GENERAL PROJECT DESCRIPTION The applicant owns a 6.38 acre property located at 28803 on Highway 6 & 24. The property has multiple commercial structures and the proposed subdivision would leave each proposed parcel with an already constructed building. The applicant is still determining where the proposed property line will be located. The request for a minor subdivision requires an Administrative Land Use Change Permit, pursuant to the Garfield County Land Use and Development Code. The site is located in the Commercial/General zone district, where the minimum lot area is 7,500 square feet. In the pre -application meeting, the applicant represented that the proposed split would be well above that minimum. Staff understands that currently, the buildings located on the parcel share an OWTS. The applicant will need to demonstrate that both newly created parcels will have access to an OWTS system. Per conversations in the pre -application meeting, it was determined that it was possible for both parcels to use the already in place OWTS, however the County will need detailed information about the location and quality of the system, as well as how it will be operated and maintained by the two parcels. Alternatively, the applicant could install one new OWTS so there is a system on both parcels. The waste water management plan should include the condition of the existing system, including permits and system details, and an outline of any proposed changes for a new system. The application should include any information on soils constraints or geologic conditions that may affect the feasibility or design of the OWTS. The applicant informed staff that the property is currently served by a well. The applicant will need to provide staff with a well permit that demonstrates legal water for both parcels. Depending on the timing of the last pump test, the County may require a new test as well as water quality testing. The property is adjacent to both County Road 221 and Highway 6 & 24. Currently, the property is accessed via Highway 6 & 24. A State Highway Access Permit from the Colorado Department of Transportation will be required to demonstrate legal access to the site. In addition, the applicant will need to demonstrate that both newly created Tots will have legal access either to the County Road or Highway 6 & 24. REVIEW PROCESS The review process shall follow the steps as contained in Table 4-102 and Section 4-103, Administrative Review. See attached flow -chart. IV. SUMMARY or SUBMITTAL REQUIREMENTS Application materials are generally summarized below. Please refer to Table 5-401 and Section 5-402 for a more detailed description of each requirement. 1) General Application Materials a) Application form and fee — available on Community Development's website b) Agreement to Pay Form — available on Community Development's website c) Ownership Documentation — a copy of a deed or title work and information on any lien holders d) Letter of Authorization — if the owner intends to have a representative submit the application e) General project description f) Statement of Authority — if the property is held by an LLC or Trust (see attached form) g) Names and mailing addresses of all owners of the property within 200' of the subject parcel — this is available using the Garfield County Land Explorer tool available on the Garfield County website h) Names and mailing addresses of all mineral owners on the subject site — see attached memo i) Copy of this pre -application form j) Colorado Geological Suivey Application foil II and fee (application attached) 2) Vicinity Map — 8"x11" copy 3) Site Plan this is the parcel shown with all improvements, the location of improvements, driveways, access roads, well, septic system, otc. Details regarding the site plan are found in 4-203(d) of the land use code 4) Water Supply/Distribution Plan — Legal and physical water information (well permit, pump tests, water quality tests, etc.) 3 5) Wastewater Management Plan — Include inforrnation on the existing ©WTS and as appropriate information on the feasibility of a future system on the proposed lot. 6) Proof of legal access to the site via a CDOT State Highway Access Permit as well as any easements that are needed for a parcel that does not have access to Highway 6 & 24 or the County Road 7) Respond as applicable to Standards fully described in Article 7, Divisions 1, 2, 3, and 4 of the Land Use and Development Code 8) Respond to Standards in Article 5-301(C) 9) Preliminary Engineering Reports e detailed in Table 5- 402 of the Land Use and Development Code a) Roads, Trails, Walkways, and Bikeways (if any) b) Sewage Collection and Water Supply and Distribution System c) Groundwater Discharge d) Preliminary cost estimates for improvements (if any) 10)Copies of any existing or proposed covenants on the property Submit three paper and one electronic copy (CD or USB Stick) of the application. Both sections contain review criteria for approval of waivers which need to be addressed in the application submittals. GENERAL APPLICATION PROCESSING Planner reviews the application for completeness and sends the Applicant a letter once the review is finished. If the application is not complete, the Planner will request further documentation or clarification from the Applicant. Once complete, Planning Staff and referral agencies then review the application to determine if it meets standards of review. Planner makes a recommendation of approval, approval with conditions, or denial to the appropriate hearing body which in the case of Administrative review is the Director of the Community Development Department. The Director's decision is subject to a 10 -day call-up period, during which the Director's decision may be reviewed by the Board of County Commissioners. VIII.
