The meeting was called to order with the following members absent: MaryOdellandRichardMoolick. John Tripp appointed associate members Leo Jammaron and Pete Cabrinha to vote. The minutes of August 28th were approved with a change of date from August 27th to August 28th at the heading. Pete Cabrinha made the motion to approve as amended with a second from Allan Bowles. The motion carried unanimously. VARIANCE TO THE RANCH AT ROARING FORK PLANNED /DEVELOPMENT ZONING FRONT YARD SETBACK - ADRIAN AND BARBARA ANDERSON Jim Leuthauser gave approval that the public notice and mailings were in order. Glenn Hartmann entered the following as exhibits: A. Proof of publication B. Proof of mailing C. Application D. Staff report Pete Cabrinha made a motion that the exhibits be accepted with a second from Leo Jammaron. The motion carried unanimously. Glenn Hartmann summarized the staff report stating that the site was located in the Ranch at Roaring Fork and consisted of a .41 acre lot. Mr. Hartmann said that the applicant constructed a house on the lot a number of years back with a 20.4 ft. setback at that time rather than the 25 ft. requirement of the Zoning Resolution of Garfield County. The proposed addition to the building will maintain the same setback. The lot in question is triangular in shape and development of the lot is limited by the lot shape and the maintenance of front yard setbacks on two of its three sides. Mr. Hartmann listed the Suggested Findings and made note that staff recommended approval to allow a 20.4 foot front yard setback. Jim Milkovich, representative of the Andersons, added that after measuring the setback, he felt that the road was built at another place than was on the plat. Larry Hazelton asked Mr. Milkovich if he was satisfied with the Staff Recommendation. Mr. Milkovich said it was fine with him and the Andersons. John Tripp closed the public portion of the meeting with a motion from Leo Jammaron and a second from Allan Bowles. It was a unanimous decision. Leo Jammaron made a motion to recommend approval of the variance to allow a 20.4 ft. setback including the three findings. Pete Cabrinha seconded the motion and the motion carried unanimously. REQUEST FOR A VARIANCE FROM SECTION 5.05.03(8) ACCESSORY STRUCTURE IN REQUIRED YARDS - JOSEPH A. SCOTT Jim Leuthauser noted that public notice was properly made. Glenn Hartmann entered the following as Exhibits: Exhibit A - Proof of Publication B - Proof of Mailing C - Application D - Staff Report E - Letter from Cathleen & Jim Weaver Larry Hazelton made a motion to accept the exhibits which was seconded by Allan Bowles. The motion carried unanimously. John Tripp swore in Joseph and Jackie Scott to testify. Glenn Hartmann summarized the staff report stating that the site consists of a long and narrow lot located between the County Road and No Name Creek. A large portion of the lot is embankment above the creek with the buildable portion of the site lying adjacent to the road. The applicant has proposed construction of a six foot high fence within their required front yard setback, a portion of which has already been erected. The fence is designed to provide security and privacy for existing and proposed improvements on the site. Mr. Hartmann continued that Section 5.05.03(8) limits fences within a required front yard to be 3 feet in height. Hardships to development of the lot include both the narrowness of the lot and the exceptional topographic situation including No Name Creek and its embankment. The construction of the fence immediately adjacent to the existing roadway, will potentially conflict with county snow removal and road maintenance. As a result, Mr. Hartmann said the County Road and Bridge Department has recommended moving the location of the fence back from the road and establishing an agreement between the property owner and County, releasing the County from responsibility for damage to the fence resulting from maintenance operations. Mr. Hartmann noted that the three Suggested Findings were in the Staff Report and the recommendation was approval of a variance from Section 5.05.03(8) to allow a six foot fence within a required front yard, subject to the following conditions: 1. That Garfield County receive an executed agreement between the property owner and the County establishing that the County not be held responsible for any damage to the fence resulting from road maintenance operations. 2. That the location of the fence maintain a 5 ft. setback off the applicant's property line. 3. That the fence shall not encroach on the County Road right- of -way. Mr. Hartmann said that the last condition needed to be amended to read as follows: and any approval of the variance does not constitute a permit to build permanent structures on the County right -of -way." The Scotts, Staff and the members of the Zoning Board of Adjustment discussed the existing fence, the property lines, pre - existing conditions of railroad ties all the way along the property in back of which the fence was started and where the snow plow operator would dump snow when clearing the road. Mr. Hartmann said that a three foot fence would be allowed along the property without any further action. Jim Leuthauser made the point that a variance cannot be granted when the hardship is self imposed. 