A 35 -acre parcel of land located at 0269 CR 309, adjacent to the Battlement
Mesa PUD in the SE % SE 14 Section 5, Township 7 South, Range 95 West of
the 6r" P.M. and legally described in Exhibit A
Assessor's Parcel No. 2407-054-00-085
In accordance with and pursuant to provisions of the Garfield County Land Use and
Development Code, as amended, and the Garfield County Director's decision the
following activity is hereby authorized by Land Use Change Permit:
A Small Injection Well Facility known as the Ursa Tompkins Injection Well as
shown on the Site Plan Attached as Exhibit B
(GAPA-02-16-8418)
This Land Use Change Permit is issued subject to the conditions contained in the
Director's decision issued on April 29, 2016, attached as Exhibit C, and shall be valid only
during compliance with such conditions and other applicable provisions of the Garfield
County Land Use and Development Code, as amended, Building Code, and other
regulations of the Board of County Commissioners of Garfield County, Colorado.

The SE 1Y4 of the SE 14 of Section 5, Township 7 South, Range 95 West of
the 6th P.M. excepting therefrom a tract of land described as follows:
Beginning at the Northeast comer of the SE 1 of the SE 1/4 of said
Section 5; thence West 40 rods; thence South 20 rods; then East 40 rods;
thence North 20 rods to the Point of the Beginning and as also shown in
Boundary Agreement recorded April 18, 1967 in Book 383 at Page 485 as

1. That all representations made by the Applicant in the application shall be conditions
of approval unless specifically altered by the conditions of approval of the Board.
2. That the Tompkins Injection Well shall be operated in accordance with all applicable
Federal, State and local regulations governing the operation of this type of facility.
3. The Applicant shall maintain all required CDPHE permits for the facility including any
applicable air quality APEN permits including as may be required for the storage tank
batteries.
4. The facility shall maintain compliance with CDPHE Storm Water Management
Permits, Drainage and Grading Plans, and Reclamation and Erosion Control Plans for
the site.
5. The Applicant shall remain in compliance with the Watershed Permit issued by the
Town of Parachute.
6. The Applicant shall maintain all required COGCC permits and forms for the facility and
shall comply with all conditions or requirements of said permits and forms. Copies of
COGCC permits and forms shall be provided to the County once issued.
7. The facility shall maintain compliance with COGCC Noise Standards/Regulations and
the facility shall be required to utilize an electric pump as represented. If future
compliance issues are identified, the Applicant shall provide noise mitigation in order
to achieve compliance along with a technical evaluation by a qualified professional to
confirm compliance. Should transfer pumps for distribution of water between well
pads be constructed on the site as part of the injection well operation, said pump shall
be tested for noise compliance with noise mitigation installed if necessary to include
the potential for housing in a sound mitigation structure.
8. The facility shall have only termporary lighting for unscheduled night time
maintenance. All lighting shall comply with Section 7-304, Lighting Standards, with all
lighting to be directed inward and doward toward the interior of the site. Facilities and
storage tanks shall be painted a non -glare neutral color to lessen any visual impacts.
9. The Applicant shall comply with the Battlement Mesa Wildlife Mitigation Plan -
Agreements between Ursa Operating Company and CPW which includes limitations
on trucking to between the hours of 10 a.m. and 3 p.m., when and where possible,

compliance with noise regulations and use of bear proof trash containers for all food
related trash.
10. The Applicant shall comply with the recommendations of Geologic and Soils
Hazards Report related to the Potts-Ildefonso Soils present on the site. These
recommendations include the use of coated steel or appropriate cathodic protection,
as well as the use of corrosion resistant concrete.
11. The Applicant shall comply with the access representations and Traffic Report
including use of designated haul routes and maximum estimated traffic generation.
The daily trucking estimates may be applied based on a weekly average to account
for minor operational variations. Trucking of water to the site shall utilize watertight
tanks and shall comply with all COGCC or CDOT requirements for hauling of
production water. The Applicant shall provide the County with updates on the
progress toward implementing pipelines for transportation of water to the injection
well. Said updates shall be provided on an annual basis and include assessment of,
and mitigation for, any unanticipated traffic impacts.
