'!his letter will serve as confirmation that the Board of Adjustment, by
unanimous vote approved your request for a variance to the rear yard
setback requirement of Section 3.08.06(2) of the Garfield OJunty zoning
Resolution of 1978 as amended, on SeptellOer 20, 1985. '!his variance does
allow you to construct the proposed buildings on your site with a zero ft.
rear yard setback. Please note that all applicable regulations of the
Building Department still must be complied with.
In addition, I have enclosed a copy of the Resolution of Approval for your
related zone District Amendment rezoning the above mentioned property from
A/R/RD to C/G.

I. DESCRIPTION OF THE PROPOSAL

The applicant is in the process of rezoning the property from A/R/RD
to C/G. The applicant is requesting a variance from the rear yard
setback in the C/G zone district (Section 3.08.06(2)) of 7.5 ft. for
lots with no residential occupancy to zero feet. This would allow for
the placement of two proposed single story warehouse/shop buildings,
25 ft. by 100 ft. in size on the site.
II. MAJOR ISSUES AND CONCERNS
1. On September 9, 1985, the Planning commission, recommended to the
Board of County Commissioners, approval of the proposed rezoning
from A/R/RD to C/G. A public hearing on the proposal is
scheduled for September 30, 1985 before the Board of county
Commissioners. Approval of the variance should be contingent on
approval of the rezoning.
2. While adjacent properties are zoned A/R/RD, historically they
have been used for non-conforming, pre-existing commercial uses
including automobile storage and a gravel pit. The rear lot line
of the site will border on the Otto Zinke gravel pit property.
3. Based on the narrowness of the lot (50 ft.) and additional
setback requirement of 25 ft. from the front lot line and 10 ft.
from side lot lines, without any variance the available building
envelope on the lot would be very limited. Given this narrowness
of the lot and the nature of surrounding land uses, the requested
variance appears to be reasonable.

III.SUGGESTED FINDINGS
1. That due to the exceptional shape of the lot an undue hardship is
created.
2. That the variance requested is the minimum necessary to alleviate
the hardship.
3. That the variance will not detrimentally affect the general
public, including adjacent property owners.
IV. RECOMMENDATION
APPROVAL, of the variance request from Section 3.08.06(2) to allow a
zero ft. rear yard setback, with the following condition:

variance application may be reviewed at the Office of the Department of

to 1:00 P.M.) Monday through Friday.

I am in process of rezoning to Cornmerical, General with those setbacks I only
have 17~ feet left for a building due to the 50' width of the lot.
Site backs up to hillside along rear lot line so nobody should be adversely
affected by this variance.
