Approximately 0. 92 acres Mid Valley Metropolitan Highway 82 and Dakota Drive R/L/SD A. Site Description: The subject property is located at the end of a cul-de-sac in the Dakota Subdivision. Approximately two-thirds of the lot is identified as wetlands and an irrigation ditch easement. Improvements on the site include an existing single-family home and certain accessory structures. A subdivision plan and site plan are included with this report. B. Request: The applicant is requesting a variance from the required twenty-five (25) foot front yard setback and the ten (10) foot side yard set back, to correct an error in the siting of the existing dwelling unit. The proposed variances would place the northeast comer of the existing dwelling 22.5 feet from the front property line and nine (9) feet from the side yard. The applicant has stated that the encroac ents were a result of incorrect staking of the lot corners. (See application pgs. ' /0) -1- • • II. MAJOR ISSUES AND CONCERNS Qj Zoning: Sections 3.03.06 (1) and (2) require that a front yard setback of 25 ft. and a side yard setback of 10 ft. be observed for any house located in the R/L/SD zone district. The existing house was built out of conformance, in that the northwest comer of the structure is within the 25 ft. front yard setback and the side yard setback of 10 ft., by 2.5 ft. and 1.0 ft. respectively. B. Section 9.05.03 states that "by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of this resolution or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property," the Board may authorize a variance. In addition, the Board must also find that: 1. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; and 2. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; and 3. That the circumstances found to constitute a hardship was not caused by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; and 4. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the applicant. C. The proposed variance is the result of incorrect staking of the lot in question. The lot is an irregular shape and the house was placed in the present location with the intent of meeting the setback requirements. To require the applicant's to remove a section of the existing structure would create an unnecessary hardship and the homeowner's association has no objection to the variance. Staff feels that the proposed variance is the minimum necessary. IV. SUGGESTED FINDINGS 1. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. -2- . • • 2. There was never any mention that the corners of the lot were not at the back of the curb, Nor on any maps is there mention of a future sidewalk or a "no mans land" existing on our property. When the house was laid out we used the back of curb as the start of the fifteen foot utility easement, and the 10 foot setback, which creates the twenty five foot front yard. When the neighbor to the east had their lot surveyed we discovered that the corner marker was not where it was conveyed to us it would be, additionally the property marker stake was at the back of curb but not in the correct location which is another logic 1 used when laying out the foundation. The third logic 1 used was the fact that when we bought the lot the same corner marker was laying on the ground, we asked the realtor to make sure all corners were staked out. When we saw the stake standing we assumed it was handled and never gave it another thought. t • • page 2 The House foundation ended up 7-4 3/4" in the twenty five foot setback. Removal of the section of the foundation encroaching on the setback would cause the front bedroom in the setback to have an inside net dimension of Nine feet six inches plus or minus, creating a room that could not be able to be used as a bedroom as was originally intended. A two foot six inch reduction in the required front setback and a one foot reduction in the side yard would elevate this problem 100%. We have attended a meeting of the Dakota subdivision homeowners association called to discuss this matter. We have their full support, there was much conversation and discussion of the explanation. The meeting ended up with no opposition from any of the attendees. Since the start of the construction of this home we have faced nine months of delay due to our construction loan company's filing bankruptcy in April of 1999 and the caseation of disbursements of funds since December of 1998. We look forward to the courts approval of our settlement offer to DeGeorge Capitol Corp. Sometime in late October early November. There was never any mention that the corners of the lot were not at the back of the curb, Nor on any maps is there mention of a future sidewalk or a "no mans land" existing on our property. When the house was laid out we used the back of curb as the start of the fifteen foot utility easement, and the 10 foot setback, which creates the twenty five foot front yard. When the neighbor to the east had their lot surveyed we discovered that the corner marker was not where it was conveyed to us it would be, additionally the property marker stake was at the back of curb but not in the correct location which is another logic 1 used when laying out the foundation. The third logic I used was the fact that when we bought the lot the same corner marker was laying on the ground, we asked the realtor to make sure all corners were staked out. When we saw the stake standing we assumed it was handled and never gave it another thought. • page 2 The House foundation ended up 2'-4 3/4" in the twenty five foot setback. Removal of the section of the foundation encroaching on the setback would cause the front bedroom in the setback to have an inside net dimension of Nine feet six inches plus or minus, creating a room that could not be able to be used as a bedroom as was originally intended. A two foot six inch reduction in the required front setback and a one foot reduction in the side yard would elevate this problem 100%. We have attended a meeting of the Dakota subdivision homeowners association called to discuss this matter. We have their full support, there was much conversation and discussion of the explanation. The meeting ended up with no opposition from any of the attendees. Since the start of the construction of this home we have faced nine months of delay due to our construction loan company's filing bankruptcy in April of 1999 and the caseation of disbursements of funds since December of 1998. We look forward to the courts approval of our settlement offer to DeGeorge Capitol Corp. Sometime in late October early November. This is the sole reason we have not tried to deal with this matter in an earlier time frame. We would like to thank the board for considering our request for a variance.
