As a part of the review of your application for a
variance from Section 3.02.06 (3) of the Garfield County
Zoning Resolution, a method of eliminating the need for the
variance has been found. Section 5.05.03 (6) of the
Garfield County Zoning Resolution of 1978, as amended, allows
"porches, slabs and patios, walks, steps, fences, hedges and
walls" to be within a required yard, provided they are
unobstructed from ground level to the sky.
To verify that my interpretation of the above mentioned
section was correct, I consulted with the Garfield County
Attorney. He stated that if the patio was uncovered it would
not have to meet the setback requirements for Section 3.02.06
(3) of the Zoning Resolution. This eliminates the necessity
of having to proceed with the Board of Adjustment hearing.
