Glenwood Springs on Tuesday , the 31st day of May A.D.

when the following proceedings, among others were had and&done, to -wit:
RESOLUTION NO. 83-128
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION FOR PETER KIEWIT AND SONS COMPANY.
WHEREAS, the Board of County Commissioners of Garfield County has
received an application from Peter Kiewit and Sons Company for a special
use permit for industrial operation; specifically, a low profile concrete
batch plant on the following described tract of land:
A parcel of land containing 22.6 acres more or less in the NE
1/4, Section 2, Township 6 South, Range 89 West of the Sixth
Principal Meridian in Garfield County, Colorado.
WHEREAS, pursuant to required public notice, the Board conducted a
public hearing on the 23rd day of May, 1983, upon the question of whether
the above described special use permit should be granted or denied, at
which hearing the public and interested persons were given the opportunity
to express their opinions regarding the issuance of said special use
permit; and
WHEREAS, the Board, on the basis of the evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. The proposed use is compatible with the uses existing and
permitted in the district in which it is to be located, provided
that certain hereinafter contained conditions be complied with.
2. That neither the impact on traffic volume and safety or on
utilities, or any other impact of the special use will be
injurious to the established neighborhood or zone district in
which the special use is to be located.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield
County, Colorado, that a special use permit be and hereby is authorized
permitting the use of the above described tract of land for industrial
operations; specifically, a low profile concrete batch plant upon the
following specific conditions:
1. That the use of the tract of land comply with all present and
future regulations of Garfield County relating to industrial
operations in the zone district in which the property is now or
may later be located.
2. That, prior to the issuance of the authorized special use permit,
the above described tract of land shall be severed from any other
tract of land upon which there may exist a principal use, unless
such other such principal use has been terminated at the time of
the issuance of the special use permit.
3. That all proposals of the applicant shall be considered
conditions of approval unless expressly stated otherwise by the
Board of County Commissioners.
4. That the haul trucks entering and existing the site not operate
between the hours of 8:00 A.M. to 8:15 A.M. and 4:00 P.M. to 4:15
P.M., or such hours as would conflict with school buses loading
and unloading children in the area.
5. Operations shall be between the hours of 7:00 A.M. and 5:00 P.M.,
Monday through Friday.
6. The permit shall expire in 5 years and is subject to an annual
review to determine whether it meets all conditions of approval.
7. This permit shall be expressly for the purpose of allowing
concrete batch plant operations for the I-70 Glenwood Canyon
project only.
8. That prior to the issuance of the subject special use permit, the
applicant shall obtain and submit to the Garfield County
Development Department/Planning Division, copies of it's permits
from all other governmental agencies.
