I. GENERAL PROJECT DESCRIPTION
The owner of Lot GV1 (0.752 acres), Richard and Leann Katchuk, wish to amend the
building envelope for lhis lot. The amendment has been reviewed by the Aspen Glen HOA,
who has indicated their approval of the request. The property is located within the Tz Ac¡e
Residential Zone District. The proposed building envelope amendment enlarges the
envelope to the west along Bald Eagle Way. A review of the setbacks within Aspen Glen
PUÐ %Acre Residential Zone District require a25'setback for corner lots along the side
yard. Based on representations regarding the proposed layout of the home, it appears that
ihe side where the enlargement is to occur can be considered a'side yard abutting
public/private street'. lt has been represented that the building envelope would be extended
to this 25' setback line. The enlargement of the building envelope along this side does not
appear to encroach on any known utility, drainage, rights-of-way or other easements.

III. REVIEW PROCESS
The process to accommodate this request shall require submittal of an amended final plat
processed by Administrative Review pursuant to the LUDC.
o The review process shall follow the steps as contained in Section 5-305 (see attached
flow chart and below outline).r Pre-Application meeting;r Submittal of Application (3 copies plus one electronic);
r Gompleteness Review;r Submittal of additional materials (if needed) and copies for Referral agencies (21 day
review);. Setting a date for the Directors Determination;
r Public Notice 15 days prior to the Director's Determination to property owners within
200 feet and mineral rights owners on the subject property;
o Directors Determination including any conditions;
r A 10 day Call-up Period after Director's Decision is made;
r Finalizing the Plat and satisfaction of any conditions;
r Circulation for ApplicanUOwner and other signatures;
r Board of County Commissioners execution of the plat as a consent agenda item;
r Recording the Plat with the County Clerk and Recorder.
IV. SUBII'IITTAL REQUIREMENTS

lienholders and/or encumbrances (a title commitment may be necessary). Statement of Authority (should the parcel be held by an LLC, trust, corporation or
other partnership.) and Letter of Authorization, as necessary
' Fee Payment and Payment Agreement Form. Pre-APplicationConferenceSummary. Names and addresses of all property ownens within 200 feet of subject parcels
and all mineral owneñe of the subject parcels.. Vicinity Map. lmprovements Agreement (may be waived upon request)
' Final Plat (plat should include improvement location information adequate to
confirm that no new nonconforming conditions will result from the proposal). Code, Covenants, Restrictions (needs to be referenced on the plat). The request should be consistent with all applicable provisions of Article 7,
Divisions 1 ,2 and 3. The Application should include, at a minimum, representations
that the amendment will not result in any changes to drainage, access, utilities, and

Re: Referral for the Proposed Amended Plat for Lot GV-l, Filing 2 Aspen Glen
Dear Glenn,
Thank you for the opportunity to submit this referral letter related to the amended plat for
Lot GV-l/ 12 Primrose. The Aspen Glen Design Review Committee (DRC) reviewed
the proposed plat amendment at their meeting May 16, 2018. The proposed adjustment
was considered to accommodate a minor addition. In keeping with the DRC's historical
review, the amount of square footage forthe building envelope expansion, 1,620 square
feet, was deducted from another area of the envelopo to maintain the original size of the
building envelope as first platted.
The DRC approvcd the adjustment finding that the area of property that will bc cxpanded
upon is not adjacent to other private properties (it is near a street corner) and the yard
area is heavily vegetated to screen the one-story addition closer to the street. The DRC
recommends approval to the Garfield County Board of County Commissioners with the
following conditions:
l. A copy of the recorded amended plat shall be provided to the Aspen Glen DRC.
2. The DRC did approve the minor addition in conjunction with the proposed
building envelope adjustment. As this review progresses, if the proposed
adjustment is altered or not approved, then the applicant is required to review any
amendments to the minor addition with the DRC.
3. The DRC did not consider vacation of utility easements as that is the
responsibility of the property owner to ensure that those easements can be vacated
based upon review by service providers.

4. Resoarch the legal description of the subject property with the Clerk and Recorder's
computer. You can search the Section, Township, and Range of the subject property.
You may find deeds for mineral interests for the subject property.
5. Research whether a Notice of Mineral Estate Oumership was filed for the subject
property. On the Clerk and Recorder's computer, search under Filter (on the right hand
side of the screen), General Recordings, Notice of Mineral Estate Oramership for the
subject property.
6, If you find mineral interest owners as reservations on your deed, listed in your title
insurance policy, ûom the Assessor's records or the Clerk and Re,corder's computø, you
necd to determine whether these mineral interests were hansferred by deed and recorded
in the Clerk and Recorder's office.
7. Enter ttre name of the mineral interest owner as the Grantor in the Clerk and Recorder's
computer to see if the mineral interest was tansferred. If you find a transfer deed, you
need to repeat this process to follow any transfer of the mineral interest to prese,lrt day.
8. Include a description of your research process in your application and the name(s) and

Mineral interest research can be a difûcult and time consuming ptocess. If you are unable to
determine mineral rights ownership by yourself, consider hiring an attorney or landman.
Attorneys and landmen specialize in determining mineral rights ownership, but they charge a fee
for their services.
