HomeMy WebLinkAbout2.0 Resolution 2000-271 JIIlII 11111 11111111111111111 III 1111111 111 111111111101 561921 04/12/2000 09:06A 61181 P904 M ALSDORF 1 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) eikFp A/gYO At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday the 10 thday of Apri 1 John Martin Walt Stowe Larry McCown Don DeFord Mildred Alsdorf Ed Green A.D. 2000 _ there were present: , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator RESOLUTION NO. 2 0 00- 27 A RESOLUTION CONCERNED WITH GRANTING APPROVAL OF AN AMENDMENT TO A PRELIMINARY PLAN RESOLUTION OF APPROVAL, if 2000-015; WHEREAS, Jay Weinberg of Aspen Equestrian Estates, LLC, petitioned the Board of County Commissioners of Garfield County, Colorado, for amendment to a preliminary plan approval pursuant to the Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984, Section 4:00 through 4:94 concerning a tract of land described as a parcel of land situated in a portion of Lots 3, 4, 6, 17, 18, and 19, Section 31, Township 7 South, Range 87 West of the 6th P.M.; (in the State of Colorado and the County of Garfield); and WHEREAS, Aspen Equestrian Estates, LLC has filed an application with the Board of County Commissioners of Garfield County for approval of an amendment to the conditions of approval of a Preliminary Plan for the Aspen Equestrian Estates Subdivision of the Preshana Farms PUD; WHEREAS, The amendment is technical in nature and concerns a required plat note. The plat note as approved by resolution 2000-15 states: "Potential homeowners should be aware that the building sites cannot be considered totally sinkhole risk free since the Eagle Valley Evaporite is present in the subsurface. Site specific studies must be conducted for individual lot development in order to detect the presence of subsurface voids" and the request is to amend the plat note to state: "Potential homeowners should be aware that the building sites cannot be considered totally sinkhole risk free since the Eagle Valley Evaporite is present in the subsurface. WHEREAS, based on the material submitted by the applicant and the comments of the Garfield County Planning Department, this Board finds as follows: 1. That proper publication, public notice and posting was provided as required by law for the hearing before the Board of County Commissioners; 2. That the hearing before the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing; 3. That the 1978 Garfield County Zoning Resolution, as amended, the Garfield County Subdivision Regulations of 1984, the Garfield County Comprehensive PIan for Study Area 1, the Garfield County road standards and policies, and all other applicable local, state, and federal regulations, resolutions, plans, and policies appear to be in compliance; 4. That for the above -stated and other reasons, the proposed amendment to the conditions of approval of the preliminary plan is in the best interest of the health, safety, morals, convenience, order, prosperity, and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED, that the amendment to resolution 2000-15 concerning the approval of the Preliminary Plan of the Aspen Equestrian Estates Subdivision (of the Preshana Farms PUD), for the above described unincorporated area of Garfield County, be approved with the following conditions: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval; 2. That all conditions of approval contained in resolution 2000-15 shall still be binding except for the following amendment to a required plat note: p "Potential homeowners should be aware that the building sites cannot be considered totally sinkhole risk free since the Eagle Valley Evaporite is present in the subsurface.
