Description of the Proposal: Request for Variance to Section 3.10.04 of the Garfield County Zoning Resolution (the Resource Lands zone district text section) Mountain Fuel Resources Approximately 1/2 mile west of the Rifle city limits on the North side of Highway 6 & 24 Resource Lands/Gentle Slopes and Lower Valley Floor North: South: East: West: RL (Resource Lands) ARRD (Agricultural/Residential/Rural Density) RL (Resource Lands) RL (Resource Lands) The applicant has requested a variance to the 100 foot side yard setbacks specified in the Resource Lands/Gentle Slopes and Lower Valley Floor zone district. II. Major Issues and Concerns: A. Previous History: This 9.64 acre parcel has been reviewed by the Planning Commission for subdivision into 3 lots of approximately 2, 2 and 6 acres each. Mountain Fuels already has pipe storage, a compressor station, and an office on the proposed six acre parcel. The company wants to provide the other two lots to employees as residential mobile home sites. Their request for variance to the 100 ft. side yard setback is to allow the two mobile horres to be placed 10 feet from the lot line (or twenty feet between mobile homes) so that utility connections are in closer proximity and thus less expensive to provide. If this variance is approved, the applicant must finalize their subdivision request and apply for two mobile home special use permits. B. Staff Comments: 1. There are no physical constraints on the property which would necessitate the variance requested. 2. A hardship on the applicant created by the Garfield County Zoning Regulations does not exist in this case. 3. The hardship is caused solely by the applicant; and use of the site can easily occur within the parameters of the existing zoning regulation. III. Findings: 1. That proper publication, posting of the property and public notice was provided as required by law for the hearing before the Board of Adjustment. 2. That all hearings before the Board of Adjustment were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. IV. Recommendation: Denial for the following reason : 1. There is no legal hardship created by the Garfield County Zoning Regulations. Box 11150 Salt Lake City, Utah 84147 Dear Mr. Nicolaides: January 24, 1983 We received your application for a Board of Adjustment review on your request for a variance to reduce minimum setback requirements on lots zoned Resouce Lands. Your application verbage seems in order, however, the map (plot plan) showing two 80' x 120' proposed trailer lots primarily on Parcel 'C' cannot be submitted because two or more mobile homes on one lot (parcel) will form a mobile home park. The original concept was for a mobile home on Parcel 'B' and Parcel 'C' as shown on the original map. We can submit the variance application, provided you change the plot plan so that one 80' x 120' area is on Parcel 'B' and one on Parcel 'C', in keeping with the originally stated concepts. With the variance your could place the mobile homes within 3'-1" of the property line between Parcel 'B' and 'C'. The Uniform Building Code would require one hour fire walls if closer than 3 1 to property lines, however, I would recommend a minimum of 20' between mobile homes to preserve occupant privacy. You would be required separate septic systems unless you can hookup to a public sewage system. I advised your Salt Lake office by telephone of the above situation on January 19, 1983 and requested that you return my call, since several days have passed, I am advising you by mail.
