Recorder BEFORE THE BOARD OF COUNTY COMMISSIONERS OF 'GARFIELD COUNTY, COLORADO RESOLUTION NO. 78 -1,0 BOOK 518 PAGE$97 WHEREAS, Ms. C. Lucille Fischer has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C. R. S. 1973, 30-28-101 (10)(a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 1.86 acre tract into three (3) tracts of approximately 0.60 acres, (hereinafter tract "A"), 0.62 acres, (hereinafter tract "B"), and 0.64 acres, (hereinafter tract "C"), more or less, and said tracts "A", "B", and "C" are more particularly described as follows: TRACT A A tract of land designated as tract No. 6 situated in the NE1 of Section 21, Township 6 South, Range 89 West of the 6th Principal Meridian lying westerly of the westerly bank of the Roaring Fork River and Easterly of the Easterly line of the County Road as constructed and in place described as follows: Beginning at a point on the Westerly bank of said river, N38° 11' W. 2073.52 feet and S16°17' E. 529.45 feet from the east 1 corner of said section 21, thence N.87°05' W., 258.98 feet to a point on the easterly line of said road; thence S12°14' E. 103.60 feet along the easterly line of said road; thence S.87° 05' E. 266.73 feet to a point on the westerly bank of said river; thence N.16°17'W. 105.89 feet along the Westerly bank of said river to the point of beginning. The above described tract of land contains 0.60 acres, more or less. TRACT B A tract of land designated as tract No. 7 situated in the N.E. 1 of Section 21, Township 6 South, Range 89 West of the 6th Principal Meridian lying Westerly of the Westerly bank of the Roaring Fork River and Easterly of the Easterly line of the County Road as constructed and in place described as follows: Beginning at a point on the Westerly bank of said river, N.38°11' W. 2073.52 feet and S.16°17'E. 635.34 feet from the east 3 corner of said section 21, thence N.87°05'W. 26.73 feet to a point on the Easterly line of said road; thence S.12 14'E. 103.60 feet along the Easterly line of said road; thence S.87°05'E. 274.48 feet to a point on the Westerly bank of said river; thence N.16°17'W. 105.89 feet along the Westerly bank of said river to the point of beginning. The above described tract of land contains 0.62 acre, more or less. TRACT C A tract of land designated as tract No. 8 situated in the NEy of Section 21, Township 6 South, Range 89 West of the Sixth Principal Meridian lying Westerly of the Westerly bank of the Roaring Fork River and Easterly of the Easterly line of the County Road as constructed and in place described as follows: Beginning at a point on the Westerly bank of said river N.38°11' W. 2073.52 feet and S. 16°17'E. 741.23 feet from the East 34 corner of said section 21; thence N. 87°05'W. 274.48 feet to a point on the Easterly line of said road; thence S. 12°14'E. 103.60 feet along the Easterly line of said road; thence S. 87°05'E. 282.23 feet to a point on the Westerly bank of said river to the point of beginning. The above described tract of land contains 0.64 acres, more or less. • BOOK518 PA6E898 WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that she desires said.,.,,.-. exemption for:. the purpose of re -sale of said tracts "A", "B", and "C" into single-family: residential acreage, and; WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of. County Commissioners of Garfield County, Colorado, that there is a reasonable probability'' of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that central sewer service is available to saidtracts, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the. State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdi.vision" and "subdivided land" as setforth in C. R. S. 1973., 30-28=101(10)(a) 77 '.(;d) as amended, NOW,. THEREFORE, upon the motion of Richard C. Jolley, seconded by Eleven J. Cerise-, and carried, said 1.86 acre tract --may be divided into three tracts of 0.60, 0.62, and 0.64 acres, more or less, all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaia subdivision statutes and regulations.
