DESCRIPTION OF THE PRDPOSAL Variance from Section 3.02.06 - Minimum Setback-Front Yard Michael K. Stahl A tract of land located approximately one (1) mile east of the State Highways 82 and 133 intersection, opposite Planted Earth 2.79 acres Individual well and Individual Sewage Disposal System State Highway 82 AIR/RD AIR/RD A. Site Description: The subject property is a lot between the Roaring Fork River and State Highway 82. The rear yard of the applicant's property includes the Roaring Fork River running through the middle of it. Improvements on the property include a single family dwelling unit that was burned down and is being rebuilt. An improvement Location Certificate attached on page• 4 • , shows the dimensions of the proposed house and the proposed new garage. B. Request: The applicant is requesting a varian·ce from the required fifty foot (50') front yard setback on the north side of the lot to build an attached garage to the new house. The proposed variance would put a wall of the garage eighteen (18) feet from the front lot line, which is adjacent to the State Highway 82 ROW. The application letter is attached on pages+'• " . II. MAJOR ISSUES AND CONCERNS A. Zoning: The front yard setback from an arterial street in the NR/RD zone district is 50 ft. from the front lot line or 75 ft. from the street centerline, whichever is greater. State Highway 82 is classified as an arterial street in the County Zoning Resolution. In this case, the Highway 82 driving surface is 80 ft. from the property line, giving the garage 98 ft. from the driving surface. --I- j ... . . ·.1.,;., '·' • B. c. • • Section 9.05.03 states that ~by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of this resolution or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property," the Board may authorize a variance. In addition, the Board must also find that: 1. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; and 2. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; and 3. That the circumstances found to constitute a hardship was not caused by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; and 4. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the applicant. The applicant does not have a large building envelope due to the location of the river and the existing individual sewage disposal system. Given the circumstance, staff agrees that there is a hardship created due to the unusual topography of the lot and that granting the variance will not have any detrimental effect on any adjoining property. IV. SUC'..OESTED FINDINGS I. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. I am rebuilding the hane on the existing foundation and would like to put a garage on the North side of the new house. 1. The available sites for the garage are limited by the existing setback on the west side, the Roaring Fork River on the South side and the septic tank/leach field on the East side. The available building area is limited by the odd shape of the property surrounding the existing foundation. 2. The existing foundation is perched on a site above the Roaring Fork River which has approximately eight to twelve feet of flat ground to the South of the foundation before the land drops off steeply to the river. 3. This dwelling was previously constructed of log and was consumed by fire on June 27, 1994. I would like to use the existing foundation to rebuild the house and add a garage as shown. This hane is below the view plane fran Hwy 82 towards Mt. Sopris. Extension of the garage into the northerly setback does not affect the Mt. Sopris view for persons traveling along Hwy 82. 2. Adjacent property owners will not be affected by the North side garage because they will only see it when traveling along Hwy 82. The proposed garage can not be seen fran any adjacent property owners' hanes or places of business. c. The hardship or difficulty associated with this request was not created by the applicant. Destruction by fire of the previous residence was not a deliberate act. The addition of the garage developed out of the 'subsequent redesign of the house and a desire to buffer the house fran Hwy 82 noise and North side heating losses. 4.
