are subdivided. Expectations for service by new residents often exceed expectations of existing residents and existing service levels provided. This "increasing demand for service" costs the taxpayer lots of money. Residential growth does not pay its own way. Taxes for schools, fire districts, water districts, college districts, counties and other service providers will increase as result of this type of development. A fiscal impact analysis should be completed for the proposed development to quantify expenditures and revenues associated with the project. Any long-term deficit created by this development should be compensated by the applicants to minimize the anticipated tax increases in the future. Recommendations Page 5 of 5 The Town of Silt urges the Garfield County planning commission and County Commissioners to consider carefully the adverse impacts that may be associated with this development on the county taxpayer before the decision is made on the project. All impacts should be quantified by the applicant to the satisfaction of the county prior to a decision. Any negative impacts should be completely mitigated before this project is allowed to move forward. If the Town of Silt can provide any additional information or answer any questions related to this memorandum, please feel free to contact the town. If this subdivision is approved, Public Service Company would require that utility easements be provided for installation of gas/electric facilities to serve these lots. Additionally, there is an indication of 10 primary dwelling units, two per lot. If these buildings are addressed differently we will provide a point of service to both buildings. However, if there is only one address per lot, there will be ONE POINT OF SERVICE per lot in compliance with National Electric Code 230-2. In order to provide utility service to these lots there must be 15' front lot line easements in the cul-de-sac and the road which runs north -south from County Road 250 to the cul-de-sac entrance. As is stated in the real estate contract included in the Aug. 20, 1999 submittal, SMI, LLLP is the current owner of the property. Permission to subdivide is granted in this contract. For further clarification of this matter, please see attached letter from SMI, LLLP date September 1, 1999 (Attachment A). 1 B) Legal Description. The legal descriptions are shown on the Sketch Plan Map submitted Aug. 20, 1999 under "Legal Descriptions." We have modified these to include the full metes and bounds legal description for the parent property. See revised Sketch Plan Map (Attachment B). 2) The source of domestic water supply. The source of domestic water is the public (domestic) water system that currently serves the Peach Valley Orchard Subdivision and Simon Subdivision Exemption. Lot 4 of Simon Subdivision currently owns 8/25 of this water system. This water can be used for domestic and irrigation use. The well location and easements for the well are not shown on the plat map because they are not on or a part of Lot 4. Accessory Dwellings. The Sketch Plan Map has been changed to reflect the Counties guidelines regarding Accessory dwellings. Two of the proposed lots are now reflected to have Accessory Dwellings, while three of the lots are proposed to have "guest" units. 4) Access. Evidence of access to public right-of-way is included in a document previously recorded at Garfield County, to wit: "Grant of Easements and Declarations of Covenants, Conditions and Restrictions for a Portion of Peach Valley Orchard and Simon Subdivision Exemption," recordation number 546583, June 3, 1999. The well is the source of supply for the community water system (PWSID # to be assigned by CDHPE) serving the Peach Valley Orchard subdivision and the Simon Subdivision Exemption. The subject parcel is Lot D the Simon Subdivision Exemption. The Simon well holds a water right decreed absolute for 49 gallons per minute (gpm) for domestic and irrigation uses. The date of appropriation was May 31, 1910 and the date of adjudication was July 3, 1972. The well holds permit #049153F. Copies of the decree for the well and the well permit are attached. No changes of water rights or additional Water Court action is required to use the well for domestic use in the North 27 Subdivision. The North 27 Subdivision owns 8/25ths of the 49 gpm adjudicated to the well. This is 15.7 gpm or 3.14 gpm for each of the 5 proposed lots. At a continuous rate of 3.14 gpm, each lot receives 4,516 gallons per day. This compares to the in-house demand 350 gallons per day per house typically used for water supply planning purposes (3.5 persons per house each using 100 gallons per day). A 72 hour pump test was completed on the Simon well in February, 1999. A winter pump test was conducted to determine the aquifer conditions during the least favorable conditions. That is, when the groundwater table is typically at its seasonal low and recharge is minimal. The well was pumped at 33 gpm. The pump test data indicates that the well is capable of sustaining 33 gpm. Evidence of this is the fact that the pumping level reached equilibrium (no additional draw down) 390 minutes (6.5 hours) into the 72 hour test. Extrapolation of the pump test data suggests that the well is capable of producing more water than the 49 gpm allowed by the decree. 2 Irrigation Water Supply Raw water irrigation will be supplied from a combination of Farmers Irrigation Company direct flow water and Silt Project storage water. The North 27 Subdivision owns 11.90 shares of Farmers Irrigation water and 26.04 acre feet (AF) of Silt Project water. The water will be conveyed to each of the proposed lots pro -rated based on the acreage of the proposed lots. The irrigation water will be delivered to the lots via an underground pressurized delivery system. Thi, system is being constructed by the developer of the Peach Valley Orchard Subdivision and the Simon Subdivision Exemption. Additional piping will be installed to provide service to the interior lots. B Proposed Type of Sewage Disposal. Individual Sewage Disposal Systems (ISDS) are proposed. There is no regional central sewer system within several miles of the proposed development. It is anticipated that some systems may have to be designed by a Colorado Registered Professional Engineer due to the possible presence of seasonally high ground water. Statement assessing the impact of the proposed subdivision on the lakes, streams and topography of the site. The subdivision will have no adverse impact on lakes, streams and topography of the site. There are no lakes within the development area or in the immediate surrounding area. There are no naturally occurring streams in the development area. Man-made drainage channels within the proposed subdivision will be maintained and drainage easements will be platted to ensure the continuance of these features. No significant topographic changes are proposed. The site slopes gently to the south and exhibits good natural surface drainage. The proposed cul-de-sac will be constructed to properly drain but will not require extensive re -grading. Building sites should be graded by the individual lot purchaser to provide adequate drainage around individual structures. E. Statement Assessing Potential Radiation Hazards of the Site. There are no known radiation hazards at the site. The site has been in agriculture for the past 100 years or more. The Simon well contains some naturally occurring uranium but the level (16.5 pCi/liter) is below the proposed Colorado Department of Health and Environment and U.S. Environmental Protection Agency limits for drinking water supplies. F. Evidence That All the Lots and Parcels Created by the Subdivision Will Have Access to a Public Right-of-way, in Conformance with the Colorado State Highway • Access Code and Applicable County Regulations. Lots A, B, C and D will access Garfield County Road 250 via private access road on the west side of the development.
