My wife and I chose the subject property based on the beautiful scenery and landscapes this remote area of Garfield County has to offer, as well as the ability to defray a portion of the acquisition cost through the rental of the guest house on a year round basis. Therefore, in order to meet our financial obligations on this property we need to be able to rent out the ADU. Prior to purchasing, we responsibly performed due diligence and learned that both the permit and approval, Resolution no. 2009-03, had language providing for year round rentals of the ADU. Exhibit A within the Specíal Use Permit of Burnt Park Trail, LLC 3410 County Road 151, Garfield County Parcel Number: #1863-214-00-117, as well as RESOLUTION NO. 2009-03 clearly states: "The accessory dwelling unit shall not be conveyed as a separate interest but may be leased." Nowhere in either the approved Special Use Permit or the Resolution did it state that the use was limited to 10 weeks out of the year. Accordingly, we purchased the property in May of this year (2Q18). We have since been informed by the Garfield County Community Development Department that, despite the approval language contained within the approved permit and resolution, the original applicant made a representation that the ADU would only be used 10 weeks out of the year. As a result, we have been asked to submit this modification to allow the year-round use of the ADU. Since this application is a modification to an existing, approved permit, and adequate water, sewer, access, conditional mitigations, etc have already been established for the ADU., I will focus and address how I plan to limit and mitigate possible perceived impacts to neighbors. I have established the following measures in order to ensure that this ADU does not create adverse impacts to neighbors: ¡ The home has all down facing lights, and we will not add outdoor lighting to it; o We have and will continue a strict "no outdoor music" policy; . We will limit the ADU to 5 individuals to stay at at any one time;¡ We will limit the ADU to 2 vehicles at any one time; o We have and will continue a prohibition of the use of firearms or fireworks by ADU guests; ¡ ADU guests will not be allowed to use ATVs or motorcycles on the property; ando The ADU is consistent with the vernacular architecture of the property and its beautiful surroundings; and will be maintained as such (please see attached photos). The ADU is over 1500 ft from the closest neighbor. The ADU is not visible from neighboring homes and outbuildings, and it is completely secluded within a dense aspen grove.
