RELATIONSHIP TO THE COMPREHENSIVE PLAN The tract of land is located in the Glenwood Springs Urban Area of Influence of the 1995 Study Area I, Garfield County Comprehensive Plan. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject property is located in the Western Hills subdivision in West Glenwood. The subdivision was developed in the early l 960's, prior to the County having any subdivision regulations and was built out in the 60's and 70's. B. Reqyest: The applicant is requesting the following variances: 1. Section 3.06.06 -Minimum Setback (1) front yard -reduce the minimum of25 ft. to 15 ft. from. (2) rear yard -reduce the 25 ft. minimum to 13 ft .. -/- • • III. MAJOR ISSUES AND CONCERNS A. Section 9.05.03 of the Zoning Resolution (Variance -Action by the Board of Adjustment) states that the Board may authorize a variance to relieve hardship, provided: 1. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; 2. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; 3. That the circumstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; 4. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. B. ZoniOf:: The Residential/Limited/Urban Density {R/L/UD) zone allows a single family residence and accessory uses as a use by right. The lot created in the subdivision in the l 960's was typical of the subdivision design at that time. (See Application Pgs. 3 -9 ) The lot is irregular in shape, leaving a very restricted building envelope, given that two of the setbacks created by the zoning after the subdivision was platted, have to be 25 ft.. It is staffs opinion that the lot is an unusual configuration and the requested setback is the minimum necessary to build the proposed addition. IV. SUGGESTED FINDINGS 1. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. V. It should be demonstrated by the above information and statements that, " ... where by reason of exceptjonaJ narrowness, shallowness or sh.aJlt of the specific piece of property at the time of enactment of this Resolution, or by reason of exceptjonaJ topographic condjtjon of such piece of property, the strict application of any regulation enacted under this resolution would result in peculiar and exceptional hardship upon the owner of such property". Submit applications to the Garfield County Plarutlng Department no later than the last Friday of the month in order to be included on the following month's agenda. Regular meeting of the Zoning Board of Adjustment scheduled on the fourth Monday of each month at 7:00 p.m .. 2. You will receive, from the Plarutlng Department, a "Public Notice Form" indicating the time and date of your hearing. 3. Notice by publication (of the public notice form) shall be. given once in a newspaper of general circulation in that portion of the county in which the subject property is located, at least fifteen (IS) days prlorto the date of the public hearing, and proof of publication shall be presented at the hearing by the applicant. (section 9.05.04 (!). 4. Notice by mailing (of the public notice form) shall be sent by certified return-receipt mail to all owners ofaU property within two hundred (200) feet of the subject property at least five (5) days prior to the hearing, and the return receipts showing receipt of notice shall be presented at the hearing by the applicant, unless the applicant is able to otherwise show evidence of adequate noticr 1to such owners. DAVIS AND MARY ELLEN DAVIS This is a narrative explanation attached to the Variance Application to the Garfield County Zoning Board of Adjustment. This narrative explanation refers directly to the SUBMITTAL REQUIREMENTS lettered A through K on the Application. The narrative explanation to the SUBMITTAL REQUIREMENTS is as follows: A. A sketch map showing all improvements building sizes, locations, set-backs, and is attached as Exhibits A-1 and A-2. on the site, access points B. A vicinity map showing the general geographic location of the property is attached as Exhibit "B". c. A legal description of the site as shown by the Warranty Deed of ownership is provided by a copy of the Warranty Deed attached as Exhibit "C". D. A practical description of the site is that the property is located approximately one quarter mile directly north of the west Glenwood I-70 Interchange on Melrey Road, the address of which is 0345 Mel Ray Road, Glenwood Springs, Colorado 81601. E. The names and addresses of all of the property owners adjacent to, or within 200 feet of, the site is attached hereto as Exhibit ''E''. F. Utilities are provided to the property as follows: Water is provided by the Glenwood Springs Water System; sewage disposal is provided by the West Glenwood Springs Sanitation District; electricity is provided by the City of Glenwood Springs Electric Department; and natural gas is provided by KN Energy, Inc. G. Plans and specficiations for the proposed addition are attached as Exhibit "G". H. The variance is being requested to allow a very modest addition of a living room, kitchen and garage addition on the north side of the residence. This residence was first built in 1964 before any zoning or set-back requirements existed in this county. The lot is oddly shaped to form a triangle with one side of the triangle fronting on Mel Ray Road. The residence was originally located as centrally as possible on the trianglular shaped parcel. In order to add any addition this very small house, it is probably necessary, going in any direction to violate at least one of the set-backs now applicable to the property. In this particular case, since the addition is being extended toward the north, a variance from the 25 foot rear yard set-back of Section 3.04.06(2), allowing the location of a part of the addition to within 13 feet of the rear property line is requested. Also, in the front one corner of the addition will be within 15 feet of the front lot line, 34 feet from the edge of the pavement of Mel Ray Road, and approximately 44 feet from the centerline of Mel Ray Road. Here a front yard set-back variance from Section 3.04.06(1} bringing the structure closer than 25 feet 4- • • from the front lot line is requested. This property meets the exception requirements of the Garfield County zoning Resolution in that most portions of the property, since it is triangularly shaped, are exceptionally narrow or exceptionally shallow leaving little room to locate any structure at the margins of the triangular shaped lot. J. The variance requested herein is the minimum necessary to alleviate the practical difficulties presented by the property. K. A $250.00 fee is enclosed herewith. OTHER PROCEDURAL REQUIREMENTS Upon submitting this Application, obtaining a hearing time and date, and a form for the public notice, applicant will commence the necessary publication in the Glenwood Post, which is a newspaper of general circulation applicable to this property. Such public notice publication will be published at least fifteen (15) days prior to the date of the hearing. Also, upon receipt of a mailing notice form from the Garfield County Building and Planning Department, the applicant will send certified mail, return receipt requested notices, to all owners of properties as listed on Exhibit "E". RELATIONSHIP TO THE COMPREHENSIVE PLAN The tract of land is located in the Glenwood Springs Urban Area of Influence of the 1995 Study Area I, Garfield County Comprehensive Plan. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject property is located in the Western Hills subdivision in West Glenwood. The subdivision was developed in the early 1960's, prior to the County having any subdivision regulations and was built out in the 60's and 70's. B. Request: The applicant is requesting the following variances: I. Section 3.06.06 -Minimum Setback (I) front yard -reduce the minimum of 25 ft. to 15 ft. from . (2) rear yard -reduce the 25 ft. minimum to 13 ft .. -/- • • Ill. MAJOR ISSUES AND CONCERNS A. Section 9.05.03 of the Zoning Resolution (Variance -Action by the Board of Adjustment) states that the Board may authorize a variance to relieve hardship, provided: 1. That the variance granted is the m1mmum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; 2. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; 3. That the circumstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; 4. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. B. Zoning: The Residential/Limited/Urban Density (R/L/UD) zone allows a single family residence and accessory uses as a use by right. The lot created in the subdivision in the 1960's was typical of the subdivision design at that time. (See Application Pgs. 3 ~ Cf ) The lot is irregular in shape, leaving a very restricted building envelope, given that two of the setbacks created by the zoning after the subdivision was platted, have to be 25 ft.. It is staffs opinion that the lot is an unusual configuration and the requested setback is the minimum necessary to build the proposed addition. IV. SUGGESTED FINDINGS I. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. This narrative explanation refers directly to the SUBMITTAL REQUIREMENTS lettered A through K on the Application. The narrative explanation to the SUBMITTAL REQUIREMENTS is as follows: A. A sketch map showing all improvements building sizes, locations, set-backs, and is attached as Exhibits A-1 and A-2. on the site, access points B. A vicinity map showing the general geographic location of the property is attached as Exhibit 11 8''. C. A legal description of the site as shown by the warranty Deed of ownership is provided by a copy of the Warranty Deed attached as Exhibit ''C''. D. A practical description of the site is that the property is located approximately one quarter mile directly north of the west Glenwood I-70 Interchange on Melrey Road, the address of which is 0345 Mel Ray Road, Glenwood Springs, Colorado 81601. E. The names and addresses of all of the property owners adjacent to, or within 200 feet of, tl1e site is attached hereto as Exhibit ''E''. F. Utilities are provided to the property as follows: Water is provided by the Glenwood Springs Water System; sewage disposal is provided by the West Glenwood Springs Sanitation District; electricity is provided by the City of Glenwood Springs Electric Department; and natural gas is provided by KN Energy, Inc. The variance is being requested to allow a very modest addition of a living room, kitchen and garage addition on the north side of the residence. This residence was first built in 1964 before any zoning or set-back requirements existed in this county. The lot is oddly shaped to form a triangle with one side of the triangle fronting on Mel Ray Road. The residence was originally located as centrally as possible on the trianglular shaped parcel. In order to add any addition this very small house, it is probably necessary, going in any direction to violate at least one of the set-backs now applicable to the property. In this particular case, since the addition is being extended toward the north, a variance from the 25 foot rear yard set-back of Section 3.04.06(2), allowing the location of a part of the addition to within 13 feet of the rear property line is requested. Also, in the front one corner of the addition will be within 15 feet of the front lot line, 34 feet from the edge of the pavement of Mel Ray Road, and approximately 44 feet from the centerline of Mel Ray Road. Here a front yard set-back variance from Section 3.04.06(1) bringing the structure closer than 25 feet -4- • • from the front lot line is requested. 'l'his property meets the exception requirements of the Garfield County Zoning Resolution in that most portions of the property, since it is triangularly sl1aped, are exceptionally narrow or exceptionally shallow leaving little room to locate any structure at the margins of the triangular shaped lot. The variance is being requested to allow a very modest addition of a living room, kitchen and garage addition on the north side of the residence. This residence was first built in 1964 before any zoning or set-back requirements existed in this county. The lot is oddly shaped to form a triangle with one side of the triangle fronting on Mel Ray Road. The residence was originally located as centrally as possible on the trianglular shaped parcel. In order to add any addition this very small house, it is probably necessary, going in any direction to violate at least one of the set-backs now applicable to the property. In this particular case, since the addition is being extended toward the north, a variance from the 25 foot rear yard set-back of Section 3.04.06(2), allowing the location of a part of the addition to within 13 feet of the rear property line is requested. Also, in the front one corner of the addition will be within 15 feet of the front lot line, 34 feet from the edge of the pavement of Mel Ray Road, and approximately 44 feet from the centerline of Mel Ray Road. Here a front yard set-back variance from Section 3.04.06(1) bringing the structure closer than 25 feet • • from the front lot line is requested. This property meets the exception requirements of the Garfield County Zoning Resolution in that most portions of the property, since it is triangularly shaped, are exceptionally narrow or exceptionally shallow leaving little room to locate any structure at the margins of the triangular shaped lot. J. The variance requested herein is the minimum necessary to alleviate the practical difficulties presented by the property. K. A $250.00 fee is enclosed herewith.
