Rural COMPREHENSIVE PLAN Open Space / Public Land I. DESCRIPTION OF THE PROPOSAL An Administrative application was submitted for a Minor Subdivision with a request to subdivide an existing 5 acre parcel owned by Jarad Elder, into two parcels. The Applicant's request is to create one new approximately 2.001 acre parcel from the existing 5 acres which is located at the intersection of County Roads 331 and 326.The proposed parcel B, currently has a permitted ADU on the property as well as a permitted pole garage. Parcel A has a residence and a permitted accessory garage. The parcel was originally created as part of the Mattingley Exemption, with the 5 acre parcel being split from a 63.9 acre parcel. The applicant has proposed that the two lots share the existing well. Wastewater is to be served by existing, permitted, Onsite Wastewater Treatment Systems. II. DESCRIPTION OF THE SITE The 5 acre parcel is at the intersection of County Road 331 and 326. The ADU on the north east portion of the property accesses onto County Road 326 and the other residence has a separate access onto CR 331. The site is split by a depression where the augmentation pond and an intermittent drainage channel are located. The site is well -vegetated and has multiple deciduous trees located on the property. The existing structures are built on the higher portions of the property. WAIVER REQUESTS FROM STANDARDS The Applicant has not requested any waivers from the applicable Standards. IV. AUTHORITY — APPLICABLE REGULATIONS 3 A. Section 5-301 of the Land Use and Development Code (LUDC), designates the division of land that creates no more than 3 parcels, is served by a private well or water supply entity and does not require the extension, construction, or improvement of a County right-of-way, as requiring Administrative Review. B. Section 4-103 of the LUDC sets forth the Administrative Review Procedures by which the current Application is being considered. C. Article 7 of the LUDC sets forth General approval standards in Division 1, General Resource Protection Standards in Division 2 and Site Planning and Development Standards in Division 3. Minor Subdivisions are also subject to standards in Article 7 Division 4, Subdivision Standards and Design Specifications, Section 5- 301(C) and 5-402(F). The standards are addressed in the Application submittals and in the Staff Analysis section of the Staff Report. V. PUBLIC AND REFERRAL COMMENTS The Applicant has provided documentation that all required notice mailings have been completed in accordance with the LUDC. One public comment was received as a result of the public notice. It is attached as an exhibit and summarized below. Referral Comments received on the Application are attached as Exhibits and summarized below: A. Garfield County Consulting Engineer, Mountain Cross Engineering (See Exhibit 3): The following comments were submitted. • "The Applicant states that drainage requirements are not applicable since the structures are constructed and existing. However, the Applicant should verify that there is positive drainage away from the structures, that there are no areas of shallow ponding, and that existing drainage patterns are not causing erosion or sedimentation problems." • "The Applicant provides pump tests results from the well from over 15 years ago. Adjacent land uses, additional wells, drought, or other impacts can affect the production of a well over time. The Applicant should provide results of a recent pump test." • "The Applicant provided water quality testing results that appear to show that E. Coli was detected. The Applicant should verify the results and provide proposed method of treatment or test results showing the absence of E. Coli." B. Garfield County Road and Bridge (See Exhibit 4): The following comments were submitted. • "Patrick we have review the application for the Elder Subdivision both of the driveways have aprons and are up to code." C. Colorado Parks and Wildlife (See Exhibit 5): The following comments were submitted. 4 • "After reviewing this proposal I find no significant wildlife concerns regarding this subdivision." D. Colorado Geological Survey (CGS) (See Exhibit 6): The following comments were submitted. • "No new construction or improvements are currently proposed. We visited the site on August 1, 2017. We did not observe any surface conditions that would preclude the existing and proposed residential use and density. CGS therefore has no objection to approval of the two -lot subdivision as proposed." • "Rockfall. The existing ADU on proposed Parcel B is located below a small slope containing detached blocks of Wasatch Formation (claystone, siltstone, sandstone, and minor conglomerate). The blocks appear to be stable under current conditions. Future improvements should be located and constructed such that any grading, driveway, foundation, or other cuts do not undercut the slope or otherwise remove any existing material supporting these blocks." • "Erosion setback from unnamed drainage channel. An unnamed, intermittent drainage channel crosses the site from east to west. No flood hazard has been mapped for this drainage. CGS recommends an erosion setback for any future improvements on both proposed lots, to reduce hazards associated not just with rising floodwaters but also erosion and scour. The setback should be determined based on site-specific analysis of topography and soil erosion properties." E. Colorado River Fire Rescue (See Exhibit 7):The following comments were submitted. • "I have no requirements or concerns with this lot split on the existing property including building and residences. This lot split will not add any additional impacts to CRFR or our response to that area." F. Colorado Division of Water Resources (DWR) (See Exhibit 8): The following comments were submitted. • "Based on the above, it is our opinion, pursuant to CRS 30-28-136(1)(h)(I) that the proposed water supply will not cause material injury to decreed water rights, so long as the applicant maintains a valid well permit and the augmentation plan is operational. Provided the well continues to have a sustained yield similar to the rate reported in 1981, the water supply should be physically adequate for domestic purposes. Please note the long term adequacy of any ground water source may be subject to fluctuation due to hydrological and climactic trends." G. Public Comment from Lois Martinez (See Exhibit 13): The following comments were submitted. • "My name is Lois Martinez and I received, registered mail a notice that Jarad Elder has applied to change the zoning for a subdivision. I am assuming this is the area. Where me and my family owns minerals rights. For gas wells. I have no problem with the rezoning as long as he understands, he can not interfere 5 with anything that affect the income of my family from the gas wells. Lois Martinez" H. Garfield County Public Health (See Exhibit 9): The following comments were submitted. • "Drinking water: the shared private well that services the two properties has not been tested for water quality since 2003. Water quality tests are recommended every year for private drinking water wells, with more comprehensive tests every five years. Public Health suggests that the applicant should do a test on the well that is at least as robust as the Colorado Department of Public Health and Environment Laboratory Services Division's Deluxe Colorado Package. A water treatment system should be use as necessary to assure safe drinking water for residents." • "Onsite Wastewater Treatment System: If the owner has not had the septic systems serviced and maintained since 2001, we recommend an inspection and tank pumping if necessary. The status and location of both systems should be known to be in good working order to protect groundwater supplies, including the residents' own drinking water well." I. Garfield County Vegetation Management (See Exhibit 10): The following comments were submitted. • "The county listed weeds, whitetop, Russian knapweed, and Russian olive are located on the property. It is too late this season to treat whitetop; however Russian knapweed and Russian olive may be treated this fall. Staff requests that the applicant treat the Russian knapweed this fall. Russian olive may be treated by using the cut stump method. Russian olive may be treated effectively in September and October." • "The County partners with the Conservation Districts on a noxious weed cost - share program that provides for partial financial assistance for noxious weed treatments. The applicant may contact the Vegetation Management Department for information on this program. Please provide this office with treatment records by October 31, 2017 (if any noxious weeds are located). A multi-year treatment program may be necessary." J. Garfield County Surveyor (See Exhibit 11): The following comments were submitted. • "Please refer to section 5-402 (F) Final Plat of the Garfield County Land Use Code. Once the plat is complete and correct please re -submit for review." • "Once these comments have been addressed and all final comments from the Community Development have been completed the Mylar may be prepared for recording. The Mylar shall be delivered to the Community Development office with all private party signatures no later than Monday the week prior to the next commissioner meeting day in order to make that meeting." K. Assistant Garfield County Attorney: (See Exhibit 12): 6 • "The title commitment was updated. There is a lender so the plat will need a lienholder certificate and signature. The plat should include a plat note that all easements and encumbrances in this updated commitment are referenced on the plat. The new title commitment number should be referenced." • "ILC—it looks ok. I had an issue with the northern access, but you pulled the subdivision exemption legal description for the property and it provided a legal to the southern portion of the road so access should not be a problem." VI. STAFF ANALYSIS Article 7, Division 1: General Standards 1. Section 7-101: Compliance with Zone District Use Regulations The development on the property is in general conformance with the dimensional standards for the Rural zone district. The minimum lot size in the Rural zone district is 2 acres and the smallest lot proposed is 2.001 acres. The Applicant's site plan shows the metal shop on Proposed Parcel B is located within approximately 20 feet of the proposed new lot line. Staff has determined that this lot line functions as a side setback and thus all structures meet required setbacks. 