Set Bac]< Requirements.There shall be no general rule for the location of improvements with relationto property lines, but the location of such improvements shall receive the advanceapproval of the Àssociation in paragraph B above required and all such sites shallconform to the Jefferson County zoning regulations then in effect.E. Fences.No fence, waII, or similar t1çe barrier of any kind shall be constructed,erected, or maintained on any 1ot for any purpose whatsoever except such fences,wa1ls, or ba=riers as may be approved by the Association.F. Signs.No signs of any kind shall be displayed to the public view on any part ofthe property, except one sign of nct more than two (2) square feet designatingthe owner of any building site, one sign of not more than five (5) square feetadvertising the property for sale or rent, except temporary signs used by Declaran-uor its agent, to ad.vertise property or services in Riverbend.G. EasementsEasements and rights-of-way as described on the recorded plat of Riverbendhave been reserved for poles, wires, pipes, and conduits for electricityr gêsrtelephones, sev¡er, drainage \.rater, sí¡o\{ removal and other utility and road pur-poses together with the right of ingress and egress for further construction,maintenance and repair thereof es shown on the recorded pJ-at of the subdivision.Equestrian and pedestrian trails also are designated on the plat of the subdivision.Road rights-of-way and easements shown on the plat contain utility easements,and easements for other purposes. No dwelling, improvement, material, equipment,or refuse shalÌ be placed on any part of said property within the area of easementsreserved so as to interfere with the use thereof as reserved.-3- H. Garbage and Refuse DisPosal.No part of the property above or below ground shall be used or maintainedas a dumping ground for refuse, trash, garbage. debris, or other waste; at alltimes the property shall be maintained in a saritary condition. Reasonableprecaution shall be taken against fire hazards and no outdoor burning of anykind shal1 be permitted upon the prernises (except for cooking). Each propertyowner shall províde suital:le receptacles for the temporary storage and collectionof refuse and all such receptacles shalt be screened from public view and protectedfrom clisturbance. These restrictions also apply to contractors doing construction.No motor vehícle of any type shall be permitted to remain on the property in anon-operating condition for more than thirty (30) days in any calendar year. Anysuch vehicle rvhici does not display current and valid license plates and safetyinspection sticker as required by state law shall be deemed to be in a "non-operating condition".I. Trees,Living trees, the trunk of which is four (4) inches or more in diameter'naturally existing upon a lot, except to the extent necessary for constructj-onpurposes, shall not be cut, trimmed, or removed from the properties except as maybe approved by the Association.J. Livestock and Poultry.No animals, livestock, or poultry of any kind shal1 be raised, bred, orkept on any portion of the property for any conmercial purpose. Household petskept for recreational purposes nust be kept within the dwelling or a kennel orcage unless accompanied by and under the control of the owner. The RiverbendProperty O¡rners Association shall have the power to impound any household petallowed to run free and uncontrolled v¡ithin the subdivision. A first offensieshall be punishable by a fine of $25. A second offense shall be punishable bya fine of $10O. In the case of a third offense by the same resident' theRiverbend Property Owners Associatio¡ shaLl require the removal from the sub-division of aII domestic pets owned by the resident.K. Landscaping.Irrigated lawn sizes for all.classificatíons of lots shall be limited to2500 square feet. The bala¡ce of the lot should be seeded in native grasses notrequiring irrigation such as Crested l^lheat. Indigenous trees, bushes, and shrubscan be plantec and watered.. Gardens not exceeding .500 square feet may also bewatered.L. Continuity of Construction.Àtl structures conmenced in this subdivision shall be prosecuted diligentlyto completion and shall be completed within twelve (12) nonths of issuance ofbuitding permit unless approved in writing by the Àssociation.M. Nuisance and Fire Arms.No noxious or offensive activity shall be carried on within the subdivisionnor shal1 anything be done or ^oermitted l¿hich will constitute a public nuisancethèrein; nor shall any fire arms be discharged within the subdivision. Firearms as used herein shall be construed to mean not only rifles and pistols andcannons, but fireworks, explosives, air rifles, BB guns, or similar devices.-N. Parking-parking shall- be aÇcommodated on site with no parking allowed on publicstreets. Each site sha11 provide at least a one-car garage, or equivaLent coveredparking area, and the minimum of two additional parking units should be acconuno-dated in the driveway designO. Certificate of Assessments.Upon payment of a reasonable fee riot to exceed 'Iwenty-Five clollars and u,oonthe written request. of any owner, mortgagee, prospective grantee or prospectivemortgagee, of a 1ot, the Association -- by its financial officer -- shall issuea written Certificate setting fo:th the amount of unpaid comr¡.on expenses, if an1'.with respect to the subject lot; the amount cf the current assessment and thedate upon v¿hich such assessment becor¡res due; and creclj-t for advanced payments orfor prepaid items (includinq, but not limited to, insurance premiums). Suchcertificate shall be conclusive upon the Asscciation in favor of all persons vrhorely ¡¡.teon in good faith.
