Void Permit. A Building Permit becomes null and void if the work authorized is not commenced within 180 days of
the date of issuance and if work is suspended or abandoned for a period of 180 days after commencement.

understand that the Building Divìsion accepts the Application, along with the plans and specifications and other
data submitted by me or on my behalf (submittals), based upon my certificat¡on as to accuracy. Assuming
completeness of the submittals and approval of this Application, a Building Permit will be issued granting
permission to me, as Owner, to construct the structure(s) and facÌlities detailed on the submittals reviewed by the
Building Division. ln consideration of the issuance of the Building Permit, I agree that I and my agents will comply
with provisions of any federal, state or local law regulating the work and the Garfield County Building Code, OWTS
regulations and applicable land use regulations (County Regulation(s)). I acknowledge that the Building Permit
may be suspended or revoked, upon notice from the County, ifthe location, construction or use ofthe structure(s)

Overview: Grading Permits typically require the submission of:. A Site Specific lnventory and Map of county and State Listed Noxious Weeds,. A Weed Management Plan,. A Revegetation and Reclamation Plan,. A Cost Estimafe. A Financial Security.
The purpose of the plan is to ensure that the development does not result in: (i) erosion and dust generation, (ii) the propagation
of noxious weeds, (iii) the excessive loss of wildlife habitat and food sources, and (iv) long-term visual eyesores. The financial
security allows the County to perform reclamation in the case that the developer abandons the project or does not perform
adequate reclamation.

Section I . Soil Handllng, lncludes: (i) provisions for salvaging on-site topsoil, (ii) a timetable for eliminating topsoil and/or
aggregate piles, (iii) plan that provides for soil cover if any disturbances or stockpiles sit exposed for a period of 90 days or more,
and (iv) erosion conhol barriers and dust suppression measures.
Section 2 - Weed Management Plan. lncludes: (i) a site specific weed inventory along with a site plan showing County Listed
Noxious Weeds and Colorado Listed A & B Noxious Weeds (Contact Garfield County Vegetation Management for updated list),
(ii) weed management plan that addresses inventoried weeds in a timely and effective manner. (Note: Garfield County may
require the submittal for treatment records.)
Section 3 - Site Revegetation and Restoration. lncludes: (i) plant material list (be specific, scientific and common names
require), (ii) planting schedule (to include liming, methods, and provisions for watering, if applicable.)
Section 4 - Gost Estimate Cost eslimate is used to determine the amount of the financial security, Line items within lhe cost
estimate include: (i) mobilization, (ii) earthmoving, (iii) seed and planting, (iv) weed- free mulch, erosion conlrol, and dust
suppression, (v) irrigation, and (vi) weed management, (Note: For pipelines and projects in which existing grade is the same as
final grade, a cost of $2,500/acre can used to determine the financial security,)
Financial Securitv: Bonds, Letter of Credit valid for a minimum of 2 years or Cash.
Countv lnsoection and Releage of Flnsnpial $ecuritv: When grading has been completed and vegetation reestablished, the
developer (permit holder) phones Counly Vegetation Manager (970-945"1377 Ext. 4305) and requests an inspection. lf
restoration is determined to be adequate, the county will inform the development and release ihe financial security,

GENERAL
J101.1 Scopc. The provisions of this chapter apply fo grad-
ing, excavation and earthwolk construction, including fills
anã embankments. Where conflicts occur between the techni-
cal requiretnents of this chapter and the gcotechnical report,
the geotechnical report shall govern.
J101.2 Flood hazard areas. Unless the applicant has submit-
ted an engineering analysis, pre.parect in accordance wilh
standard engineering practice by a registered desigtt profes'
sional, l6al ãernonstrates the proposed work will not result itr
any increase in the level of the basc floocl, grading' excava-
tion ancl earthwolk construction, including lìlls and embank-
ments, shall not be permitted in tloodwøys that are in flood
hazard areas establishecl in Section 1612.3 or 'nflood hazail

SECT¡ON Jl02
DEFINITIONS
J102.1 Definitions. Thc following wolds and terms shall, for
the purposes of this appcnclix, have the tneanings shown
herein. Refer to Chapter 2 of this code for general definitions'
BENCH. A relatively levol siep excavated into earth material
on which fill is to be Placed.
COMPACTION. The densification of a fill by mechanical
means.
CUT. See "Excavation."
DOWN DRAIN. A device for collecting water from a swale
or ditch located on or above a slope, and safely delivering it
to an approved drainage facility.
EROSION. The wcaring away of the ground surt'ace as a
result o[ the movement of wind, water or ice.
EXCAVATION. The rcmoval of eatth matedal by artificial
mcans, also refetred to as ¿l cut.
FILL. Deposition of earth materials by artificial means.
GRADE. The vertical location of the ground surface.
GRADE' EXISTING. The grade prior to glading.
GRADE, FINISHED. The grade of thc site at the conolusion
of al1 grading effotts.
GR^DING. An excavation or fill or combination thereof.
KtìY. A cornpacted fill pìaced in a trench excavated in earth
material beneath the toe of a slope.
SLOPE. An inclined surface, the inclination of which is
expressed as a ratio ofhorizontal distance to vertical distr¡nce.
TERRACE. A relatively level step constructed in the face of
a glaclecl slope for drainage and maintenance putposes.

FILLS
J107,1 General. Unless otherwise recommended in the geo-
technical report, lîlls shall comply with the provisious of this
section.
J107.2 Surface prcparation. The ground sur.lace shall be
prepared to receive fill by removing vegetarion, topsoil and
other unsuitable materials, and scarifying the ground to pro-
vide a bond with the fill nlaterial.
J107.3 Bonching. Whcre existitlg grade is at a slope steeper
than one unit verticul in lìvc units horizontal (Z0-purent
slope) and the depth of the fill exceeds 5 feet (1524 mm)
benching shall be provided in accordance with Figure J107.3.
A key shall be providerl th¿t is at least 10 feet (3048 mm) in
width and 2 feet (610 rnnr) in depth.
J107.4 nil material. Fill material shall not include organic,
frozen ol other deleterious materials, No r.ock or similar irre-
ducible m¿rtcrial greater than 12 inches (305 mnr) in any
clinrension shall be included in fills,
J107.5 Compaction. All fill material shall be compacted to
90 percent of nraximum density as determined by ASTM D
1557, Modified Proctor, in lifts not exceeding l2 inches (305
rnm) in clepth.
J107.ó Maximum slope, The slope of fill surfaccs shall be
no steeper than is s¿fe for the intended use. Fitl slopes steeper
than one unit vertieal in two units horizonLal (50-percent
slupe) shall bejustified by a geotechnical report or engineer-
ing data.
SECTION J108
SETBACKS
J108.1 General. Cut and fill slopes shall be set back from the
propelty lincs in accordance with this section. Setback
dimensions shall be measured pcrpcndirlular to the property
line and shall be as shown in Figurc Jl08.l, unless substanti-
ating rlata is submitted justifying reduccd setbacks,
J108.2 Top of slope. The setback at tho lop of a cut slope
shall be not less than that shown in Figure J108.1, or than is
required to accommodate any required interceptor drains,
whichever is greater.
J108.3 Slope protection. Where requirecl to protect adjacent
properties at the toe of a slope from advelse effects of the
grading, additional protection, apploved by ttte building otJi-
cial, shall bc included. Such protection may include but shall
not be limited to:
1. Setbacks greater than those required by Figure J108.1.

40, Section J103,1 is amended to read as follow:
i103,1 Permits required. Except as exempted in Section J103.2, no grading shallbe
performed without fírst having obtained a permit from the Garfield County
Community Development Department. A grading permit does not include the
construction of retaining walls or other structures. Security deposits in a form and
amount approved by the Building Official or designee, based upon recommendations
from the County Vegetation management Office and the county's designated
engineer shall be established prior to issuance of a major grading permit.
41. Section J103.2 (1,) is amended to read as follows:
1. Grading, excavation and earthwork construction, including fills and embankments
that are constructed solefy for agricultural purposes on lands that are farms or
ranches.
42. Section J103.2 is amended to add an Sttt exemption from permit as follows:
B, Grading that does not exceed 50 cubic yards of earthwork material or 6000
Square Feet of graded area, whichever is greater,