2- John Tripp said he felt a six foot fence was the way to go when there is a swimming pool on the property, because of safety. Mark Bean joined the meeting briefly and said that King Lloyd of Road and Bridge was concerned that there be five feet from the existing road for snow removal. Mr. Scott said he would get together with Dr. Weaver, who is leasing the property on the other side of the road, and see if some of the brush could be removed along the roadway to give additional room for snow. Mr. Scott also had some concern about the sprinkler system on his property and how it would be affected if the fence was moved back. Larry Hazelton said it was up to the Board to be only concerned with the six foot height of the fence and he felt it would be up to the applicant to make further arrangements concerning space for the snow removal and road maintenance. Mark Bean said it looked as if the road was not built according to the original survey. Jim Leuthauser said that there were a couple of issues that needed to be addressed and he would suggest that the meeting be continued for another month. Pete Cabrinha said that he would be willing to make a motion to allow the six foot fence at this hearing. Larry Hazelton said he would be willing to second such a motion, however the public portion of the hearing had not been closed. Mark Bean said the problem of the six foot fence could be resolved by having Dr. Weaver clear some of brush along the roadway. Glenn Hartmann, Mark Bean, and the Board discussed the option of the Board to approve the variance with only conditions #1 and #3 and eliminating condition #2 dealing with the 5 ft. setback. John Tripp, on a motion by Pete Cabrinha and a second from Leo Jammaron with unanimous approval, closed the public portion of the hearing. Leo Jammaron said the problem he had was that 95% of the road was on the Scott's property and asking a 5 foot setback when the road is narrow enough as it was. Allan Bowles felt that the Scotts could work with the County on the snow removal and that it was reasonable to allow the 6 foot fence. Mr. Scott said it would be in their best interest not to have their fence pushed over by snow removal. Pete Cabrinha made a motion that the variance be granted to allow a six foot fence within the required front yard with Condition 1 and amended Condition #3 as follows: That the fence shall not encroach on the County Road right- of-way and any approval of a variance does not constitute a permit to build permanent structures on the County right -of -way. The motion was seconded by Larry Hazelton. The motion carried with unanimous approval. The meeting was adjourned after an appointment of Larry Hazelton as Acting Secretary. APPLICANT:David and Alvera Howell LOCATION:A parcel of land situated in Lot 36 of Section 1, T7S, R89W; approximately 4 1/2 miles south of Glenwood Springs at State Hwy. 82 and County Rd. 114, southeast corner behind Hue Mart. SITE DATA:The site consist of a 1.05 acre parcel ACCESS:Two 30' access easements EXISTING ZONING:C /L, Commercial Limited ADJACENT ZONING:C /L II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in an area ofprimarily commercial development, with adjacent land uses incl ding a conveniencestore /gas station, auto body shop, and vacant ground. The site is generally level to moderate in slope with scrub growth. County Rd. 114 borders the site on the north and curves east and south along the property line. B. Project Description: The applicant proposes the construction of a 100' x 200' building on the site with a zero foot front yard setback. C. History: The lot was created by subdivision exemption in July, 1979 by Resolution No. 79 -78. III. MAJOR ISSUES AND CONCERNS 1. Hardships to development of the parcel include the shape of the lot and a 50' Public Service easement across the rear of the parcel. The lot shape results in front yard setback requirements of 25' along the long side of the parcel adjacent to County Rd. 114, while the easements on the site reduce the size of the available building envelope. 2. The application has been referred to the County Road and Bridge bepartment and Glenwood Springs Fire Protection District, with no comments received at this time. 3. Based on the potential for new development and expansion of existing developments in the Spring Valley area, the widening of County Rd. 114 at some future date is possible and has been proposed. At present, the existing road width is approximately 24' and located 40' from the applicant's property line based on available mapping. The County Road right -of -way in the vicinity is estimated to be 60+ feet in width. 4. Section 9.05.03(2) of the Zoning Resolution states that a variance should not result in substantial detriment to the public good. The proposed zero ft. setback with it's location adjacent to a broad curve in County Rd. 114 has the potential for impacts in light of future expansion of the roadway. See page M) 5. Section 9.05.03(1) establishes that any variance be granted to the minimum extent necessary to alleviate a hardship. The applicant has not submitted information adequate to establish that a zero ft. setback is the minimum necessary to alleviate the problems on the site. 1-- 6. Section 9.05.03(3) indicates that the circumstances found to constitute a hardship not be caused by the applicant. The size and configuration of the proposed building may be interpreted as contributing toward the hardships apparent on the site. IV. SUGGESTED FINDINGS 1. That the application for variance was found to be consistent/ inconsistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the hearing. V. RECOMMENDATION Approval or denial, of a variance from Section 3.07.06(1.B), front yard setback, to allow a zero ft. front yard setback, is entirely subject to the Board's findings regarding the conformity of the application to the requirements outlined in Section 9.05.03 of the Garfield County Zoning Requirements. If the application is not so in compliance, the Building Official shall notify the applicant of the deficiencies. No application for variance shall be forwarded to the Board until such compliance is achieved by the applicant. 9.05.03 Action by the Board of Adjustment: After the proper forwarding of an application for variance to the Board and where by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of enactment of this Resolution, or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property, the strict application of any regulation enacted under this Resolution would result in peculiar and exceptional practical difficulties to, or exceptional and undue hardship upon, the owner of such property, the Board may authorize upon the application relating to said property, a variance from such strict application so as to relieve such difficulties or hardship, provided however: 1) That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; 2) That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; 3) That the circumstances found to constitute a hardship were not caused by the applicant, are not due to or the result of general coMitions in the distract, and cannot be practically corrected; 4) That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. 