WHEREAS,. Ray R. F'ender -has filed' a pet=ition, with the Board of County
CommissionerS of Garfield County, Colorado, -for approval 9f the Red Hill`
Planned Unit .Development; , and
WHEREAS; a' public hearing was held by this Board on July 29, 1985; and
WHEREAS, bas=ed on the evidence, testimony, exhibits,' study of :the
master ;plan: for the . unincorporated area of the County, comments from .the
Garfield,.County Planning Department and Garfield County Planning
`Commission And. comments from all interested parties:,. this Board finds as
-follows
.1: That -proper publication and public notice was provided as required
.by law for the hearing before the Board;
2.: That the hearing before the Board was extensive and complete, that
all pertinent facts, matters, and issues were submitted and that all.
interested parties were heard at the hearing;
3. That the Garfield:County Planning Commission has recommended to
this Board that the requested zoning change be granted, provided that
certain conditions be imposed upon the applicant;
4. That the proposed zoning is' in general compliance with the
recommendations set forth in the master plan for the unincorporated
area of the . County;
5. That the requested zone change amendment: and pan approval •meets
all requirements of the zoning resolution of Garfield. County, and
further, that the requested Planned Unit. Development is generally.
suitable and appropriate for the subject property concerning the
location, condition and circumstances of said property, and that the
proposed amendment implements the purposes and meets the standards and.
requirements of 'the Planned Unit Development_ provisions of the
Garfield County Zoning Resolution;
6. That the proposed land use will be generally compatible with the
existing land uses in the nearby area;
7. That for the above -stated and other reasons, the proposed zone
district amendment and Planned Unit Development plan is in the best
interest of the health, safety, morals, convenience, order, prosperity.
and Welfare 'of the citizens of Garfield County;

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County, Colorado, that the pet';tion for the Red Hill Planned Unit
Development plan be approved for the foliowi,..described property in the
unincorporated area of Garfield County as fo,'_.lwss
A. Approval of the Planned Unit Development expressly conditioned
upon the following conditions:
l. That no building permits be issued until a signed agreement
witla the Colorado Department of Highways is submitted to the. .'
Planning Department. Further, that no ( )
cert�.ficate s of
occupancy be issued untilthe agreedupon highway improvements
are completed. This does not include the signalization of the.
intersection.
2. That this approval does not include the approval of further
subdivision of this property., without compliance with the
applicable County Subdivision Regulations;

following zone districts, the boundaries of which shall oe indicated
upon Exhibit "A" which is attached hereto and incorporated herein by
reference.

General Provisions
A. Effect of Garfield County Zoning Resolution (adopted January 2,
1973).
The_ provisions of the Garfield County Zoning Resolution and the
successors thereof, as now in effect and as hereafter amended,
are by this reference incorporated herein as if set forth in
full, to the extent not divergent from the provisions of the Red
Hill Planned Unit Development Zone Regulations:
:3 Conflict.
The provisions of the Red Hill PUD Zone Regulations shall prevail
and govern the development of the Red Hill PUD provided, however,
where the provisions of the Red Hill PUD gone Regulations do not
clearly address a specific subject, the provisions of the
Garfield County Zoning Resolution, or any other ordinances,
resolutions" or regulations of Garfield County shall prevail.'
C. To carry out the purposes and provisions of the Garfield County
Zone Resolutions, Garfield County, Colorado and, particularly
Section 4.00 of that title, as amended, the Red Hill Planned Unit
Development Zone District is further divided into the following
Zone District classifications:
Highway Commercial
Common Open Space
The boundaries of these districts shall be located as shown on
the Ped Hill PUD Plan and shall be governed in conformity with
the hereinafter contained regulations.
2. HIGHWAY COMMERCIAL
A. Uses, by right:` Park, hotel, motel.
One residential dwelling and accessory uses for a caretaker.
Office for conduct of business or profession, studio for conduct of -arts
and crafts provided all activity is conducted within a building.
Commercial establishments and accessory buildings and uses as listed
below, provided the following requirements are observed:
1. All fabrication, service and repair operations are conducted within a
building;
2. All storage of materials or equipment shall be within a building;
3. All loading and unloading of vehicles is conducted on private.
property;
4. No dust, noise, glare or vibration is projected beyond the lot;
Wholesale and retail establishment including sale of food and beverages,
automotive and vehicular fuel and new parts.
General service establishment, including restaurant .(standard, fast food
or drive-in), bar in association with a restaurant, recreation, storage,
repair and service of automotive and vehicular equipment, vehicular
rental.
• Minimum .Lot Area: 75.00 square feet.
• Maximum Lot Coverage: 50 percent
• Minimum Setback

is along County'Road 107.
2. Raar yard 25 feet from rear lot Tine for lot occupied by

E. Maximum Height of Buildings: 35 feet.
F., Additional Requirements
All uses= shall be subject to the provisions under Section 5 Of
the- January 1, 1979 Garfield County Zoning Resolution
(Suppleme.ntary:Regulations)
`2 Any development will minimz:e negative visual impacts' through the
use of architecture and landscaping that is compatible with the
environmental constraints of the site. A development plan noting
the size, configuration and color tOnemel of all structures,
parking and access plans, along with• the location and:type. of
landscaping will be submitted to Garfield County prior to
building permit application.. The developmentplan will be
referred to the Carbondale Planning and Zoning Commission for
review and comment within 30 days :of submittal. • At the next
regular County Planning Commission meetin
g, the development plan
will be either approved or disapproved subject to modification.
Modifications noted_ must be made:prior-to and incorporated into
any building permit issued. If there is disagreement on the.
proposed changes, the Board of County Commissioners has the final
determination.
3. No additional excavation of the hillside will be allowed.
4. More than one principal use is allowed on a lot, if approved as a
part of a development plan.
C, COMMON OPEN SPACE

Section 28, Township 7 South, Range 88 West of the Sixth
Principal Meridian, Garfield County, Colorado, being more
particularly described as follows:
Beginning at a point on the westerly boundary of a
40 -foot road right-of-way, the centerline of which is
described at Book 181, Page 276, Garfield County Records,
from which the East One -Quarter Corner of Section 28 bears
South 71051'57" East, 691.53 feet distant; thence continuing
alongsaid westerly boundary- the' following courses and dis-
tances:
