Our office is in receipt of a Notice of lntent (NOl) to Construct a Non-Jurisdictional Water
lmpoundment Structure for the subject dam. The impoundment is to be tocated on [stream
or tributaryJ, with the fitting source to be [diversion, direct runoff, etc.].
ln accordance with Rute I 1.1 of the Colorado Rutes and Regutations for Dam Safety and Dam
Construction, the hazard of this dam has been assessed as Low and no submittal of ptans or
specifications is required prior to construction. The assignment of this hazard classification
was based on assessment of aerial photography. A copy of the signed NOI is attached. An
etectronic copy witt be maintained with the Division of Water Resources.
Please note the fottowing:
As an off-channel pond with a 5.7 acre drainage area the standard requirement of a
minimum ó-inch diameter bottom outlet is waived, so tong as owner can control att
inflow.
With onty 5.7 acres of drainage area and 7.4 acre-feet of capacity, the minimum of 3
feet of freeboard between the spìttway and the dam crest is atso waived, so long as a
spittway of 10 foot bottom width is maintained and free of debris.
ln the event groundwater is encountered during construction of the pond, the pond
must þe backfitled so as not to expose groundwater until such time as: 1) a well
permit has been obtained for the groundwater pond pursuant to CRS 537'90-137, or ?l

Ptease atso note that this signed NOI does not in and of itsetf confer upon the owner a vested
water right; however, one may be obtained separatety through District Water Court. The
reservoii may onty be fitted when water is legally avaitabte, and wit[ be required to bypass atl
inftow and reptace evaporation losses when there is a more senior downstream catl on the
system.
The requirements and recommendations provided herein are based on our review of the
safety and water administration aspects of the proposed dam and the information provided in
the submitted NOl. These requirements and recommendations create no liabitity for the
State of Cotorado shoutd the dam fai[ for any reason. Please be aware that it is in the
owner's best interest to construct, operate, and maintain the structure in a safe manner, as
he or she may be hetd tiabte in civil court for any downstream damages resutting from faiture
of the dam. A copy of Specifications for Construction of Non-Jurisdictional Dams is provided
to assist you in the construction of a sound structure.
Finatty, ptease be aware of any other permitting or regutatory requirements associated with
the construction of a water impoundment structure, including but not timited to county
and/or municipal regulations, and wetland permitting through the U,5. Army Corps of
Engineers (see www. usace. army. mit for regionat contact information).

DAtyI SAFETY BRANCH Speciflcations for Construction of Non.Jurisdictional Dams
Site Setection:
- Eundation soits shoutd be firm to provlde adequate support for the embankment and shoutd have low
permeabigty to attow for water retention. Site selection shoutd consider potentiat downstream proPerty damage
in the eveni of a dam failure. Construction of dams in Þoggy areas, areas with non-uniform fractured rock, or
sands/gravets is not recommended and an engineer shoutd be hired to evaluate the site conditions. Any part of
the reservoir basin excavated betow grade cannot expose groundwater.
Embankment Deslqn::Ïãilnä rnaær¡ãt to be used for construction of the cutoff trench and embankment shoutd be a suitabte clay
materiat and contain no material larger than ó inches in diameter.
- The upstream stope should be constructed with a stope no steeper than 3:1, and the downstream slope should be
no steeper thðn 2:1 (see cross section betowl. The dam crest should have a minimum \{idth of 10 feet and the
surface shoutd be graded wlth positive drainage toward the reservoir basin.
- lt Ís recommended that rock rip rap or other suitable material be placed on the upstream slope of the
embankment to protect it from wave action. A suitabte gravel or geosynthetic material shoutd be ptaced under
the rip rap to prevent fine materiat fro¡n washing out from behind the targer rock.
- The embankment shoutd be fenced to restrict livestock from accessing the dam since they damage the protective
vegetation and increase erosion.
Embankment Construction
fThãtopsoit and ãtt organic material shoutd be removed from the foundatlon of the proposed dam site. Organic
soit shoutd onty be reused for placement on the compteted embankment to promote the re'growth of vegetation'
- A cutoff trench shoutd be excavated under the futt tength of the centertine of the dâm with stoping sides (1:1
min.), a mínimum bottom width of 3 feet and a depth of 3 feet.
- The foundation of the dam should be scarified/ripped to a depth of 6-inches to provide proPer contact þetween
the nätive foundation and embankment. This surface should then be moisture treated before ptacement of fitl,
- Fitt materiat shoutd be ptaced in layers not exceeding 12 inches in thickness prior to compaction. Suitabte backfilt
material should have enough ctay and moisture content to roll a smatt batt by hand. lf this cannot be done, the
soit is tikety too dry or does not have adequate ctay content.
- Each tift shoutd be thoroughty compacted using a sheeps foot compactor. Care shoutd be taken not to altow the
top tayen of the soil to dry out between ptacement of lifts.
- Fitt shoutd be placed in uniform lifts that cover the entire embankment length and width.
Outlet. Ùntess a waiver is granted in writing by the Division Engineer, atl non-jurisdictional dams require an outlet
conduit positioned at the natural low point of the reservoir basin, A minimum diameter of 12 inches is
recommended and shoutd be controtled at the upstream end by a vatve and trash rack.
Emerqencv Spittwav
- the spittway shoutd have sufficient width to provide capacity to route the runoff from the drainage basin above
the dam during rainfalt/runoff events.
- The emergency spittway shoutd be tocated on natural ground far enough away to prevent erosion of the dam
embankment. A spittway over the dam embankment is not acceptable.. A minimum of 3 feet of freeboard is required from the bottorn of the emergency spittway to the top of the dam.
- To determine the minimum spittway width, see the attached tabte for your areâ and drainage basin size.
