Subject:Single family dwelling being constructed at 0181 Harmony Road,
Joseph's Meadow, near Carbondale, Colorado. Permit No. 5228.
Dear Jim:
It appears that a portion of the house may vary from the plan that was approved for
construction by Garfield County. The plan that we have on file indicates a sink and
counter arrangement in the upstairs and appears to be a wet bar, however, the on
site inspection indicates that a more complete kitchen is being constructed in this
area. This would not be consistent with the permit which was issued for a single
family dwelling in that the completion of a kitchen would create another complete
dwelling unit, requiring a Special Use Permit from the Planning Department.
The on site inspection also indicated the construction of a habitable area on the
upper floor that does not have adequate natural light and ventilation as required by
code. Jim, I would appreciate your contacting me within seven (7) days of the date
of this letter so that we can discuss these items. Thank's for your communication
and cooperation.

MINIMUM APPLICATION REQUIREMENTS
for
SINGLE FAMILY DWELLING CONSTRUCTION
including
NEW CONSTRUCTION
ADDITIONS
ALTERATIONS
and
MOVED BUILDINGS
In order to understand the scope of the work intended under a permit
application and expedite the issuance of a permit it is important that
complete information be provided. Adequate and complete information
will prevent delays in the plan review process. Reviewing a plan and the
discovery that required information has not been provided by the applicant
may result in the delay of the permit issuance and in proceeding with
building construction. The owner or contractor may be required to provide
this information before the plan review may proceed. This causes delays
because other plans that are in Iine for review may be given attention
before the new information may be reviewed after it has been provided to
the Building Department.
Please review this document to determine if you have enough information
to design your project and provide adequate information to facilitate a plan
review. If you do not, it may be helpful to obtain a book titled 'Dwelling
construction under the Uniform Building Code. This book is available to
you through this department at our cost. Also, please consider using a
design professional for assistance in your design and a construction
professional for construction of your project.
To provide for a more understandable plan in order to determine
compliance with the building, plumbing and mechanical codes, applicants
are requested to review the following check list prior to and during design.
Applicants are required to indicate appropriately and to submit completed
check list at time of application for a permit:

This morning I was informed by Mark Bean that Mr. Jim Adams has agreed
to remove the second kitchen in the residence referenced above and to sign
an affidavit stating that he will not use the area as a separate dwelling. The
counter and sink may remain but the cooking appliances will be removed.
At this time Mr. Adams does not intend to make application for a Special
Use Permit for a second dwelling unit at this address.

An enclosed space has been finished as a habitable room. The space is
adjacent to one of the bedrooms and has one wall common to the room.
The area of the common wall is 168.6 sq. ft., an opening of 68 sq. ft. has
been completed and finished. This is about 4% less than the one half of the
common wall opening as required under U.B.C. Section 1205 (a). However,
under U.B.C. Section 106, Modifications, I believe that there are practical
reasons for not requiring that the additional 4% of opening be provided.
This being that the addition of less than 7 sq. ft. would require demolition of
finished work with minimum practical gain.
It is my determination that the room as configured meets the intent and
purpose of the Uniform Building Code. Further modifications other than the
addition of a smoke detector wired into the building electrical system and the
providing of a ventilation system providing for two air changes per hour, will
not be required.

residential structure built under building permit # 5228 is a single family dwelling.
Further, that the structure as constructed will not be divided into separate dwelling units for
any reason. A dwelling unit, being defined as one or more rooms in a dwelling occupied by one
1) family living independently of any other family. A family is one (1) or more persons
occupying a dwelling unit.
It is agreed, that the County will be given the right to request the removal of certain
