Subdivided as Mountain Shadow Place Minor Subdivision (Reception Number 903163). Said property is located on the northwestern border of the City of Glenwood Springs directly west of the Western Hills Subdivision (practical add ress TBD). 0.349 acres Residential Urban (RU) Approval with Conditions I . r:rl :Í;í, 1il i"l lií,r.ilrl)l; lilrli:, lliúil:rjljrlr The Applicant is requesting an Amended Plat to adjust the lot lines between the existing Lot 3 of the Mountain Shadow Place Minor Subdivision recently created in 2018. The Amendment is to add a 6.94' 'gap' between the Mountain Shadow Subdivision and the Western Hills Subdivision. This'gap' is understood to have been created by a surveying error. The amendment would shift the property line between the two parcels, resulting in an increase in the size of Lot 3 and the elimination of the 'gap' area. The judgement and decree quieting title process to ¡ncorporate the 'gap' can be found at Reception No. 903023. Both Lot 3 and the 'gap' area are located within the Residential Urban Zone District. Lot 3 is currently unimproved. Access to the parcel is via Mountain Shadow Drive, or County Road 1338. The lot is owned by CMH Homes lnc. No changes to the existing access or utilities are proposed as a result of the amended plat. ln addition, no noncomforming conditions have been noted which would result from the lot line modification. The sewer easement on the south side of Lot 3 will be extended across the 'gap'area to the eastern edge of the parcel. ln addition, the ingress/egress/emergency access easement on the north side of Lot 3 will be slightly extended. The existing Mounta¡n Shadow Place Subdivision lmprovements Agreement can be referenced at Reception No. 903L63. II, DESCRIPTION OF THE SITE AerialContext AerialZoom The parcels are located within the newly created Mountain Shadow Subdivision just northwest of the City of Glenwood. The site is accessed via Mountain Shadow Drive, or County Road 1338. 2 Applicant's Site City of Glenwood Springs III. AUTHORITY.APPLICABLEREGUT.ATIONS The Amended Final Plat Application is processed in accordance with Section 5-305, Amended Final Plat Review and Tables 5-1-03 Common Review Procedures. Section 4-LO3 and 4-L01 address details of the review procedures. The Application has been determined to be complete. Public notice was required for the Director's Decision in accordance with Sections 4-103 and 4-L01-. The Applicant has provided evidence of completion of the required notice for the Director's Decision. ