GENE.RALPROJECT DESCRIPTION_ _ + The property owner is requesting a variance from the setback requirements in the Residential Urban (RU) Zone District. The property is identified as Block: 13 Lot: 28 THRU:- Lot: 30 & LOT A of the Cooperton Townsite. The 2013 Land use and Development Code, as amended (LUDC) states that a lot front yard setback in the RU zone district is 25 feet. As the parcel is a corner lot, Section 3-202 (C) states that "On lots bordered on 2 contiguous sides by streets, the required front yard setback shall be observed along both streets." A 1680 square foot manufactured home was built on the property in 1967. From County records, it appears that the manufactured home may have been moved in 1982 (building permit 1637), however the permit indicates that the file was closed in 1984 with no Certificate of Occupancy issued (see permit attached). It is believed that because the additions are based around a manufactured home that a CO was not issued because compliance of this manufactured home with the building code in place at the time could not be verified. Inspections for footers, foundation, framing, and waterproofing were conducted. This permit also indicates that the manufactured home was to be moved to 12' from the property line along Satank Road (CR 106). Currently, it is understood that the home sits 1 Page within this 25' setback along Satank Road. As a result, it appears that the home is currently non -conforming as it sits within the front yard setback. This matter was brought to Staffs attention as a result of the construction of a fence within the front setback that is in excess of the 3' permissible within the front setback in the RU zone district (Section 7-1201(B)). While it is understood that the property owner checked with the Community Development Department ahead of construction, the owner obtained misinformation from the Department. The requested variance is anticipated to be for both the home in the setback along Satank Road and for a fence in excess of 3 feet within the front yard setback. The applicant should include both requests in the same application. Colorado revised statute 24-65.5-103 requires notification to mineral owners when a landowner applies for a land use designation by a local government. As such, the landowner must research the current owners of mineral interests for the property. The Garfield County Land Use and Development Code of 2013 ("LUDC") Section 4- 101(E)(1)(b)(4) requires written notice to owners of mineral interests in the subject property "as such owners can be identified through the records in the office of the Clerk and Recorder or Assessor, or through other means." It is the duty of the applicant to notify mineral interest owners. The following is a suggested process to research mineral interests: 1. Review the current ownership deed for the property (i.e. Warranty Deed, Special Warranty, Quit Claim Deed or Bargain and Sale Deed—NOT a Deed of Trust). The ownership deed is usually one or two pages. Is there a reservation of mineral interests on the ownership deed? Are there any exceptions to title? A deed may include a list of reservations that reference mineral owners or oil and gas leases. 2. Review your title insurance policy. Are there exceptions to title listed under Schedule B - II? If so, review for mineral interests that were reserved and oil and gas leases. 3. Check with the Assessor's office to determine if a mineral interest has been reserved from the subject property. The Assessor's office no longer documents the mineral reservation ownership for its tax roll records unless ownership has been proven. There are only a limited number of mineral owners who have provided such information to the Assessor's office so this may not provide any information, depending on your property. MEMO June 24, 2014 Page 2 4. Research the legal description of the subject property with the Clerk and Recorder's computer. You can search the Section, Township, and Runge of the subject property. You may find deeds for mineral interests for the subject property. 5. Research whether a Notice of Mineral Estate Ownership was filed for the subject property. On the Clerk and Recorder's computer, search under Filter (on the right hand side of the screen), General Recordings, Notice of Mineral Estate Ownership for the subject property. 6. If you find mineral interest owners as reservations on your deed, listed in your title insurance policy, from the Assessor's records or the Clerk and Recorder's computer, you need to determine whether these mineral interests were transferred by deed and recorded in the Clerk and Recorder's office. 7. Enter the name of the mineral interest owner as the Grantor in the Clerk and Recorder's computer to see if the mineral interest was transferred. If you find a transfer deed, you need to repeat this process to follow any transfer of the mineral interest to present day. 8. Include a description of your research process in your application and the name(s) and address(es) of the current mineral interest owner(s). Mineral interest research can be a difficult and time consuming process. If you are unable to determine mineral rights ownership by yourself, consider hiring an attorney or landman. Attorneys and landmen specialize in determining mineral rights ownership, but they charge a fee for their services. 4.114. CODE TEXT AMENDMENT. A. An application for a land use code text amendment shall meet the following criteria: 1. The proposed text amendment is in compliance with any applicable intergovernmental agreements; and 2. The proposed text amendment does not conflict with State law. 4-115. VARIANCE. A. Overview. 1. Applications for variance shall be reviewed and decided by the Board of Adjustments. 2. Variances are deviations from certain zoning dimensional requirements of this Code that would not be contrary to the public interest when, owing to special circumstances or conditions like exceptional topographic conditions, narrowness, shallowness, or the shape of a specific piece of property, the literal enforcement of the provisions of this Code would result in peculiar and exceptional, practical difficulties to or exceptional and undue hardship on the owner of the property. B. Review Process. Applications for a variance shall be processed according to Table 4-102, Common Review Procedures and Required Notice. C. Review Criteria. The following standards shall be satisfied for approval of a request for variance from specific regulatory provisions of this Code: 1. Special Circumstances or Conditions Exist. One or more of the following circumstances or conditions exist with respect to the specific property: a. Exceptional narrowness, shallowness, or shape of the property at the time of the enactment of the regulation in question; b. Exceptional topographic conditions of the property; and c. Other extraordinary and exceptional situations or conditions of the property. 