2. Section 7-102: Conformance with Comprehensive Plan and compliance with IGAs The parcel is labelled as Open Space / Public Land According to the Garfield County Comprehensive Plan of 2030. It is staffs opinion that this designation was is a Scribner's error. A Public Lands / Open Space designation is described in the Comprehensive Plan as, "Federal and state lands and land for which conservation easements preclude or limit further development." This parcel clearly does not meet this standard as it is a privately held piece of property without a conservation easement. The adjacent subdivision also is mislabeled. Surrounding parcels outside of the adjacent subdivision are designated as Residential Medium High with a suggested density of 2 to 6 acres per dwelling unit. The proposed subdivision creates lots of approximately two acres and three acres, which would meet the density recommendations for a Residential Medium High comprehensive plan designation. Additionally, no new dwelling units are being proposed as part of the Minor Subdivision. The ADU that will be located on one parcel was previously permitted with the County. The proposed subdivision is in general conformance with Garfield County's Comprehensive Plan Section 2 – Housing: Goal 1, which states, "To bring about a range of housing types, costs, and tenancy options, that ensure for our current and future residents affordable housing opportunities in safe, efficient, residential structures."This proposed lot split creates two smaller Tots, both of which will supply different sized lots than surrounding for County residents. This directly addresses the Comprehensive 7 Plan's goal to provide a variety of housing options. With this analysis, staff is of the opinion that the proposed subdivision is in general conformance of the Garfield County Comprehensive Plan. Section 7-103: Compatibility 2T.' .;- i Parcels that are white or gray are considered Open Space / Public Land The proposed use is located in a rural residential area. Surrounding land uses are residential and/or agricultural in nature. The proposed subdivision would create a new lot, but would not create another dwelling unit, as the Applicant has proposed that the existing ADU would become the primary residential use on the new lot. It is Staff's opinion that the proposed Minor Subdivision is compatible with adjacent land uses. 8 4. Section 7-104: Sufficient, Adequate, Legal and Physical Source of Water The Applicant has proposed that both parcels will be served with well water from an existing onsite well (Division of Water Resources Permit No. 55921-F). The permit allows for water to be served to two single-family dwelling units and the well has served both the main residence and the ADU since 2001. The Applicant has indicated that there is a required augmentation pond on the property to meet Division of Water Resources augmentation requirements for use of the well by two dwelling units. The Applicant has supplied a proposed water well sharing agreement. The County Attorney has reviewed the agreement and recommended that as a Condition of Approval, the water sharing agreement be reviewed and approved by the County Attorney's office prior to final plat approval. This recommendation has been included as a Condition of Approval. The applicant has provided documentation that a 4 -hour pump test was completed in 2001, however the Garfield County Referral engineer included comments indicating that the pump test may no longer reflect the capacity of the well (Exhibit 3). He recommended that the Applicant should provide recent pump test results. The Division of Water Resources also echoed this comment by stating in their referral letter (Exhibit 8), "Provided the well continues to have a sustained yield similar to the rate reported in 1981, the water supply should be physically adequate for domestic purposes. Please note the long term adequacy of any ground water source may be subject to fluctuation due to hydrological and climactic trends." To address these two comments, a proposed condition of approval has been included that requires a 4 -hour pump test on the well. The Applicant has provided water quality tests from 2003 and also from June 2017. Neither of the tests address all of the water quality contaminants identified in Section 4- 203(M)(1)(B)(5)(C). Since neither of these tests is comprehensive, staff has included a suggested condition of approval that the Applicant test the well water to address all the contaminants identified in the Land Use and Development Code. This issue was also addressed by the Garfield County Department of Public Health's Comment (Exhibit 9), that stated: Drinking water: the shared private well that services the two properties has not been tested for water quality since 2003. Water quality tests are recommended every year for private drinking water wells, with more comprehensive tests every five years. Public Health suggests that the applicant should do a test on the well that is at least as robust as the Colorado Department of Public Health