Our completeness review included input from the County Attorney's Office and has identified several items that need to be addressed or clarified prior to a determination of technical completeness. Please respond to the following items: 1. Please submit copies of the OWTS permits as referenced in the application. 2. Please provide a copy of the Building Permit for the older structure on the parcel. 3. Please provide a copy of the referenced Colorado River Fire District's Letter. 4. Thank you for your responses to Division 7 in the Land Use and Development Code. Please respond to Table 7-107 Roadway Standards, with a statement regarding how many Average Daily Trips will be generated from the newly subdivided parcels and whether or not the internal roads and access on the property meet the County Roadway Standards. If the roads do not meet those standards, you may submit for a Roadway Standard Waiver (attached) or you may choose to upgrade internal roads. Please contact staff for further information if you choose to upgrade the internal roads. 5. Please further explain exception 10 in Schedule B — Section 2 of the Title Commitment. This exception states that there is a water well joint ownership agreement. Please address whether the well is already shared and explain the referenced document. 7. The application referenced the applicant's request to include the 4 -hour pump test of the well as a condition of approval. Please address whether there is a similar request for the water quality testing. 8. The supplied well permit states, "The use of ground water from this well is limited to fire protection, drinking and sanitary facilities for a commercial business and general commercial operations, ordinary household purposes inside one (1) single family dwelling, the irrigation of not more than 9,000 square feet of gardens and lawns, and the watering of two (2) domestic animals." It appears the proposed split would increase the number of commercial businesses that the well would serve to two and it seems that the well is only permitted to serve one commercial business. Please address this discrepancy and detail how the subdivision will have an adequate supply of water. If you have had any communication with the Division of Water Resources regarding this topic, please reference that as well. 9. The application states that there are two buildings on the property. However, the Assessor's website shows three. Please address this discrepancy and supply any applicable building permits. 10. Please provide an 11"x17" copy of the final plat. 11. Please provide topographic information to address grading and drainage. 12. Please provide a demonstration that parking requirements detailed in Table 7-302A will be met on both parcels. 13. To address landscaping standards, please supply photos of any landscaping existing on site, and include a view of the site from Highway 6 & 24. Once the above topics are addressed, we can finalize our completeness review and schedule a date for the Director's Decision. Please note that the Garfield County Land Use and Development Code requires that the technical completeness issues be resolved within 60 -days of the date of this letter. If not resolved in that timeframe, the application will be deemed withdrawn, unless a request for extension is submitted and approved. In response to your letter, please find the following: 1. Septic permit# 232 and 233 have been provided for the building constructed in 1981. Septic permit #Sept -3-13-2773 has been provided for the building constructed in 2013. 2. No building permit is required for the older structure as it was built in 1949, prior to building permits being required. 3. The letter was incorrectly referenced as a typo. This property had a letter submitted to Garfield County around the time of building permit was requested for the building constructed in 2013. The Applicant will have a new letter drafted as part of the minor subdivision referral process. However, I have included email correspondence dated August 30, 2013 from Mr. Kevin Whalen, Fire Marshal for the Colorado River Fire Rescue. 4. In response to Division 7 in the Land Use and Development Code, Table 7-107, The average daily trips generated from the newly subdivided parcels shall not change from its current use. Average daily trips is currently between 20-30. Peak hours are during daylight hours. The roads have been designed for safe and adequate access. There is a 30ft wide access point off Highway 6. This is a legal access point as determined by the Title Commitment and the Colorado Department of Transportation, email provided of such in initial submission. The interior roads have road base and are flat and allow for drainage, meeting the minimum requirements. 5. A copy of the Improvement Survey mentioned is provided. 6. The water well is already a shared well, but the document in the title commitment is old and believed to be out dated. Applicant wishes to replace existing document with a newer version of the shared well agreement to ensure proper terminology in use today. 7. The applicant would request water quality be a similar condition to approval, water test has been drawn, but the lab performing the test results will take between 3-4 weeks for results. 8. Individual Sewage Disposal Systein in order to evaluate the site soils for on-site sewage disposal, 1-X13ET observed four test pits previously excavated in the vicinity of the proposed absorption field, As indicated on the test pit logs included in Appendix A, the soils at the site consisted of sand and gravel fill materials above native silty clay soi]s, Groundwater was not encountered in the test pits at the time of the investigation. Percolation testing was conducted in 'fest lits TP -•1 through '['P-3. The percolation rate in the native soils ranged from 40 to 160 minutes -per -inch. The percolation testing data is included in Appendix B. In general, a percolation rule of between 5 to 60 minutes -per -inch is required for soils to be .deemed suitable for on-site sewage disposal. Therefore, based upon the results of the percolation testing, the native clay soils are not suitable for on -Site sewage disposal. As a result, replacement soils will be required below the absorption bed. hi addition to the percolation rate of the subsurface materials, the seasonal high groundwater elevation is an important factor in determining the suitability of elle site for Individual Sewage Disposal Systems. For ISDS suitability, the seasonal high groundwater elevation should be at least four l:eet below the bottom of the proposed :absorption bed. As indicated previously, groundwater was not encountered in the test pits at the time of the Investigation. Replacement soil consisting of imported saedy loam is recommended. Washed rock may not be used as replacement soil. The proposed replacement soil must be approved by the engineer. After the applicant files their application with Garfield County, then the County will refer Water Supply, identified by the applicant, to our Denver Office for comment. In general if an expansion of use of the well is proposed, then the well would need to be re -permitted. If a shared well is proposed, consider; a well sharing agreement, easement to the well, identify an out -parcel around the well for access and maintenance, ownership association, etc. When filing the subdivision application with Garfield County, the applicant needs to be very specific regarding the proposed water supply, for their proposed subdivision. The well agreement that Paige sent has no mention of the limit on commercial space, so I would also advise that each lot be limited to 6,250 square feet of commercial space. If additional commercial space is required, then we may need to amend the contract to increase it. If they anticipate a home on the second lot, they also would need to add another house to the contract (not like that is a huge amount of water anyway). was under the impression that the County will require the well to be pump and water quality tested for the subdivision process. If,they don't, I would also advise that they at least have it pump tested so they know what the yield is (I didn't find a pump test under the well permit information). It may be good to have that physical supply limit included in the well agreement too (i.e. if the yield is 15 gpm, limit each lot to 7.5 gpm). The agreement could even require flow restrictors be installed to ensure each lot receives half of the yield of the well.
