At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners Meeting Room, Garfield County Courthouse, in Glenwood Springs on
Tuesday , the 18th of March A.D. 19 97 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 97-13
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD
COUNTY SUBDIVISION REGULATIONS FOR MANGURIAN PARTNERSHIP.
WHEREAS, Mangurian Partnership petitioned the Board of County Commissioners of Garfield
County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land"
under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted April 23, 1984, Section 8:00 through 8:60 and for the division of a 81.683 acre tract as
described in Book 836, Page 153, as filed in the Offices of the Clerk and Recorder of Garfield County,
Colorado, into two (2) parcels of approximately 11.673 acres, more or less, and a remaining parcel, which
proposed divided parcels are more practically described as follows:
Parcel C: See Attached
Parcels A/B: Remainder Parcel
(in the State of Colorado and the County of Garfield); and

WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes
of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the division
does not warrant further subdivision review; and
WHEREAS, the Petitioner has demonstrated, to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic
water on each of said parcels, that there is existing ingress and egress to said parcels, that the location of
septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part
of an existing or larger development and does not fall within the general purposes and intent of the
Subdivision Regulations of the State of Colorado and the County of Garfield, and should, therefore, be
exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973,
30-28-101 (10) (a) -(d), as amended;
NOW THEREFORE, BE IT RESOLVED that the division of the above described Parcel "C" and
the Remainder Parcel from the above described 81.683 acre tract is hereby exempted from such definitions
and said tract may be divided into said Parcel "C" and the Remainder Parcel and may be conveyed in the form
of such Parcel "C" and the Remainder Parcel all as is more fully described above and that a copy of the
instrument or instruments of conveyance, when recorded, shall be filed with this Resolution.

A tract of land situate in the SE 1/4 of the SW1/4 of Section
19, Township 5 South, Range 92 West of the 6th Principal
Meridian being more particularly described as follows:
Beginning at the south 1/4 corner of said Section 19; thence
N 00"17'16" W 60.00 feet; thence N 89"57'57" W 46.26
feet to the TRUE. POINT OF BEGINNING a point on the north
right--of—way line of County Road No. 251; thence
N 89'5509" W 941.38 feet along said north right—of--way
line to the southeast corner of a tract of land described in Book 750 at Page
792 of the records of the Clerk and Recorder of Garfield County, Colorado;
thence N 00'06'40" W 539.59 feet along the east line of said tract; thence
N 89'57'07" E 939.57 feet; thence S 00'78'09" E 541.77 feet along
a fence to the TRUE POINT OF BEGINNING, containing 11.673 acres
more or less.
