Cerise Don DeFord Mildred Alsdorf (absent) , Commissioner County Attorney Chuck Deschenes , Clerk of the Board , County Administrator when the following proceedings, among others were had and done,, to -wit:. RESOLUTION NO. 86-113 A RESOLUTION CONCERNED WITH AMENDING RESOLUTION NO. 86.-93 CONCERNED WITH AN EXEMPTION REQUEST BY BILL AND HELEN DAVIS. WHEREAS, the Board of County Commissioners of Garfield County did approve the Exemption Request by Bill and Helen Davis by the above mentioned Resolution No. 86-93. WHEREAS, the legal description for Parcel B requires minor corrections. NOW THEREFORE, be it resolved that this Board's Resolution No. 86-•93 be end hereby is amended to read in its entirety as follows: WHEREAS, Bill and Helen Davis, have petitioned'the Board of County Commissioners of Garfield County, Colorado, for en exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-8-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984, Section 8:00 through 8:60 and for the division of a 107 acre tract as described in Book 423, Page 15, as filed in the Office of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of approximately 4.194 acres and -102.806 acres, more or less, which proposed divided tracts are more particularly described as follows: Tract A: See attached legal description for Tract A. Tract B: See attached legal description for Tract B. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the. proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the division does not warrant further subdivision review, and BOOK 697 ? E 598 WHEREAS, the Petitionerhas demonstrated to the .satisfactionof the .: Board of Counts' Commissioners of Garfield County; Colorado;, that there is a reasonable probability of locating domestic water on each of. said; 'tracts, that there is adequate ingress and. egress to.said tractsy.that"the;; location of septic tanks will be permitted. by the Colorado Department:of Health, that the requested division is not part of'an existing ,or iarg"er development and does not fallwithin the.general.purposes and :intent` of. the subdivision regulations of theState Of Colorado and the county of: Garfield, and should, therefore, be exempted from the definition of `.the terms "subdivision and subdivided land" as set forth in 30-28--101 .(10) ;a) -(d), as amended; NOW THEREFORE, BE IT RESOLVE]) that the division of the above described tracts °A" and "B" fr-om the above described 107 acre tract.is hereby_ exempted from such definitions and said tract may be divided into parcels all as is more fully described*above, and ;said divided •tract. may be conveyed in the form Of such smaller tracts without further,.campliance- with the aforesaid subdivision statutes and regulations; provided, however, tnat this exemption is granted on the condition. and with the express understanding and agreement of the Petitioners that no further.. exemptions be allowed on said parcels and that a copy of the instrurilent or instruments of conveyance when- recorded shall be filed with this.
