when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 81-329
A RESOLUTION CONCERNED WITH TIIE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY
R. L. FARMER AND SONS, INC.
WHEREAS, the Board of County Coaw,issioners 6f Garfield County has received an application
from R. L. Farmer and Sons, Inc. for a special use permit for industrial operations; specificall-
an open pit sand and gravel mine, and one concrete and one asphalt batch plant on the following
described tract of land:
A tract of land contained within the S1 of the NE4 of
Section 35, T6S, R95W of the 6th P.M.
Beginning at the most north easterly corner, which lies appro—
ximately 10 feet south of an irrigation ditch center line,
whence the NE corner of said Section 35, a 1921 brass cap,
bears N37°08'34"E 1805.22 feet, thence southerly and
approximately parallel to said ditch the following courses,
S54°37'W 347.12 feet, S59°23'05"W 310.25 feet, thence
a leaving said ditch, S32°00'E 230.00 feet, thence 520°27'30"W
463.43 feet, thence N 44°04'35"E 525.96 feet, thence
N32°51'35"E 237.88 feet, thence northerly, 100 -feet from and
parallel to the northerly high water mark of the Colorado
Rive ' the folic.._ ngN13°42'E 203.36 fact,thence

NO2°41'E 128.14 feet, thence N25°45'E 94.37 feet to the
point of beginning, containing 4.67 acres more or less.
WHEREAS, pursuant to required public notice, the Board conducted a public hearing on the
28th day of September 1981, upon the question of whether the above described special use permit
should be granted or denied, at which hearing the public and interested persons were given
the opportunity to express their opinions regarding the issuance of said special use permit; and
WHEREAS, the Board on the basis of the evidence produced at the aforementioned hearing,
has made the following determinations of fact:
1. The proposed use is compatible with the uses existing and permitted in the district
in which it is to be located, provided that certain hereinafter contained conditions be
complied with.
2.That neither the impact on traffic volume and safety or on utilities, or any other impact
of the spacial use will be injurious to the established neighborhood or zone district in which
the special use is to be located.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado, that
a special use permit be and hereby is authorized permitting the use of the above described
tract of land for industrial operations; specifically, an open pit sand and gravel mine, and
one concrete and one asphalt batch plant, upon the following specific conditions: •
1. That the use of the tract of land comply with all present and future regulations
of Garfield relating to industrial operations in the zone district in which the property is
now or may later be located;
2. That, prior to the issuance of the authorized special use permit, the above described
tract of ].and shall be severed from any other tract of land upon which there may exist a
principal use, unless such other such principal use has been terminated at the time of the
issuance of the special use permit.
3. That the rights of the ditch use be protected;
4. That the landowner must bring the uses on the entire tract of land into compliance
with the Building Code and Garfield County Zonings Regulations.
5. That the applicant must meet all conditions indicated by the'Col.orado Division of
Wildlife, as follows:
a) A berm of 100 feet in width should be left between the pit and river
to prevent breaching by the river. The pit is located on the outside
curve of the river.
b) No cottonwood trees should he removed unless in the pit proper. Trees
removed should be replaced on a 7:1 basis.
c) The botton and shoreline of the pit should be irregular to enhance
aquatic life forms. Peninsulas are desirable.
d) An area 150-200 feet in length and located in the southeast corner
should be sloped at 5:1 to encourage aquatic plants and to provide
a mud flat for waterfowl.
e) Locate the batch.plant as far from the river as possible.
f) Revegetate with cottonwood trees, native shrubs and grasses.
