Commissioners for Garfield County, Colorado, held at the
Commissioners' Meeting Room at the Garfield County Courthouse in
Glenwood Springs on the 20th day of February A.D. 1990 ,

RESOLUTION NO. 90-022
A RESOLUTION CONCERNED WITH THE APPROVAL OF TWO SPECIAL USE PERMIT
APPLICATIONS BY FINA OIL AND CHEMICAL COMPANY FOR NATURAL GAS
WELLS.
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has received an application from Fina Oil & Chemical
Company for two Special Use permits for natural gas wells on the
following described tract of land:
Well #14-22, located in the SW 1/4, Section 22, T6S, R94W
Well # 3-28, located in the NW 1/4 Section 28, T6S, R94W
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board held a public hearing on the 5th day of
February, 1990 upon the question of whether the above-described
Special Use permits should be granted or denied, at which hearing
the public and interested persons were given the opportunity to
express their opinions regarding the issuance of said Special Use
permits; and
WHEREAS, the Board on the basis of substantial
evidence produced at the aforementioned hearing has

was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested
parties were heard at that hearing.
3. That the application is in compliance with the Garfield
County Zoning. Resolution of 1978, as amended.
4. For the above stated and other reasons, the proposed use
is in the best interest of the health, safety, morals,
convenience, order, Firosperity and welfare of the
citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Garfield County, Colorado that the Special Use
permit be and hereby is authorized permitting the use of the above
described tract of land for a natural gas well upon the following
specific conditions:

That a mist control be placed at the end of the blooey

5 That weed free seed and mulch be utilized for .reclamationf
and there be continued monitoring of the reclamation by
the applicant or applicant's delegate. - • - _
6. - That the applicant shall provide evidence acceptable to ,.
the Board of County Commissioners that all utility
companies operating in, or with equipment in the vicini.ty
of the well sites have been notified to assure no damage
occurs to existing utility facilities. Said evidence
shall include letters from utility companies indicating
thatthey have been notified, written statements by the
• applicant indicating that there are no utilities in the
• area,, • and/or written statements from the • applicant out-
lining their working relationship and notification
policies with local utility companies.
7. The applicant shall have 120 days from the date of the
• Resolution of Conditional Approval to meet all conditions
set forth in the Resolution. The Conditional Use permits
• shall be issued when all conditions are met and shall
expire 120 days after issuance, unless construction or
• use has commenced.
8. The applicant will be required to place in each of its
contracts with its drillers and with their sub-
contractors a provision requiring those entities and
individuals to become knowledgeable of all conditions of
approval and to comply with all conditions of approval.
