The approval is conditioned upon the following items: I) That there be verification of the lease agreements covering the four (4) of the five (5) existing structures, allowing the structures to remain in place. Specifically, those structures located within the Southern Pacific Railroad property. 2) That the variance is only valid for the buildings as they exist and only as long as the leases are in force and that the variance does not allow for any expansion or replacement of the existing buildings without complying with the setback requirements in place at the time. 3) If purchase of the property occurs, then a sufficient amount of property must also be purchased to allow the existing structures to meet the setback requirements in effect at that time. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said properly; 2. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; 3. That the circumstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; 4. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. B. Zoning-The Commercial/Limited (C/L) zone district allows a 7.5 ft rear yard setback on lots without residential use. The applicant has noted that the request is for relief from the 7.5 ft. rear yard setback, when it is from the 25 ft. rear yard setback, since there are residential uses on the property. This does not invalidate the request, but any decision by the Board of Adjustment should be based on the 25 ft. set back. C. History -The applicant bought the property knowing about the property encroachments. Any approval of a variance should be based on the existing buildings present location and not provide for any expansion of the buildings in noncompliance with the required setbacks. The removal orreplacement of any building should void any variance from the setback requirements and require the new structure to be placed on the property in conformance with the setback requirements in place at the time. III. SUGGESTED FINDINGS I. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. Thal proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. Zoning Resolution of 1978, as amended f Lett er from B LM Glenn McCuen told the Board that he is requesting a variance to allow for a zero Jot line on a side yard that is adjacent to land owned by the Bureau of Land Management. The applicant started building a house on their property based on an incorrect survey of the property lines. As a result, the house was placed 4.47 foet outside of the property line and onto BLM property. The error was not discovered until the applicant had completed the foundation. At that time, communication with the BLM was initiated to try to acquire enough land to met the zoning requirements for the side yard setback. Due to BLM requirements for land acquisition, it will take 18 months to complete the process, which will result in the applicant not being able to meet the mortgage company requirements ------------------------------- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - for conversion ofa construction loan to conventional loan. The applicant is working with an engineer to cut the corner of the house off, so that it has a zero side yard setback. Mr. McCafferty told the Board that if the variance is not granted, the applicant will have to tear down the house that is nearly complete. The applicant's error was self imposed, but the solution without a variance would appear to be extreme, given that the impact on adjoining properties is minimal at best. Discussion regarding the issues of how he would cut the corner of the house off including the foundation, alternate solutions, surveying, OLM does not object to the O' side yard setback, well permit, and site constraints. Why do you feel that the variance should be granted: Ernie Fyrwald purchased the property in 1995. The buildings were in place at that time. We do not have any detailed history on the reason for the locations of the buildings but it appears that there was an error in the property description at some time in the past. The attached survey makes reference to a recorded property description that located the property line much closer to the railroad. It appears that the structures were built prior to discovery of the incorrect survey. The current survey was conducted in early 1995. The buildings have been in place for several years and the raih·oad is apparently aware of their location on railroad property. We anticipate having a statement from the railroad prior to the Board of Adjustment hearing on February 26. There was a lease agreement signed with the railroad in 1989 for the structure that extends the farthest into the railroad right-of-way. That lease has been transferred to Ernie Fyrwald (attached). There are currently discussions being conducted with the railroad for additional lease agreements to cover the other three buildings projecting into the right-of-way. Presently, four buildings (two ware houses and two mobile homes) cross the rear property line by various distances (see attached survey) ranging from .3 foot to 60 plus feet .• Additionally a third mobile home is located 5.23 feet from the rear property line. The rear property line is the railroad right-of-way and would normally require a 7. 5 foot setback. 3. Why do you feel that the variance should be granted: Ernie Fyrwald purchased the property in 1995. The buildings were in place at that time. We do not have any detailed history on the reason for the locations of the buildings but it appears that there was an error in the property description at some time in the past. The attached survey makes reference to a recorded property description that located the property line much closer to the railroad. It appears that the structures were built prior to discovery of the incorrect survey. The current survey was conducted in early 1995. 1'he buildings have been in place for several years and the railroad is apparently aware of their location on railroad property. We anticipate having a statement from the railroad prior to the Board of Adjustment hearing on February 26. There was a lease agreement signed with the railroad in 1989 for the structure that extends the farthest into the railroad right-of-way, That lease has been transferred to Ernie Fyrwald (attached). There are currently discussions being conducted with the railroad for additional lease agreements to cover the other three buildings projecting into the right-of-way, The lease agreement gives the railroad authority to terminate the agreement at any time and require the removal of the structures. -• • • Variance Application page 2 Removal of the structures as required to meet the standard rear lot setback would be a considerable financial burden to the Applicant . The buildings have apparently had no adverse affects on the public in their several years of existence, With an acknowledgement by the railroad, the Applicant requests that the buildings remain in their present locations. 4.
