This letter is given to satisfy the duty to disclose the reserved rights attendant to the subject real property. The "Subject Property" is the approximately one hundred acres, located at 16411 Old Highway 82 and titled to: Aspen Polo Partners, LLP. I have reviewed the records in the office of the Clerk and Recorder for Garfield County, Colorado. All recitations of Book and Page refer to such records. No research has been undertaken outside the records of the Clerk and Recorder for Garfield County, Colorado. I began with the two Patents for the subject property, which is today owned by Aspen Polo Partners, LLP under the Special Warranty Deed recorded on 1 June 2017 as Reception# 893042. In addition to the two Patents, there are three documents of record that create reserved rights. They are: 1. The Warranty Deed recorded in Book 208 at Page 584, Reception# 105766, conveyed the property to Margaret R. Phipps. However, an undivided one-half interest of the "oil and gas" rights was reserved by the grantors, Posic Cerise and 011ie Cerise. 2. Margaret R. Phipps conveyed property by Deed recorded in Book 257 at Page 110, Reception# 175244 to Oscar Cerise and Wilma Cerise, which conveyance included an undivided one-half interest in the mineral rights. 3. Thereafter, by Quitclaim Deed recorded in Book 333 at Page 302, Reception #213359, Oscar Cerise and Wilma Cerise conveyed to Posic Cerise and 011ie Cerise their undivided one-half interest in "all oil and gas rights". www.wrightlawaspen.com WRIGHT LAW ASPEN, LLP Glenn Hartmann, Senior Planner 10 October 2017 Page 2 Re: Reserved Rights Ownership Aspen Polo Partners, LLP Under the rights retained by Posic Cerise and 011ie Cerise in the document described in number #1 above, and the rights acquired by Posic Cerise and 011ie Cerise in the document described in #3 above, record title to all of the reserved rights today is vested in Posic Cerise and 011ie Cerise. No address is provided in 1961 Quitclaim Deed for by which Posic Cerise and 011ie Cerise acquired the remaining undivided one-half interest. The records affecting the Subject Property have been dated down to 29 September 2017, at which time there were no further conveyances of reserved rights. There are not conveyances or death certificates of record affecting Posic Cerise and 011ie Cerise and their last document of record is from 1961. Consequently, today the record beneficial owners of reserved oil and gas rights are Posic Cerise and 011ie Cerise, and Aspen Polo Partners, LLP, has no subsurface rights.
