EXECUTOR'S DEED
THIS EXECUTOR'S DEED, made this 13th day of February , 1963,
between GLADWYN B. GAUMER, as administrator of the estate of Della B.
Gaumer, deceased, party of the first part, and SAN, J. CAMPBELL and
VIRGINIA W. CAMPBELL, not as tenants in common but in joint tenancy with
right of survivorship, of Santa Barbara, California, parties of the
second part, WITNESSETH THAT,
WHEREAS the party of the first part desires to sell the real estate
hereinafter described to the parties of the second part and the parties
of the second part have paid to the party of the first part the sum of
$2,500.00, the receipt of which is hereby acknowledged, as consideration
for such•sale; and
WHEREAS the County Court of the County of Garfield, State of Colorado,
has entered an order in words and figures as follows, to wit:

ORDER_
This matter coming before the Court upon the petition of
Gladwyn B. Gaumer, executor of the above entitled estate, and the
Court being fully advised in the premises, DOTIl FIND:
That said executor desires to sell, for a consideration
of $2,500.00, to Sam J. Campbell and Virginia W. Campbell, as
joint tenants, the said decedent1s undivided one-half interest in
and to the following described real property situate in Garfield
County, Colorado, to wit:
Lot 2 o.E Section 6, Township 7 South, Range 88 West,
6th P.M., and Lots 1 and 2 of Section 36, Township 6
South, Range 89 West, 6th P.M.;
That the Last Will and Testament of said decedent pro-
vides:
"I hereby nominate and_ appoint my husband, GLADWYN B. GAUr ER,
Executor of this, my Last Will and Testament, should he be
living at the time of my death, and I hereby authorize and
empower him, in his discretion, to sell any and all property
of my estate, either with or without notice as he shall see
fit, at public or private sale, subject only to such con-
firmation as may be required by law, and the purchasers need
not see to the application of the proceeds."
That, under the above quoted powers contained in such
Will, no confirmation of said executor's proposed sale is required

by. law, but for the benefit of title examiners who in the future
may have some question as to the effect of the above quoted clause,
"subject only to such confirmation as may be required by law,", the
following order is entered..
NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND
DECREED that the sale proposed by said Gladwyn B. Gaumer, as such
executor, as above set forth, be and the same is hereby approved,
-ratified and confirmed, and that said executor be and he is hereby
authorized to convey the decedent's undivided one-half interest
in and to the land above described to Sam J. Campbell and Virginia
W. Campbell in joint tenancy with right of survivorship.

and convey, unto the said parties of the second part, their heirs and
assigns forever, not in tenancy in common but in joint tenancy, all the

The undersigned affiant, being of legal age and first
duly sworn upon her oath, deposes and says:
1. The undersigned was personally acquainted with
Della Blanche Gaumer, also known as Della B. Gaumer, and
also known as Della Gaumer.
2- Della Blanche Gaumer, the person referred to in
the certified copy of Certificate of Death recorded in the
office of the Garfield County, Colorado Clerk and Recorder
on September 3, 1971 as Reception No. 250975 in Book 422 at
page 330, was at the time of her death the owner of record,
in the name of Dellz. Gaumer, of an interest in the following
described real property, to -wit:

Lot 2, the W1/2SE4, the NE4SE4: Section 31; Lot 7, the
SE4SE4, Section 32; Lots 18 and '.9, Section 33; all in Tp. 6
S. R. 88 W. 6th P.M.
Lots 6, 9, 10, 11 and NE4SW4, the NW4SE4, the NE4 of
Section 5, Tp. 7 S. R. 88 W. 6th P.M.
Lots 6 and 7 Section 4; Lots 4, 5, 6, and 7 Section 9
Tp. 7 S. R. 88 W. 6th P.M.
The NE4, the EINW4 the SW4NW4, the NE4SE4 Section 36,

in joint tenancy with G. B. Gaumer, by virtue of Warranty
Deed to Joint Tenants dated December 28, 1947 and recorded
in said office as Rec. No. 163399 in Book 233 at page 376 on
January 16, 1948.
3. The undersigned has no record interest or other
interests in the above described real property.
4. The undersigned has personal knowledge of all of
the facts set forth in this Affidavit, and this Affidavit is
signed and executed, and offered for recording, pursuant to
the requirements of Colorado Revised Statutes, 08-31-102.
