Dear Debbie: At their meeting on May 28, 1992, the Garfield County Board of Adjustment approved a two (2) foot variance for the front yard setback for a front porch on the above described property. Since the proposed greenhouse was determined to be an "accessory" structure with a 7.5 foot setback, no variance was required for this structure. The site consists of 13,320 square feet. WATER/SEWER: Individual septic/shared well ACCESS: Driveway onto Sopris Avenue I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in the Carbondale Urban Area oflnfluence as identified on the Comprehensive Plan Management Districts map. II. DESCRIPTION OF THE PROPOSAL A. B. c. Site Description: The subject property is currently developed with a mobile home and an accessory shed. The mobile home is located at the west end of the parcel and is sharply angled, trending northwest-southeast. Two (2) large trees are located just east of the residence. The remainder of the property contains a large garden and irrigation ditch. Request: The applicants are requesting a variance from the required setbacks for the street side, interior side and rear yard from the required 25', IO' and 25' to 23', 6' and 16' (see enclosed site plan). The newly proposed encroachments would allow the applicants to expand their mobile home. Background: The subject property consists of a newly configured lot, recently approved by an amended plat by the Board of County Commissioners. Prior to the amended plat, the applicant's home spanned portions of five (5) of the original townsite lots. The mobile was placed on the property in late 1977 or 1978. The mobile was originally under the single ownership with the adjoining lots and residence to the east. Subsequent to the map amendment, the applicants purchased the property from the adjacent landowner. -\- III. MAJOR ISSUES AND CONCERNS 1. Section 3.04.07 (Minimum Setbacks-R/L/UD) requires a setback of twenty-five feet (25') from the front lot line or fifty feet (50') from the street centerline, whichever is greater (see enclosed on page· 4 ~ ). The section also requires a 25 foot rear yard and a 10 foot side yard setback. 2. Section 5.05.03 (Yards-Supplemental Regulations) states that the following requirements shall be observed in all zone districts, "On lots bordered on two (2) contiguous sides by streets, the required front yard setback shall be observed along both streets." 3. Based on the definitions in the Zoning Resolution, the "rear" and "side" yards could be interchangeable on the subject property. Jn reviewing this application, the identification of "rear" and "side" appears to have little substantial bearing on the application. 4. Section 9.05.03 states that "by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of enactment of this resolution or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property," the Board may authorize a variance. Jn addition, the Board must also find that: A. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; and B. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; and C. That the circumstances found to constitute a hardship were not caused by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; and D. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the applicant. 5. The subject property is not exceptionally narrow or shallow. It is substantially larger than the original townsite lots and is typical of homesites in the Sutank area. The lot is subject to setback restrictions, which apply to all residential zone districts. The building envelope on the lot consists of 5070 square feet. 6. Based on the applicant's representations oflotaction, the proposed additions on the north side of the residence would abut, or extend very close, to the existing septic tank and leach field area. State-mandated individual sewage disposal regulations require a I 0 foot setback from leach fields for structures. The proposed addition would conflict with these setbacks. These regulations cannot be waived by the Zoning Board of Adjustment. 7. In staff's opinion, the only exceptional condition relative to the subject property are two mature trees. With the requested variances, the proposed trees would remain in tact. Staff feels the home could be directionally re-oriented on the lot while still preserving the trees. III. SUGGESTED FINDINGS 1. That the application for Variance was not found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. IV. RECOMMENDATION StalTfells that there is not evidence of exceptional circumstances or topography and that the requested variances are not warranted. The applicants appear to be victim of the home's original location and its relationship to the building envelope. In addition, the proposed additions conflict with I.S.D.S. setback requirements between residences and waste water systems. The site consists of 13,320 square feet. Individual septic/shared well Driveway onto Sopris Avenue I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in the Carbondale Urban Area oflnfluence as identified on the Comprehensive Plan Management Districts map. II. DESCRIPTION OF THE PROPOSAL A. Site DescriptioD" The subject property is currently developed with a mobile home and an accessory shed. The mobile home is located at the west end of the parcel and is sharply angled, trending northwest-southeast. Two (2) large trees are located just east of the residence. The remainder of the property contains a large garden and irrigation ditch. B. Request: The applicants are requesting a variance from the required setbacks for the street side, interior side and rear yard from the required 25', 10' and 25' to 23', 6' and 16' (see enclosed site plan). The newly proposed encroachments would allow the applicants to expand their mobile home. C. Background: The subject property consists of a newly configured lot, recently approved by an amended plat by the Board of County Commissioners. Prior to the amended plat, the applicant's home spanned portions of five (5) of the original townsite lots. The mobile was placed on the property in late 1977 or 1978. The mobile was originally under the single ownership with the adjoining lots and residence to the east. Subsequent to the map amendment, the applicants purchased the property from the adjacent landowner. ~1- • • III. MAJOR ISSUES AND CONCERNS 1. Section 3.04.07 (Minimum Setbacks-R/L/UD) requires a setback of twenty-five feet (25') from the front lot line or fifty feet (50') from the street centerline, whichever is greater (see enclosed on page• 4 -). The section also requires a 25 foot rear yard and a 10 foot side yard setback. 2. Section 5.05.03 (Yards-Supplemental Regulations) states that the following requirements shall be observed in all zone districts, "On lots bordered on two (2) contiguous sides by streets, the required front yard setback shall be observed along both streets." 3. Based on the definitions in the Zoning Resolution, the "rear" and "side" yards could be interchangeable on the subject property. In reviewing this application, the identification of "rear" and "side" appears to have little substantial bearing on the application. 4. Section 9.05.03 states that "by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of enactment of this resolution or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property," the Board may authorize a variance. In addition, the Board must also find that: A. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; and B. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; and C. That the circumstances found to constitute a hardship were not caused by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; and D. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the applicant. 5. The subject property is not exceptionally narrow or shallow. It is substantially larger than the original townsite lots and is typical of homesites in the Sutank area. The lot is subject to setback restrictions~ which apply to all residential zone districts. The building envelope on the lot consists of 5070 square feet. 6. Based on the applicant's representations oflotaction, the proposed additions on the north side of the residence would abut, or extend very close, to the existing septic tank and leach field area. State-mandated individual sewage disposal regulations require a I 0 foot setback from leach fields for structures. The proposed addition would conflict with these setbacks. These regulations cannot be waived by the Zoning Board of Adjustment. 7. In staff's opinion, the only exceptional condition relative to the subject property are two mature trees. With the requested variances, the proposed trees would remain in tact. Staff feels the home could be directionally re-oriented on the lot while still preserving the trees. • • III. SJJGGESTED FINDINGS 1. That the application for Variance was not found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. IV. RECOMMENDATION Staff fells that there is not evidence of exceptional circumstances or topography and that the requested variances are not warranted. The applicants appear to be victim of the home's original location and its relationship to the building envelope. In addition, the proposed additions conflict with l.S.D.S. setback requirements between residences and waste water systems. You will receive, from the Planning Department, a "PUblic Notice Form" indicating the time and date of your hearing. 3. Notice by publication (of the public notice form) shall be given once in a newspaper of general circulation in that portion of the county in which the subject property is located, at least fifteen (15) days prior to the date of the public hearing, and proof of publication shall be presented at the hearing by the applicant.
