2. The Applicant understands and agrees that Garfield County Resolution No. 20L4-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascerta¡n the full extent of the costs
involvedinprocessingtheapplication. TheApplicantagreestomakepaymentoftheBase
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. lf actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.

AMENDED FiNAL PLAT FOR PARCEL A. WILKS SUBDIVISION EXEMPTION
Narrative Description. At the time of platting, Parcel A of the Wilks Subdivision Exetnption
consistccl of approxirnately 70.858 acres. By wananty deed lecorded l/.ay 26,2017 as Reception
No. 892879, Mr. ancl Mrs. Wilks sold 35.430 acres to Larry J. Spaulding. The remaining parcel
owned by Mr. and Mrs. Wilks is35.428 acres in size. Per Section 5-201.8(1) of the Garfield
Corurty Land Use and Development Code, as both of the new parcels exceed 35 acres in size, this
clivision of Parcel A is by "operation of law" and is exempt fi'om County Subdivision and
Exemption review. See CRS Sec. 30-28-101(l0xb). The County, however, is refusing to
acknowledge the transfer to Ml. Spaulcling until Mr. and Mrs. Wilks receive County approval for
an amended final plat for Parcel A of the Wilks Subdivision Exernption which shows Parcel A
after removal of the acreage transferred to Mr. Spaulding. Accordingly, Mr. and Mrs. Wilks seek
to amend the final plat for Parcel A of the Wilks Subclivision Exemption to remove the acreage
h'ansferred to Mr. Spaulding.
Pursuant to Section 5-305 of the Galfield County Land Use and Development Coc1e. the amer-rcled
plat for Parcel A of Wìlks Subdivision Exemption does not increase the number of lots, does not
result in a major relocation of roads. or add orle or lnore new roads. As amended, Parcel A is
currently used as a single-farnily residence. No change in use is anticipatecl.
l{equest for Waiver of Improvements Agreement. Section 4-202 of the Garfield County Land
Use and Development Code states that a waiver may be approved if the Applicant deuonstrates
the requirements are inappropriate or Llnnecessary based upon the following critelia:
1) The Applicant shows good cause for the requested walver:
2) The projecl size, compiexity anticipated itnpacts, or other factors support a waiver;
3) 'l'he waiver cloes not compromise a proper and cotnplete review; and
4) The iliformation is not rnaterial to clescribing thc proposal or dcmonstrating compliancc
with approval criteria.
HeLe, no public implovements are required as part of the amended plat. No change in use to
Parcel A as amended is anticipated. Accorclingly. Applicants request a waiver of the
Inrprovenrents Agreement requirement in Sections 5-401 and 4-203.K of the Garfield Cor.rnty
Land Use and Development Code.
Article 7, Divisions l-3, Standards. Applicants have reviewed the standards incorporated in
Divisions 1 through 3, inclusive, of ArticleT of the Gar'field County Land Use and Development
Code, Parcel A as arnended is currently nsecl as a single family resiclence and was at the tirne of
platting of the Wilks Subdivision Exemption. No change in use has occuned and no change in
use is intendecl. Accordingly, the proposecl antendment to the final plat map for Parcel A of the
Wilks Subdivision Exemption would not impact the application of any of these Standarcls.
Code, Covenants & Restrictions. A Declalation of Plotective Coveuants for Wilks Subclivision
Exemption was recorded on March 22, 2005 in Book 1672 at Page 69 in the Office of the
Galfield County Clelk and Recorder.

I. GENERAL PROJECT DESCRIPTION
The Applicant is requesting an Amended Final Plat to adjust the Lot Lines of parcelA of the
Wilks Subdivision Exemption. The Exemption Plat was recorded in 2005 (Recorclecl 670662).
The Exemption created two parcels - ParcelA (70.860 acres) and Parcel B (10.612 acres).
Recently, an adjoining properly owner, purchased 35 acres from the owner of parcel Á,
leaving two parcels over 35 acres. The applicant needs to go through an Amended Final plat
process to remove the newly purchased 35 acres from the Wilks Subdivision Exemption plat.
No changes to the existing access or utilities are proposed as a result of the amended plat.
ln addition, no nonconforming conditions have been noted which would result from the lot
line modification.
