CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit does not ensure that
no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action.
2) • Construction details for this existing well have not been provided to this office; therefore, itis not known if the construction of this well is in
compliance with the Water Well Construction Rules, 2 CCR 402-2. The issuance of this permit does not relieve the well owner of responsibility
or liability in the event contamination of the groundwater source results from the construction or use of this well, nor does the State Engineer
assume any responsibility or liability should contamination occur.
3) Approved pursuant to CRS 37-90-137(2), on the condition that this well is operated in accordance with the West Divide Water Conservancy
District Augmentation Plan approved by the Division 5 Water Court in case no. 02CW0123. If this well is not operated in accordance with the
terms of said decree, it will be subject to administration including orders to cease diverting water. WDWCD contract #120309KC(a).
4) The use of ground water from this well is limited to fire protection, drinking and sanitary facilities for a commercial business and general
commercial operations, ordinary household purposes inside one (1) single family dwelling, the irrigation of not more than 9,000 square feet of
gardens and lawns, and the watering of two (2) domestic animals.
5) The pumping rate of this well shall not exceed 15 GPM.
6) The annual withdrawal of ground water from this well shall not exceed 3.78 acre-foot (1,231,713 gallons).
7) The return flow from the use of this well must be through an individual waste water disposal system of the non -evaporative type where the
water is returned to the same stream system in which the well is located.
8) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as
appropriate. The owner shall take necessary means and precautions to preserve these markings.
9) This well shall be located not more than 200 feet from the location specified on this permit and at least 600 feet from any existing well,
completed in the same aquifer, that is not owned by the applicant, excluding well permit no. 162511 (spacing waiver submitted by the well
owner).
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be
maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.

Beginning at a point on the North line of the right of way of State Highway No. 24 at its intersection with the West
section line of said Section 12, whence the West Quarter Section Corner of said Section 12, bears South 0°17' East
distance of 511.4 feet; thence North 0°38'30" West 779.0 feet to the South line of County Road; thence along said Soutl:
line of County Road North 89°29' East 491.5 feet;'thence South 0°29' West 572.0 feet to the North line of the right of wa)
of State Highway No. 24; thence along said North right of way line on a curve whose chord bears South 66°08' West
522.6 feet, to THE POINT OF BEGINNING.

right of way line of said County Road; thence North 89°3T45" East 271.82 feet along the Southerly right of way
line of said County Road; thence South 00°34'00" East 160.20 feet thence South 89°40'00" West 272.28 feet, to the
Point of Beginning.