and Environment Laboratory Services Division's Deluxe Colorado Package. A water treatment system should be use as necessary to assure safe drinking water for residents. Additionally, in the most recent water quality test supplied by the Applicant, the County designated engineer noted that E. Coli was detected in the water system (Exhibit 3). The Applicant should determine a treatment method to address the E. Coli in the well 9 water. As part of further water quality testing, the Applicant shall be required to submit a test that demonstrates there E. Coli and Coliform meets County standards according to Section 4-203(M)(1)(B)(5)(C) of the Land Use and Development Code. 5. Section 7-105: Adequate Central Water Distribution and Wastewater Systems The Applicant has supplied permits for both Onsite Wastewater Treatment Systems on the property, from 2001 for the ADU and from 1981 for the main residence. According to Assessor's Records, neither structure on the property has exceeded the amount of bedrooms that the septic system was permitted for through Garfield County. Referral comments from the Garfield County Department of Public Health stated (Exhibit 9): Onsite Wastewater Treatment System: If the owner has not had the septic systems serviced and maintained since 2001, we recommend an inspection and tank pumping if necessary. The status and location of both systems should be known to be in good working order to protect groundwater supplies, including the residents' own drinking water well. The County designated engineer's referral comments did not note a concern with either OWTS. Because both systems were originally permitted by the County, Staff has suggested a condition of approval that all OWTS' on the property be properly maintained. 6. Section 7-106: Adequate Public Utilities The applicant states that adequate public utilities are already in operation at the site and that Holy Cross Electric serves both the ADU and the existing dwelling. The applicant supplied an email from Holy Cross confirming that there is electricity at both the ADU and the existing dwelling. 7. Section 7-107: Access and Driveways a. The application was referred to the Garfield County Road and Bridge Department (see attached Exhibit 8). Dan Goin stated that both driveways have aprons and are up to code. b. The Applicant has supplied information demonstrating that both driveways for the proposed Tots meet the standards detailed in Table 7-107: Roadway Standards. 8. Section 7-108: Natural Hazards To address Section 7-108, the application states, "No proposed changes are being made to the land. The land will remain the same and therefore there shall be no new Natural or Geologic Hazards to be identified (including but not limited to falling rock, landslides, snow slides, mud flows, radiation, flooding, or high water tables.) 10 This application was referred to Colorado Geological Survey, to address potential natural hazards on the property. They had no objections to approval of the subdivision, however they did have several comments (Exhibit 6): Rockfall. The existing ADU on proposed Parcel B is located below a small slope containing detached blocks of Wasatch Formation (claystone, siltstone, sandstone, and minor conglomerate). The setback should be determined based on site-specific analysis of topography and soil erosion properties. Staff has addressed these comments via plat notes that will be included on the plat. 9. Section 7-109: Fire Protection The application was referred to Colorado River Fire Rescue, who supplied comments stating, "I have no requirements or concerns with this lot split on the existing property including buildings and residences. This lot split will not add any additional impacts to CRFR or our response to that area." With this referral comment, it is staff's opinion the proposed subdivision satisfies Section 7-109 of the Land Use and Development Code. Article 7, Division 2: General Resource Protection Standards 10. Section 7-201 Agricultural Lands It is staff's opinion that the proposed Minor Subdivision will not impact existing agricultural uses. The density will remain the same, as the existing permitted ADU will become the primary residence on one parcel. No further development is proposed as part of the minor subdivision. With regards to Irrigation Ditches, the Application stated, "No irrigation ditches cross or adjoin the land to be subdivided." Staff did not note any irrigation ditches on site during the site visit. 11. Section 7-202 Wildlife Habitat Areas 11 The application was referred to Colorado Parks and Wildlife who stated, "After reviewing this proposal I find no significant wildlife concerns regarding this subdivision," (Exhibit 5). Staff agrees with Colorado Parks and Wildlife's assessment, especially since both dwelling units on both proposed lots are already constructed. 12. Section 7-203 Protection of Waterbodies The Applicant has provided evidence that there is an Augmentation Pond on the property that was created through the use of a dam. This pond releases water according to a Water Right and Augmentation Plan prepared by Resource Engineering in 1999, included in the application. This augmentation is required as part of the DWR permit 55921-F. Staff has determined that this pond qualifies as a water impoundment, which is defined in the Land Use and Development Code as: Confined water such as surface pits or ponds, wastewater treatment settling ponds, surface mining ponds, detention and retention ponds, artificial lakes and ponds (not related to agriculture), and produced water and condensate tanks. Water impoundment excludes tanks with a total tank volume of 5,000 barrels or fewer used exclusively for activities associated with Oil and Gas Drilling and Production, and Injection wells. Since staff has determined that the augmentation pond is a water impoundment, it does not qualify for a minimum setback from waterbodies. Therefore, although the Applicant has represented that one of the garages is located within 20 feet of the pond, it is not in violation of the Minimum Setback requirements. Additionally, all structures on the site were previously approved by the County. The Application suggests that the only waterbody on the site is the augmentation pond, however, the augmentation pond is filled by natural runoff. County GIS layers do not show a stream on this parcel and it is not mapped according to floodplain records. CGS addressed this issue in their comments by calling the drainage an, "intermittent drainage channel." Their comments about it stated (Exhibit 6): Erosion setback from unnamed drainage channel. An unnamed, intermittent drainage channel crosses the site from east to west. No flood hazard has been mapped for this drainage. CGS recommends an erosion setback for any future improvements on both proposed lots, to reduce hazards associated not just with rising floodwaters but also erosion and scour. The setback should be determined based on site-specific analysis of topography and soil erosion properties. Staff agrees with this assessment and has proposed a condition of approval that will address a waterbody setback from the unnamed drainage channel for any new construction. All current structures on the property were permitted by the County. 12 13. Section 7-204 Drainage and Erosion The Applicant provided topographic maps of the parcel to demonstrate that the site generally has positive drainage. The Applicant also stated that, "The subdivision of the Elder property does not include any development. Therefore there will be no change to the existing (A) erosion and sedimentation, (B) Drainage, (C) Stormwater Run-off because the existing dwelling, ADU and roadways are already in existence." The County designated engineer supplied a referral comment that stated (Exhibit 3): The Applicant states that drainage requirements are not applicable since the structures are constructed and existing. However, the Applicant should verify that there is positive drainage away from the structures, that there are no areas of shallow ponding, and that existing drainage patterns are not causing erosion or sedimentation problems. The single family residence, both associated sheds/garages, and the ADU were all permitted by the County. It is staff's opinion that since the structures are existing onsite and permitted, drainage was acceptable at the time of permit. Since no further development is proposed, it is Staff's opinion that the applicant has demonstrated compliance with this section. Any future development shall be required to meet positive drainage requirements. 14. Sections 7-205 Environmental Quality It is staff's opinion that no water or air quality issues are anticipated from the proposed project. 15. Section 7-206 Wildfire Hazards The subject property is identified as Not Rated, High, and a small portion of Moderate according to the Wildland Fire Susceptibility Index of the Community Wildfire Protection Plan. The applicant has represented that there are no slopes greater than 30 percent on the property. It is staff's opinion that the wildfire danger on this property is within manageable levels and is consistent with Code requirements. 16. Section 7-207 Natural and Geologic Hazards See Section 8 above. 17. Section 7-208 Reclamation No disturbance that would require reclamation is anticipated as a result of the creation of the proposed subdivision. Both dwelling units are already constructed as are associated driveways. As a result, a reclamation plan is not applicable. 13 Article 7, Division 3, Site Planning and Development Standards 18. Section 7-301 Compatible Design: The proposed Minor Subdivision is generally compatible with surrounding land uses. 19. Section 7-302 Off- Street Parking and Loading Standards: The Applicant has demonstrated through site plans that adequate off-street parking exists. 20. Sections 7-303 Landscaping Standards: The LUDC specifically exempts single family dwelling units from Section 7-303. 21. Section 7-304 Lighting: All exterior lighting will need to be downcast and comply with County standards. 22. Section 7-305 Snow Storage Standards: Adequate snow storage exists on the property. 23. Section 7-306 Trail and Walkway Standards: No recreational or community facility access areas are proposed. Article 7, Divison 4, General Subdivision Standards 24. Section 7-401 General Subdivision Standards The Applicant has supplied a water sharing agreement that will be used for the shared well on the property. The County Attorney's Office has suggested a Condition of Approval that the agreement be reviewed and approved by their office prior to final approval. Staff has included that recommendation as a suggested Condition of Approval. The Applicant did not show a maintenance easement for the well head and associated utilities on the plat. Staff has included a recommendation that an easement for this use be included on the Final Plat. 25. Section 7-402 Subdivision Lots No issues with lot configuration pursuant to this section have been noted. Final review and approval of the plat by the County Attorney's Office and the County Surveyor shall be required. 14 26. Section 7-403 Survey Monuments Compliance with these requirements will be confirmed through referral of the plat to the County Surveyor's Office. Compliance with any referral comments, corrections, and/or edits required by the County Surveyor should be included as conditions of approval. 27. Section 7-404 School Land Dedication School Land Dedication fees shall be required in accordance with the Land Use and Development Code. 28. Section 7-405 Traffic Impact Fees Traffic Impact Fees shall be required in accordance with the Land Use and Development Code. Any applicable fees shall be collected at the time of building permit. Article 5, Division 3, Minor Subdivision Review 24. Section 5-301(C)(1): It complies with the requirements of the applicable zone district and this Code. As proposed, the subdivision complies with the Rural zone district. 25. Section 5-301(C)(2): It is in general conformance with the Comprehensive Plan. See Section 2, above. 26. Section 5-301(C)(3): Shows satisfactory evidence of a legal, physical, adequate, and dependable water supply for each lot. See Section 4, above. 27. Section 5-301(C)(4): Satisfactory evidence of adequate and legal access has been provided. See Section 7, above. 28. Section 5-301(C)(5): Any necessary easements including, but not limited to, drainage, irrigation, utility, road, and water service have been obtained. Staff has included as a condition of approval that easements for the maintenance of the well and associated utilities be included on the Final Plat. 29. Section 5-301(C)(6): The proposed Subdivision has the ability to provide an adequate sewage disposal system. 15 See Section 5, above. 30. Section 5-301(C)(7): Hazards identified on the property such as, but not limited to, fire, flood, steep slopes, rockfall and poor soils, shall be mitigated, to the extent practicable. See Sections 8 and 15, above. 31. Section 5-301(C)(8): Information on the estimated probable construction costs and proposed method of financing for roads, water distribution systems, collection systems, storm drainage facilities and other such utilities have been provided. All utilities and infrastructure are in place on the property. 32. Section 5-301(C)(9): All taxes applicable to the land have been paid, as certified by the County Treasurer's Office. The Applicant will need to obtain the signature of the County Treasurer on the final plat indicating that taxes have been paid. This must be accomplished prior to the BOCC signing the plat. 33. Section 5-301(C)(10): All fees, including road impact and school land dedication fees, shall be paid. All road impact fees shall be collected at the time of building permit. Since the property is not located in the RE -1 School District, the Applicant shall pay $200 per dwelling unit to the appropriate school district. 34. Section 5-301(C)(11): The Final Plat meets the requirements per section 5- 402.F., Final Plat. As a condition's of approval, staff has suggested numerous changes that need to be made to the plat for it to meet section 5-402 F. of the Land Use and Development Code. VII. SUGGESTED FINDINGS AND RECOMMENDATION Staff recommends a finding that, with the recommended conditions, the proposed Minor Subdivision is in conformance with the Comprehensive Plan of 2030 as well as the Land Use and Development Code. Staff, therefore, recommends approval with conditions of the Elder Minor Subdivision application. Suggested Findings 1. That proper public notice was provided as required for the Administrative Review Land Use Change Permit. 16 2. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 3. That with the adoption of conditions the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. Suggested Conditions of Approval Conditions Prior to Signature of the Plat 1. The Applicant has 90 days within which to satisfy applicable conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes, Surveyor, and any mortgagees. b. Recording Fees. c. The following amendments shall be made to the plat prior to obtaining signatures. This updated plat shall be provided to, reviewed, and accepted by the Community Development Department, the County Attorney's Office and the County Surveyor prior to creating a Mylar copy of the plat and obtaining any signatures. i. The name and address of the mineral owners shall be shown on the plat. ii. The final plat shall include the Name, address, and seal of the certifying registered land surveyor preparing the Final Plat. iii. The name and addresses