Smith Arnold L. Mackley Elmer (Buckey) Arbaney Don DeFord Mildred Alsdorf Chuck Deschenes , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 89-135 A RESOLUTION CONCERNED WITH THE MINOR MODIFICATION OF RESOLUTIONS NO. 83-128 AND 85-200 FOR THE COLORADO DEPARTMENT OF HIGHWAYS. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Peter Kiewit and Sons Company for a Special Use permit for industrial operation; specifically, a low profile concrete batch plant on the following described tract of land: A parcel of land containing 22.6 acres more or less in the NE 1/4, Section 2, Township 6 South, Range 89 West of the Sixth Principal Meridian in Garfield County, Colorado. WHEREAS, pursuant to required public notice, the Board conducted a public hearing on the 23rd day of May, 1983, upon the question of whether the above-described Special Use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. The proposed use is compatible with the uses existing and permitted in the district in which it is to be located, provided that certain hereinafter contained conditions be complied with. 2. That neither the impact on traffic volume and safety or on utilities, or any other impact of the special use will be injurious to the established neighborhood or zone district in which the special use is to be located. WHEREAS, the Colorado Department of Highways has requested that the Special Use permit, approved by Resolution No. 83-128 for Peter Kiewit and Sons Company, be changed to name the Colorado Department of Highways as the permit holder, given the fact that the Colorado Department of Highways owns the subject land which was done by Resolution No. 85-200; and WHEREAS, the Colorado Department of Highways has requested that the Conditional Use permit for a concrete batch plant approved in Resolution No. 83-128 be extended until November 1, 1989, for the completion of the Glenwood Canyon I-70 project. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado that the Special Use permit, approved by Resolution No. 83-128 to Peter Kiewit and Sons Company, be changed to reflect the fact that said permit and all conditions of approval contained in Resolution No. 83-128 be valid until November 1, 1989.
