This facility, the Scott SWD, is one that was originally constructed by BBC in the summer of 2006 under the assumption that the permitting that was required by the COGCC was all that was needed for such facilities. As we all know now, Garfield County is exercising its land-use authority of the surface impacts of such facilities, however, this facility clearly predates those discussions. As part of our efforts to improve this facility - replacing the original earthern berm around the tank battery with a steel ring containment and synthetic liner under all of the tanks and replacíng the original natural gas driven pumps with cteaner burning and quieter electric pumps - we submitted a building permit application to GarCo for a building to be built over the pumps. This application was rejected because it did not have an associated land-use permit for this facility. As noted above, we do not believe that a land-use permit is required for this facility (l believe Andy referred to our assertion as a legal, non-conforming use) and would like to proceed with getting the buildíng permit approved and construction started as quickly as possible.