2. Not a Result of the Actions of Applicant. The special circumstances and conditions have not resulted from any act of the Applicant. GARFIELD COUNTY LAND USE AND DEVELOPMENT CODE 4-19 3. Strict Application Consequence. Because of the special circumstances and conditions found pursuant to section 4-115.C.1., the strict application of the regulation would result in peculiar and exceptional, practical difficulties to, or exceptional and undue hardship on, the owner of the property. 4. Variance is Necessary for Relief. The granting of the variance from the strict application of the provisions set forth in this Code is necessary to relieve the owner of the peculiar and exceptional, practical difficulties or exceptional and undue hardship. 6. Not Detrimental to the Public Good. Granting the variance will not cause substantial detriment to the public good. 6. Variance Will Not Impair the County's Zoning. Granting the variance will not substantially impair the intent and purpose of this Code. 4-1)6. ADMINISTRATIVE INTERPRETATION. ,A. Overview. CO 970-963-5852 DATE 05/02/2016 SCALE.' r - 10' JOB NO: 16-12 April 5, 2018 House and Fence Variance Statement for Jacqueline Edgerly and James Gorman We, James Gorman and Jacqui Edgerly, are requesting a Variance from the set back requirements for our property, 31 Sopris Avenue. The 2013 Land use and Development code, states that a lot front yard setback in the RU zone district is 25 feet. The parcel we are inquiring about is a corner lot, and Section 3-202(C) states that "On lots bordered on 2 sides by streets, the required front yard setback shall be observed along both of the street sides. In 1967, a 1680 square foot manufactured home was built on the property. From the records, it seems as though the home was moved in 1982 (building permit 1637). This permit indicates that the file was closed in 1984 with no Certificate of Occupancy issued (see permit attached). It is believed that because the additions are based around a manufactured home that a CO was not issued because compliance of this manufactured home with building code in place at the time could not be verified. Inspections for footer, foundation, framing and waterproofing were conducted. This permit also indicates that the manufactured home was moved to 12' from the property line along Satank Road (CR 106). Currently our home sits within this 25' setback along Satank Road. As a result, it appears that our home is currently non -conforming and it sits within the front yard setback. It was also brought to our attention that the three existing sheds are also in the setback. This matter was brought to Staff's attention as a result of the construction of our fence within the front setback that is in excess of 3' permissible within the front setback in the RU zone district (Section 7-1201(B)). We as property owners checked with the Community Development Department ahead of construction, and obtained misinformation from the Department. The Department failed to mention that a corner lot is considered 2 front setbacks and gave us permission to build a 6' privacy fence on the west side property line and an 8' fence on the south property line. Chief Building Official Andy Schwaller also stopped by the construction site. He confirmed the information we had received from the Development Department, and again we were given the wrong information. In conclusion, we are requesting a variance for our three sheds on the south side, our home and the fence and gate in the setback along Satank Road. The west fence is 6' by 58' from the southwest corner and runs along the property line. Lastly, the south side fence is currently 6' 7" tall by 82' 9" long which is built in the side yard setback. This is the minimum height and length for privacy along Satank Road (CR 106). Review Variance Criteria 1. Special Circumstances or Conditions Exist a. Other extraordinary and exceptional situations or conditions of the property i. Our home was moved into the setback and approved in 1982 and the sheds were existing on the property when we purchased the home in 2017. Building a 6' tall fence in the 25' setback would result in the fence line going through the middle of our home. This would not create any privacy. 2. Not a result of the actions of applicant. The special circumstances and conditions have not resulted from any act of the applicant. a. We were misinformed by the Development Department and the Building Official about the requirements of being a corner property. And the home and sheds were located in the setback when we purchased the property in 2017. 3. Strict Application Consequence. Because of the special circumstances and conditions found pursuant to section 4-115.0.1., the strict application of the regulation would result in peculiar and exceptional, practical difficulties to, or exceptional and undue hardship on, the owner of the property. a. This would result in the removal of our home, sheds and fence. The financial burden alone would be extremely difficult. The physical hardship of tearing down a house, three sheds and a fence is unreasonable for us as this time. We would have no place to live and no financial support. 4. Variance is Necessary for Relief. The granting of the variance from the strict application of the provisions set forth in this Code is necessary to relieve the owner of the peculiar and exceptional, practical difficulties or exceptional and undue hardship. a. Granting this variance would relieve us from tearing down our home, the sheds and the fence. 5. Not Detrimental to the Public Good. Granting the variance will not cause substantial detriment to the public good. a. Our home and the sheds have been located in the same place since 1982 and they are completely out of the way and does not affect the Public. b. The new fence is on the property line which is approximately 12' from the road. The fence does not interfere with line of sight for the traffic in either direction. c. Multiple neighbors have commented on how they love our new fence and how it is about time that our property had some privacy! 6. Variance will not Impair the County's Zoning. Granting the variance will not substantially impair the intent and purpose of this code. a. This Variance would not have an effect on the purpose of the code. The Applicant has submitted to the County an application for the following Project: Gorman Vairence 2. The Applicant understands and agrees that Garfield County Resolution No. 2014-60, as amended, establishes a fee schedule for each type application, and the guidelines for the administration of the fee structure. 3. The Applicant and the County agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. The Applicant agrees to make payment of the Base Fee, established for the Project, and to thereafter permit additional costs to be billed to the Applicant. The Applicant agrees to make additional payments upon notification by the County, when they are necessary, as costs are incurred. 4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board of County Commissioners for the consideration of an application or additional County staff time or expense not covered by the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay additional billings to the County to reimburse the County for the processing of the Project.
