The District and its engineer have determined that the DRLS replacement described in this Application are necessary to provide the District with a facility that continues to serve the community for the 20-year planning horizon. 2.0 Background of the MVMD The District was formally organized and created as the Mid Valley Metropolitan District in 1983 as a Colorado Special District to provide water and sewer services to developing areas of the Roaring Fork Valley, and its formation was approved under Title 32 of the Colorado Revised Statutes by Eagle County, Colorado. The District services areas of Basalt, El Jebel, as well as unincorporated subdivisions within unincorporated Eagle and Garfield Counties. The treatment facility consists of an extended aeration facility and discharges to the Roaring Fork River under National Pollutant Discharge Elimination System (NPDES) Permit CO0049026 and has been in compliance with its effluent limitations per its discharge permit. This is an area on the Western Slope composed of primarily residential subdivisions. Maps of the service area and 1-mile vicinity are included in Exhibit B. 3.0 Submittal Requirements Pursuant to Table 4-201 and Section 4-203 of the Land Use Development Code (LUDC), the District provides these general application materials: 1.Application Form: The Application Form is provided. 2.Ownership: All improvements will be conducted within the current parcel boundary that has been disturbed and modified in the past during initial construction of the lift station. Consequently, no new environmental impacts will be created by this project. A summary matrix of environmental impacts is as follows: Environmental Impacts Matrix EXISTING FACILITY IMPROVED FACILITY FLOODPLAIN Outside 100-year flood plain; Outside 100-year flood plain. WETLANDS NONE NONE WILDLIFE HABITAT NONE NONE ARCHEOLOGICAL NONE NONE HISTORICAL NONE NONE The existing facility and all its lands are outside any known or delineated floodplain boundary. The construction of the DRLS replacement will occur solely within the bounds of existing District-owned land, as shown on Exhibit A. Applicant Mid Valley Metropolitan District Dakota Ranch Lift Station Replacement Location and Extent Review 2 acknowledges that it will be required to obtain approval for the Site Application from the Board of County Commissioners and the Colorado Department of Public Health and Environment (CDPHE). 3.Adjacent Property Owners & Mineral Owners and Lessees: Exhibit A is a list and map of the owners of record of real property surrounding the Dakota Ranch Lift Station parcel described in this Application. 4.Fees: Once the application has been processed by Garfield County, the Owner shall pay the appropriate fees as assessed by the County. 5.Project Description: This Application is for Location and Extent approval for the replacement of the existing Dakota Ranch Lift Station to provide adequate service for the 20-year planning horizon and improve accessibility for routine maintenance of the lift station. 6.Site Plan: Exhibit C contains the plat for the Dakota Ranch Lift Station as well as an existing conditions map and survey points. 4.0 Review Criteria Pursuant to section 4-111.C of the LUDC, the Planning Commission is to review the application to determine whether the project is in general conformance with the Comprehensive Plan. 4.1 Section 1 – Urban Growth Areas and IGA The project site is not included within the “Urban Growth Area”, but is located within the “Water & Sewer Service Area” as detailed on the Garfield County Comprehensive Plan’s Future Land Use Map. The project site is within the MVMD service plan area. The project is in general conformance with the vision outlined in Chapter 3, Section 1 of the County’s Comprehensive Plan. 4.2 Section 2 – Housing While this application does not include future residential development, the relocation of the existing DRLS will continue to accommodate flow regimes under the 20-year planning horizon for the Dakota Ranch subdivision. This project is in general conformance with the vision outlined in Chapter 3, Section 2 of the County’s Comprehensive Plan. 4.3 Section 3 – Transportation This application does not create new roadways or require construction within the County Road right of way. The District and its engineer are in the process of preparing the preliminary design for the project, which will require subsequent approval from the Colorado Department of Health and Environment (CDPHE). This project is in general conformance with Chapter 3, Section 3 of the County’s Comprehensive Plan. 4.4 Section 4 – Economics, Employment and Tourism This application replaces the existing lift station which provides service to the Dakota Ranch subdivision within the MVMD service district. Therefore, it is a part of the infrastructure that improves the quality of water and wastewater and the quality of life of its citizens. This Mid Valley Metropolitan District Dakota Ranch Lift Station Replacement Location and Extent Review 3 project is in general conformance with Chapter 3, Section 4 of the County’s Comprehensive Plan. 4.5 Section 5 – Recreation, Open Space, and Trails This Application does not impact open spaces or trails. 4.6 Section 6 – Agriculture This Application does not impact agricultural lands or remove lands from agriculture. 4.7 Section 7 – Water and Sewer Services This Application replaces the Dakota Ranch Lift Station and will have no impact on the capacity of the District wastewater treatment facility. This relocation will facilitate adequate service to the Dakota Ranch subdivision through the 20-year planning horizon and will improve accessibility for routine maintenance operations at the lift station for District operators. The MVMD WWTF consists of an extended aeration facility and discharges to the Roaring Fork River under NPDES Permit CO0049026 and has been in compliance with its effluent limitations per its discharge permit. The hydraulic capacity of the WWTF is 0.999 MGD and has an organic loading capacity of 1,918 lbs of BOD5 per day. The DRLS will not have an impact on the plant’s hydraulic or organic loading, as the proposed lift station is replacing an existing lift station which currently contributes the same flows to the WWTF. This application is in general conformance with Chapter 3, Section 7 of the County’s Comprehensive Plan. 4.8 Section 8 – Natural Resources This Application is not for the construction of water and sanitary sewer service in existing rights of way and developed areas and will not affect natural resources. This application is in general conformance with Chapter 3, Section 8 of the County’s Comprehensive Plan. 4.9 Section 9 – Mineral Extraction This Application is for the replacement and construction of the Dakota Ranch Lift Station in an existing District-owned parcel and developed areas and will not prohibit resource extraction. This project is in general conformance with Chapter 3, Section 9 of the County’s Comprehensive Plan. 5.0 Summary The proposed lift station relocation will allow the District to provide adequate service to established residential populations in line with the 20-year planning horizon and will improve routine maintenance operations for District operators by replacing the 30-year-old Mid Valley Metropolitan District Dakota Ranch Lift Station Replacement Location and Extent Review 4 lift station and equipment with a facility that doesn’t pose a permitted confined space hazard.