9.05.04 Public Hearing: Hearings held on requests for variances from strict application of the provisions of this Resolution may, at the discretion of the Board, be conducted as a public hearing following public notice containing the name of the applicant, description of the property involved, a statement of the nature of the appeal, and the time and place of the hearing. APPLICANT:David and Alvera Howell LOCATION:A parcel of land situated in Lot 36 of Section 1, T7S, R89W; approximately 4 1/2 miles south of Glenwood Springs at State Hwy. 82 and County Rd. 114, southeast corner behind Hue Mart. SITE DATA:The site consist of a 1.05 acre parcel ACCESS:Two 30' access easements EXISTING ZONING:C /L, Commercial Limited ADJACENT ZONING:C/L II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in an area of primarily commercial development, with adjacent land uses including a convenience store /gas station, auto body shop, and vacant ground. The site is generally level to moderate in slope with scrub growth. County Rd. 114 borders the site on the north and curves east and south along the property line. B. Project Description: The applicant proposes the construction of a 100' x 200' building on the site with a zero foot front yard setback. C. History: The lot was created by subdivision exemption in July, 1979 by Resolution No. 79 -78. III. MAJOR ISSUES AND CONCERNS 1. Hardships to development of the parcel include the shape of the lot and a 50' Public Service easement across the rear of the parcel. The lot shape results in front yard setback requirements of 25' along the long side of the parcel adjacent to County Rd. 114, while the easements on the site reduce the size of the available building envelope. 2. The application has been referred to the County Road and Bridge Department and Glenwood Springs Fire Protection District, with no comments received at this time. 3. Based on the potential for new development and expansion of existing developments in the Spring Valley area, the widening of County Rd. 114 at some future date is possible and has been proposed. At present, the existing road width is approximately 24' and located 40' from the applicant's property line based on available mapping. The County Road right -of -way in the vicinity is estimated to be 60+ feet in width. 4. Section 9.05.03(2) of the Zoning Resolution states that a variance should not result in substantial detriment to the public good. The proposed zero ft. setback with it's location adjacent to a broad curve in County Rd. 114 has the potential for impacts in light of future expansion of the roadway. See page,,4 5. Section 9.05.03(1) establishes that any variance be granted to the minimum extent necessary to alleviate a hardship. The applicant has not submitted information adequate to establish that a zero ft. setback is the minimum necessary to alleviate the problems on the site. 6. Section 9.05.03(3) indicates that the circumstances found to constitute a hardship not be caused by the applicant. The size and configuration of the proposed building may be interpreted as contributing toward the hardships apparent on the site. IV. SUGGESTED FINDINGS 1. That the application for variance was found to be consistent/ inconsistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the hearing. V. No application for variance shall be forwarded to the Board until such compliance is achieved by the applicant. 9.05.03 Action by the Board of Adjustment: After the proper forwarding of an application for variance to the Board and where by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of enactment of this Resolution, or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property, the strict application of any regulation enacted under this Resolution would result in peculiar and exceptional practical difficulties to, or exceptional and undue hardship upon, the owner of such property, the Board may authorize upon the application relating to said property, a variance from such strict application so as to relieve such difficulties or hardship, provided however: 1) That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; 2) That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; 3) That the circumstances found to constitute a hardship were not caused by the applicant, are not due to or the result conditions in the and cannot be practically corrected; 4) That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. 9.05.04 Public Hearing: Hearings held on requests for variances from strict application of the provisions of this Resolution may, at the discretion of the Board, be conducted as a public hearing following public notice containing the name of the applicant, description of the property involved, a statement of the nature of the appeal, and the time and place of the hearing. An application for a zoning variance must be made to the:,Garfield County Planning Division. The complete application must be ,submitted at least 28 days prior to the Board of Adjustment meeting for which the request is scheduled. The fee for this application is $ 35.00 and must accompany the application. 2. Once an application for a zoning variance is submitted, the Planning staff will review the request. If the application is complete, the Planning staff will schedule a public hearing with the Garfield County Board of Adjustment. 3. The following steps must be completed not more than 30 days nor less than 15 days prior to the scheduled hearing with the Board of Adjustment: a. A public notice must be published once in a newspaper of general circulation in that portion of the County in which the subject property is located at least fifteen 15) days prior to the date of the public hearing.
