Tower: Proposed 160-ft Self-Supporting Tower
The following checklist is now used by the FCC staff as a review to inform the licensee, applicant, or tower
owner (collectively, “Applicant”) concerning compliance with 47 C.F.R. § 1.1307 of the Commission’s rules.
In addition to compiling this information, Applicants are required to comply with all of the Commission’s
environmental rules, including 47 C.F.R. § 1.1311 (i.e., “environmental information to be included in the
environmental assessment (EA)”), to determine whether a proposed facility may have a significant effect
on the environment.
Pursuant to 47 C.F.R. § 1.1307, does any of the following apply to the proposed facility’s compliance with
the following NEPA requirements:
1. Is the proposed facility located in an officially designated wilderness area? NO
The proposed Grass Mesa Tower in Rifle, CO is not located within in any officially designated
wilderness areas. The closest officially designated wilderness area, the Flat Tops Wilderness, is located
approximately 25 miles northeast of the proposed project. The location of the project site in relation
to officially designated wilderness areas was reviewed and confirmed on the following websites:
http://www.wilderness.net/map.cfm and https://ecos.fws.gov/ipac/. Please see attached U.S. Fish
and Wildlife Service (USFWS) Information for Planning and Conservation (IPac) report generated for
the project area.
2. Is the proposed facility located in an officially designated wildlife preserve? NO
The proposed Grass Mesa Tower in Rifle, CO is not located within any officially designated wildlife
preserves. The closest officially designated wildlife preserve, the West Rifle Creek State Wildlife Area,
is located approximately 8 miles north of the proposed project.
3. Will the proposed facility affect or may affect listed threatened or endangered species or proposed
critical habitats; or is likely to jeopardize the continued existence of any proposed endangered or
threatened species or likely to result in the destruction or adverse modification of proposed critical
habitats? NO
The proposed Grass Mesa Tower in Rifle, CO will have a “no effect” on federally listed threatened and
endangered species, proposed threatened or endangered species, or designated or proposed critical
habitats. In a June 16, 2017 email (attached), the U.S. Fish and Wildlife Service confirmed the “no
effect” determination for this project.
4. Will the proposed facility affect districts, sites, buildings, structures or objects significant in
American history, architecture, archaeology, engineering or culture, that are listed, or are eligible
for listing, in the National Register of Historic Places? NO
The proposed Grass Mesa Tower will not affect any districts, sites, building, structures or objects
significant in American history, archaeology, engineering, or culture. The proposed facility is in close
proximity to an existing tower facility that was constructed about 2012. The next closest
structure is the landowner’s private residence on the subject property, located approximately 500
feet to the east of the proposed tower. On June 30, 2017, the State Historic Preservation Office (SHPO)
issued their determination letter (attached) concurring with the assessment that the proposed
telecommunications facility will have no effect on historic properties, listed or eligible for listing.
5. Will the proposed facility affect Indian religious sites? NO
After onsite consultation with the THPO of the Ute Mountain Ute tribe on June 20, 2017, it was
determined the proposed Grass Mesa Tower will not affect any Indian religious sites. Consultation
was also conducted with the following tribes: Blackfeet, Crow Creek Sioux, Eastern Shoshone,
Flandreau Santee Sioux, Kiowa, Northern Arapaho, Northern Cheyenne, and Spirit Lake. To date,
seven of these tribes have responded with a determination that the project will not affect any Indian
sites, religious or otherwise.
6. Is the proposed facility located in a floodplain? NO
The proposed Grass Mesa Tower in Rifle, CO is not located within a floodplain.
7. Will construction involve significant change in surface features (e.g., wetland fill, deforestation, or
water diversion)? NO
The construction of the proposed Grass Mesa Tower in Rifle, CO will not involve any deforestation,
water diversion, filling of wetlands, or any other type of significant changes to surface features.
8. a. Will the proposed facility be equipped with high intensity white lights which are to be located in
residential neighborhoods, as defined by the applicable zoning law? NO
The proposed Grass Mesa will not be a lighted facility.
