Re: Amendment to the Aspen Equestrian Estates Preliminary Plan Approval
Honorable Board Members:
Attached hereto please find a request from Aspen Equestrian Estates, LLC, to amend their
preliminary plan approval. The preliminary plan was approved with a condition that a plat
note regarding the geology be included. However, the required plat note differs slightly from
the original meaning in the Geotechnical Report (see enclosed letter from applicant dated
1/25/00). Since the amendment is technical in nature, staff finds it will not change the original
intent of the preliminary plan approval and recommends the Board approve of the request to
modify the plat note. Enclosed, please find a resolution prepared for this purpose.

Dear Kit:
Previously I have expressed concern the specific language of one of the plat notes in
the draft resolution approving the Aspen Equestrian Estates Preliminary Plan. The
note regarding potential sinkholes is comprised of two sentences. The first identifies
the potential risk and the second is intended to specify certain actions in this regard.
consulted with Steve Pawlak of Hp Geotechnical and he confirmed that the language of
the second sentence as worded in the resolution is not as was specified by the
geotechnical study prepared for the Aspen Equestrian Estates site under his direction.
His recommendation is that the language of the second sentence should be taken word
for word from the HP Geotechnical report dated August 31, 1998.
Below is the questioned plat note as it appears in the resolution followed by the revised
plat note using the sentence from the HP report (page 4) that Steve recommends as
the appropriate second sentence.
Existing Resolution Plat Note:
Potential homeowners should be aware that the building sites can not be
considered totally sinkhole free since the Eagle Valley Evaporite is present in
the subsurface. Site specific studies must be conducted for individual lot
development in order to detect the presence of subsurface voids.
Revised Plat Note:
Potential homeowners should be aware that the building sites can not be
considered totally sinkhole free since the Eagle Valley Evaporite is present in
the subsurface. The potential presence of subsurface voids should be
considered when planning site-specific foundation studies.

Attached is a letter from Steve Pawlak confirming the accuracy of the proposed change
to the plat note.
If possible, I would request to clarify this plat note revision with the Board of County
Commissioners at the earliest and most appropriate opportunity. I respectfully look to
your direction on how and when this may be accomplished. At a minimum, I would
hope you could provide, in writing, Staffs concurrence with the appropriateness of the
proposed revision.

Dear Mr. Weinberg:
As requested by Ron Liston, we have reviewed our geotechnical study report for the
project dated August 31, 1998 with regard to encountering sinkhole related problems at
building sites.
The County's note "Site specific studies must be conducted for individual lot
development in order to detect the presence of subsurface voids", in our opinion,
should be changed to our wording "The potential presence of subsurface voids should
be considered when planning site specific foundation studies".
