Moore, being duly sworn, hereby deposes and declares: 1. I am over the age of 18 and am a resident of the State of Colorado. I have personal knowledge of the facts herein, and, if called as a witness, could testify completely thereto. 2. I suffer no legal disabilities and have personal knowledge of the facts set forth below. • On Jan. 21, 1977, Elwyn and Frances Coulter sold and conveyed to David C. Moore and Bailie Big Rock Construction Company, Inc. a tract of land with "all of its appurtenances..." (Book 492 Page 854 at the Garfield County Clerk and Record), commonly referred to as Green Diamond Rentals, 1405 Main St. Silt, Colorado 81652. • On June 30, 1988 David C. Moore and Bailie Big Rock Construction Company, Inc. sold Green Diamond Rentals to Glenwood Insurance Agency "with all and singular the hereditaments and appurtenances...". (Book 736 page 907). • In 2007 The Glenwood Insurance Agency sold Green Diamond Rentals to the Green Diamond Investments, LLC (Travis Stewart). • On Oct. 23, 2016 Green Diamond Investments, LLC, (Travis Stewart) sold Green Diamond Rentals to 3M Investors, LLC. (Rec. # 882792) "with all and singular the hereditaments and appurtenances...". • David C. Moore is a partner of the 3M Investors, LLC. When I (David Moore) purchased Green Diamond Rentals in 1977, the Property's primary source of income was derived from 11 rentals houses/apartments, and a number of recreational vehicle (RV) rentals, which varied from time to time between 4 and 10, depending on the season and the economy. After the sale to the Glenwood Insurance Agency, Glenwood Insurance Agency hired Eddie Pace to manage the property with a focus on attracting RV space renters who were full -year rather than seasonal. At times, this resulted in man -camp scenarios were 4-6 men would sleep in shifts in some of the RVs. /g75- R.J. When Travis Steward (Green Diamond Investments, LLC) purchased the property in 2007, it is my understanding that his intent was to redevelop rather than maintain the rentals. The National Recession eventually forced him to abandon his plans for redevelopment though. During his ownership, Mr. Steward entrusted the care of the Property to individuals who grossly mismanaged and neglected it. Consequently its reputation was damaged and tenancy decreased to the point that when 3M Investors, LLC acquired the Property on September 23, 2016, only 4 rental houses/apartments and 5 RV spaces were occupied. Since this date of purchase, 3M Investors, LLC has worked very hard to restore what was once a Garfield County eye -sore into a beautiful low cost living complex with Tush green common spaces by: repairing buildings; replacing broken windows, plumbing fixtures and lights; repairing doors and thermal leaks; painting all the houses/apartments; digging up and replacing root clogged sewer lines; placing the water well on a separate electrical circuit; repairing the irrigation system; trimming trees; and placing new gravel over the driveways and RV spaces. As requested by the Garfield County Planning Department, we have searched the files of both the County Clerk and the County Assessor for any documentation regarding the use of RVs at Green Diamond Rentals, but to no avail. When asked, a clerk at the Assessor's office stated that their office does not keep records of RVs on properties because they are not assessed for property tax purposes. The clerk went on to explained that RVs are serviced by the Garfield County Vehicle Department and are charged for licenses plate fees versus being treated as real, taxable property. In conclusions, recreational vehicle rental spaces have been a major part of the property commonly known as Green Diamond Rentals for as long as I have had connections and knowledge of the property, which is over 41 years.
