RE: Director Decision - Minor Modification to the Circle B Land Company LLC,
Use Change Permit (LIPA-05- 14-7915)
Dear Chase:
The County is in receipt of your Application requesting a Minor Modification to the
existing cúcle B Land company LLC, Land Use change permit for a 5 Acre
Storagé yard (taydown yard) and Welding Facility (LIPA-0S-14-7915). The site is
locate-d approximately 5 miles south of the Town of Silt, off of County Road 326 in
Section id, T65, Rg2W of the 6th P.M. on a portion of that property known by
Assessor's Parcel No. 2179-233-00-203. ln accordance with the Garfield County
Land Use and Development Code Section 4-106 a pre-application meeting has
been held to consider whether the requested modification meets the criteria
contained in Section 4-106 (C) for a Minor Modification and a Director's
Determination issued finding that the Minor Modification criteria were met.
The Director's Decision is hereby issued, approving the Minor Modification as
requested, in accordance with Section 4-106 8.1 .a., with the following clarifications
and determinations.
a. The Amended Land Use Change Permit Application submittals were
determined to be complete in accordance with the Director's Determination
Letter dated 2123118.
b. That the Applicant has demolished the pre-existing barn structure-
c. That the Applicant has established a revised building envelope for a new
structure that will fully comply with all building code and fire code
requirements.
d. That the Fire Protection District will review the building plans prior to
issuance of the Building Permit.
e. That all conditions of approval have been met.

In accordance with and pursuant to provisions of the Garfield County Land U1e and
Development Code, as amended, a Resolution of Approval of the Board of County
Commissioners of Garfield County, State of Colorado, and a Director's Decision
determining the request meets the criteria for a Minor Modification, the following activity
is hereby authorized by an Amended Land Use Change Permit:
A 5 acre Storage Area (taydown yard) and Welding Facility as shown on the
Amended Site Plan Attached as Exhibit "A" showing a revised building footprint
for a storage and wetding building (File No _LPAA-03-18-8623, original File No.
LtPA-05-14-7915)
This Amended Land Use Change Permit - Limited lmpact Review is issued subject to
conditions of approval as set forth in Exhibit "B" and shall be valid only during compliance
with such conditìons and other applicable provisions of the Garfield County Land Use and
Development Code, as amended, Building Code, and other regulations of the Board of
County Commissioners of Garfield County, Colorado'

Conditions of Approval
Conditions Prior to Issuance
1. The Applicant shall treat the idcntificd Russian Knapweed and Musk
Thistle prior to construction with satisfactory verification of treatment
provided to the Vegetation Manager no later than October 31, 2014.
Treatment and verification of treatment shall be completed prior to
issuance of the Land Use Change Permit.
Z. The Applicant shall more fully discuss the fire protection measures that
will be in place on the site. This should specifically address how the
Applicant will prevent the barn, which is a significant fire hazatd if
utìhzed for welding or storage pulposes, will be prevented from being
used for such purposes. This documentation shall be reviewed and
accepted by the Garfield County contract engineer prior to issuance of the
Land Use Change Permit.
Other Conditions
3. That all representations made by the Applicant in the application shall be
conditions of approval, unless specifically altered by the Board of County
Commissioners.
4. That the operation of the Storage and Welding facility shall be done in
accordance with all applicable Federal, State, and local regulations
governing the operation of this type of facility.
5. The facility shall maintain compliance with Storm Water Management
plan, Drainage and Grading Plans and Reclamation for the site.
6. The Applicant shall control fugitive dust during the operation of the site.
7. The facility shall maintain compliance with Section 7-306 Lighting, with
all lighting to be directed inward and downward toward the interior of the
site. Facilities shall be painted a non-glare neutral color to lessen any
visual impacts.
8. The Applicant shall comply with the submitted Noxious V/eed
Management Plan including the best management practices.
g. To protect air quality, vehicles should not be permitted to remain idling.
10. A portable toilet and bottled water shall be provided onsite.
11. The barn shall not be used for storage or welding operations.
12. Hours of operation shall be limited to 7AM to 5PM