of the property owner shall be included on the plat. iv. The plat shall be in black and white ink, no color. v. The title of the plat shall be changed to reflect that it is for the Elder Minor Subdivision and it shall provide the correct legal description. vi. The lengths of all arcs, radii, and tangents shall be identified and sufficient data shall be shown for all curved lines on the Plat to enable reestablishment of curves in the field. vii. Lot A shall be identified on the plat with its corresponding area shown to two decimal places. viii. The area of Lot B shall be shown to two decimal places ix. The width of all adjacent right-of-ways shall be added to the plat. 17 x. Notes on the second page shall be changed to represent the proposed Elder Subdivision. xi. The Applicant shall remove any note or description of a parcel of land in the Cordillera Subdivision. xii. The name and map number of any bordering subdivision within 200 feet of the boundaries of the plat shall be included on the final plat. xiii. The width, purpose, and owners of all easements shall be shown on the plat. xiv. The footprint of any structures on the property shall be removed from the plat. xv. The locations of the driveways shall be removed from the plat. xvi. The septic and water property improvement information shall be removed from the plat. xvii. Any protective covenants/restrictions shall be noted on the Plat. xviii. The plat shall show a utility and maintenance easement that gives access to the well head and any associated infrastructure from both properties. xix. The Applicant shall include the following plat notes as describe in the Garfield County Resource Guide, as Amended. a. Noxious Weeds b. Open Hearth Solid-Fuel Fireplaces c. Exterior Lighting d. Right to Farm e. Maintenance of Fences, Rural Living, Etc. f. Mineral Rights g. Domestic Dogs xx. The Certificate of Dedication and Ownership shall be updated to match the approved language in the County Resource Guide. xxi. The County Commissioners Certificate shall be updated to match the approved language in the County Resource Guide. xxii. The Certificate of Dedication and Ownership shall be updated to match the approved language in the County Resource Guide. xxiii. The Surveyor's Certificate shall be updated to match the approved language in the County Resource Guide. xxiv. The Lienholder Consent and Subordination Certificate from the County Resource Guide shall be included on the plat. xxv. The following plat note shall be added to the plat: "No further subdivision of the parcels within Elder Minor Subdivision are permitted by Minor Subdivision, as defined in the Land Use and Development Code of 2013, as amended." xxvi. A plat note shall be added to the plat that all easements and encumbrances in the updated title commitment are referenced on the plat. The new title commitment number should be referenced. 18 xxvii. A plat note shall be added to the plat that states, "Future improvements on Parcel B should be located and constructed such that any grading, driveway, foundation, or other cuts do not further impact the slope or remove any existing material supporting the detached Wasatch Formation blocks." xxviii. A plat note shall be added that states, "Any new structure that requires a building permit on either lot shall meet an erosion setback from the intermittent drainage channel, determined through a site-specific analysis of topography and soil erosion properties completed by a Professional Engineer." 2. Prior to BOCC signature on the Plat the Applicant shall provide the Declaration of Water Well Use and Maintenance Obligations to the Garfield County Attorney's Office for review and approval. 3. I understand the applicant proposes to subdivide a five -acre parcel located at 4280 County Road 331, Silt, creating two parcels. Proposed Parcel B, approximately two acres, contains an existing accessory dwelling unit which will become the primary residence on this parcel. No new construction or improvements are currently proposed. We visited the site on August 1, 2017. We did not observe any surface conditions that would preclude the existing and proposed residential use and density. CGS therefore has no objection to approval of the two -lot subdivision as proposed. However, we have several comments: Rockfall. The existing ADU on proposed Parcel B is located below a small slope containing detached blocks of Wasatch Formation (claystone, siltstone, sandstone, and minor conglomerate). The blocks appear to be stable under current conditions. Future improvements should be located and constructed such that any grading, driveway, foundation, or other cuts do not undercut the slope or otherwise remove any existing material supporting these blocks. Erosion setback from unnamed drainage channel. An unnamed, intermittent drainage channel crosses the site from east to west. No flood hazard zone has been mapped for this drainage. CGS recommends an erosion setback for any future improvements on both proposed lots, to reduce hazards associated not just with rising floodwaters but also erosion and scour. Director/State Engineer We have reviewed the above referenced proposal to subdivide a parcel of approximately five acres into two lots of approximately three acres and two acres. There are currently two residences on the five acres, a primary residence and an Accessory Dwelling Unit (ADU). Under this proposal, the primary residence will be located on the three acre lot and the ADU will be located on the two acre lot. Water for both residences is currently and will continue to be provided by a shared well and each lot will be served by individual onsite -wastewater treatment systems (OWTS). According to our records, an existing well, Permit No. 55921-F, is located on the five acre parcel. This permit was issued on June 19, 2001 pursuant to CRS 37-90-137(2) for the expansion of use of an existing well. Under this permit, the use of ground water from this well is limited to ordinary household purposes inside two (2) single family dwellings, the irrigation of not more than 2,000 square feet of home gardens and lawns, and the watering of two (2) head of livestock. The average annual amount of ground water to be appropriated shall not exceed 0.934 acre-feet. According to the unsigned Declaration of Water Well Use and Maintenance Obligations agreement included in the referral materials, irrigation uses shall be limited to not more than 750 square feet of lawn and garden irrigation on Lot 2 and 1250 square feet of lawn and garden irrigation on Lot 1. The agreement does not address the use of watering two head of livestock allowed under the well permit. Section 37-92-602(3)(b)(III), C.R.S., requires that the cumulative effect of all wells in a subdivision be considered when evaluating material injury to decreed water rights. The source of the proposed water supply would be from, or tributary to, the Colorado River. This area of the Colorado River is over -appropriated; therefore, an augmentation plan is required to offset depletions caused by the pumping of any wells. The existing well permit, Permit No. 55921-F, was issued on the condition in part, that the well is operated in accordance with the Debra Kay Engelhardt Augmentation Plan approved by the Division 5 Water Court in case no. 2000CW10. Pursuant to Permit 55921-F, the maximum pumping rate of the well shall not exceed 15 gpm. The well was constructed on September 23, 1981 and the permit is valid. According to the Well Completion and Pump Installation Report received on December 10, 1981, after the well was completed an eight hour air lift test was conducted and the well yielded 15 gallons per minute. Based on the above, it is our opinion, pursuant to CRS 30-28-136(1)(h)(I), that the proposed water supply will not cause material injury to decreed water rights, so long as the applicant maintains a valid well permit and the augmentation plan is operational. Provided the well continues to have a sustained yield similar to the rate reported in 1981, the water supply should be physically adequate for domestic purposes. Please note that the long term adequacy of any ground water source may be subject to fluctuation due to hydrological and climatic trends. Russian olive may be treated by using the cut stump method. Russian olive may be treated effectively in September and October. The County partners with the Conservation Districts on a noxious weed cost -share program that provides for partial financial assistance for noxious weed treatments. I have the following outstanding issues: Title commitment—applicant needs to provide an updated title commitment showing current encumbrances on the property. The title insurance policy is from 2005. We need it updated. This will provide us with all current easements or encumbrances and all lenders who have deeds of trusts on the property. Also, the plat should reference the updated commitment to state that all easements of record are shown. Mineral rights—the title work from 2005 shows several reservations of mineral interests. Applicant claimed that he owned all the interests. It looks like the prior owner, Debra Engelhart only owned a 1/8 interest (from the lease under exception 20 of Schedule B). Further research into the mineral interests is needed to make sure all owners are notified. Exception 21 states that potential adverse matters are disclosed on the ILC. I would like a copy of that ILC. The applicant will need to contact Bookcliff Surveying with this ILC reference number. The title work shows 2 lenders so just a note to you that the plat should have lienholder's consent. Water—the pump test is old (1981). Applicant should provide a recent pump test. He will probably not want to do this and argue that the houses have adequate water. That will be up to Sheryl to decide if it is adequate. Also, the water sharing agreement needs work to better describe the newly created lots. The agreement should state lot 1 of the subdivision and lot 2 of the subdivision with a reception number of the plat rather than street addresses. I recommend a condition of approval that the water sharing agreement be reviewed and approved by the County Attorney's office prior to final approval. Also, there is a pond that intersects the two lots. If this were a structure, it would need to be moved on to one lot or the other. I am questioning the pond. Are there mutual rights to use it? Let's discuss.
