Deputy when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 80=150 Commissioner Chairman Commissioner Commissioner County Attorney Clerk of the Board RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR.CHARLES HARRIS WHEREAS, Charles Harris has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 9.64 acre tract described as follows: in Book 380, Page 537 and Book 370, Page 88 as recorded in the Office of the Clerk and Recorder of Garfield County, Colorado, into 2 tracts. of approximately 2.58 and 7.06 acres each, more or less, which proposed divided tracts are more particularly described as follows: Tract A: A parcel of land situated in Lot 2, Section 25 township 7 South, Range 88 West of the Sixth Principal Meridian, more particularly described as follows: Beginning at a point on the westerly line of said Lot 2, whence the Witness Corner to the Southwest Corner of said Section 25 bears S.26°11'00"W. 2991.62 feet; thence north 47.28 feet along the Westerly line of said Lot 2 to the centerline of a drive as con- structed and in place; thence along the centerline of said driveway the following bearings and distances; N.46°02'09"E. 156.22 feet; thence N.25 °14'22"E. 200.93 feet; thence N.09°36'39"E. 192.80 feet; thence N.64° 53'48"E. 96.85 feet; thence N.50°42'16"E. 130.42 feet; thence leaving said driveway, east 304.74 feet; thence south 136.16 feet; thence west 469.68 feet; thence south 512.22 feet; thence S.89°21'00"W. 254.02 feet to the Point of Beginning, containing 2.58 acres, more or less, subject to easements of record; sub- ject to a county road through the southerly portion of the property. Tract B: A parcel of land situated in Lot 2, Section 25, Township 7 South, Range 88 West of the Sixth Principal Meridian, more particularly described as follows: Beginning at a point on the Westerly line of said Lot 2, whence the Witness Corner to the Southwest Corner of said Section 25 bears S.25°47'22"W. 3034.12 feet; thence along the centerline of a driveway as constructed and in, place the following bearings and distances; N.46°02'09"E. 156.22 feet; thence N.25°14'22"E. 200.93 feet; thence N.09°36'39 "E. 92.80 feet; thence_N.64°53'48"E. 96.85 feet; thence N.50°42'16"E. 130.42 feet; thence leaving said driveway, east 304.74 feet; thence North 263.84 feet; thence west 723.68 feet; thence south 867.82 feet to; the Point of Beginning, containing 7.06 acres, more or less, subject to easements of record; sub- ect to a county road through the southerly portion 1 J BOOK 552 PAGE 361 of the property. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners. of Garfield County, Colorado, that the proposed division does not fall `within ;the purposes of Part 1,Article 28, Title' 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created is not great enough to warrant a full subdivision review; and WHEREAS, the:. Petitioner. has demonstrated to the satisfaction of the Board of County Commissioners: of: Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingressand egress to said tracts, that the location of septic tanks will be permitted by; the Colorado Department of Health that. the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of ,Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as. amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts "A" and "B" from the above described 9.64 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid sub- division statutes and regulations provided, however, that this exemption is granted on the condition ;and _with the express understanding and agreement of the Petitioner that no further exemptions be allowed on said tracts "A" and "B", '. and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
