Lezlie Laybourn 181 CR 100 Carbondale, CO. 81601 Return Receipt sé,6ã r){\68 NOTICE OF'VIOLA.TION * ZONING/BUILDING CODE Dear Royal &Lezlie, On February 22nd.,2018, the Garfield County Community Development Department Code Enforcement Officer received a complaint about a possible ADLI (accessory clwelling unit) that is on your property located at 181 CR 100 in Carbondale, Colorado. Parcel # 239335200A55. I looked up our information for tlie property and was able to see that there is a pennit for the garage that states it is approved for a bedroom and utility. Permit #4980 dated 1 l/1193 states in the special conditions "approved subject lo understanding that garage ís þr personal use - No commercial unless approved by land use perncit". Pennit #5725 d,ated 7lI2/94 also states in the special conditions that "Kitchen oríginally proposed is ta be removed per agreemenl". Both permits are included in this letter. The second kitchen and the changed use of the garage would require a land use change permit for the ADU. A land use change pennit could not be located on file with us. I am sending you this letter to let you know that the use of the ADU without the requisite land use permits, would be a violation pursuant to section 2-103 of the Garfìeld County LUDC (Land Use and Development Code). They read: LUDC Section 2-103 A Land Use Change Permit must be obtained in compliance with this Code prior to beginning any development or activity associated with a change in land use. Failure to obtain aLand Use Change Permit shall be a violation of this Code and subject to the enforcement provisions in A¡ticle 12. GarrteW County You are hereby given notice, pursuant to Article 12 of the LUDC, that you have 10 days fiorn receipt of this notice to completely correct the violations or ceâse and desist from continuing the violation. Under Article 12 of the LUDC, your failure to correct or cease the violations on your propcrty may result in one or more of the followirrg etrlurucntctrt ar:tions being taken against you: l. Revocation of any building permits issued for improvements of the subject propefty; 2. Denial of additional land use approvals or building or other development applications pertaining to the subject property; 3 . Suspension of any land use approvals for the subj ect properly; 4. Withdrawal of any development permits that are being violated; 5. Forfeiture of any vested property rights; 6. Criminal enforcement; 7. County court civil penalties; and 8. Civil lawsuit.
