The Herrmans did want me to ask though if you anticipate any other items that might lead to a denial decision other than the geotech analysis. In other words, they don't want to do the analysis if the application is ultimately going to be denied on other grounds. If you could let me know your thoughts that would be much appreciated. I spoke with the Director this morning and a conditional approval is not possible as the application has not demonstrated compliance with section 7-207 F. of the 2013 Land Use and Development Code, as amended. The county is unsure if the applicant will be able to demonstrate compliance with this requirement, particularly given the "no build" designation on the original plat. Both the designated no -build area and the lack of demonstration required by 7-207 F. are findings for denial. Based upon the above information you have 3 choices — request a continuance in order to provide the necessary documentation to establish the feasibility of development propose; move forward with the submitted application and receive a Director decision of denial (with the possibility of a call-up for CBOCC review); or request the application be withdrawn.
