CONDITIONS OF APPROVAL
This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit does not ensure that
no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action.
The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18.
Approved pursuant to CRS 37-90-137(2), to use an existing well permitted under 75843-F (canceled), on the condition that this well is
operated in accordance with the Basalt Water Conservancy District's Augmentation Plan approved by the Division 5 Water Court in case no.
01 CW0305. If this well is not operated in accordance with the terms of said decree, it will be subject to administration including orders to
cease diverting water. BWCD contract #292. This well is known as Lake Springs Ranch Well D.
Approved for the installation of a pump in, and the use of, an existing well, constructed on June 23, 1995, to a depth of 320 feet, under
monitoring and observation hole notice 25625 -MH and later permitted for use under permit nos. 56292-F (expired), 60687-F (expired), 75843-F
(canceled) and 77836-F (expired).
The use of ground water from this well is limited to a water supply for 196 residential units and 2 commercial units and 11.36 acres of
landscape irrigation (approximately 2,500 square feet of irrigation per unit). All use of this well will be curtailed unless the plan of
augmentation is in effect.
The pumping rate of this well shall not exceed 150 GPM.
The combined annual amount of ground water to be appropriated by Lake Springs Ranch Wells C, 0, & E pursuant to BWCD contract #292
shall not exceed 108 acre-feet.
The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as
appropriate. The owner shall take necessary means and precautions to preserve these markings.
This well must be located not more than 200 feet from the location specified on this permit and at least 600 feet from any existing well,
completed in the same aquifer, that is not owned by the applicant.
A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be
maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
NOTE: Permit nos. 25625 -MH, 13821 -AD, 56292-F (expired), 60687-F (expired), 75843-F (canceled) and 77836-F (expired), were
previously issued for this Well.
