NOTICE OF VIOLATION — ZONING/BUILDING CODE
Dear: Mr. Mellin
Garfield County is giving you notice that we believe you are in violation of the Land Used
Development Code of Garfield County. The location where the violation is occurring is at
Assessor's Parcel No. 23908300013 located on an unaddressed parcel on CR 110. It has been
observed on numerous occasions from 2-16-2018 to 2-27-2018 that the property in question is
being used as a contractor's yard with commercial storage and as a commercial staging area. A
wide range of commercial supplies from concrete forms, precast concrete drainage structures,
scaffolding, ladders, plumbing supplies, landscape material, rocks and dirt from other jobs are
being stored on the property. Heavy equipment and a variety of trailers, a dump truck and other
equipment is also being stored on the property. It would appear that the parcel is being used as a
staging area for employees, supplies and equipment and on one occasion equipment maintenance.
It is a violation to use the property for commercial use and as a contractor's yard. This property
was the subject of a recent land use permit that was denied in part due to the residential nature of
the neighborhood and the danger of adding additional traffic to the existing narrow and steep
county road.
Correction and Remedy:
You are hereby given notice, pursuant to Article 12 of the LUDC, that you have 10 days from
receipt of this notice to completely correct the violations or cease and desist from continuing the
violation. Under Article 12 of the LUDC, your failure to correct or cease the violations on your
property may result in one or more of the following enforcement actions being taken against you:
1. Revocation of any building permits issued for improvements of the subject property;
2. Denial of additional land use approvals or building or other development applications
pertaining to the subject property;
3. Suspension of any land use approvals for the subject property;
4. Withdrawal of any development permits that are being violated;
5. Forfeiture of any vested property rights;
6. Criminal enforcement;
7. County court civil penalties;
8. Civil lawsuit.
You have the right to appeal this Notice of Violation, pursuant to the provisions of the Garfield
County LUDC. Garfield County Building and Zoning regulations, Enforcement Protocol and
permit application forms are available at www.garfield-county.com in the Community
Development directory.
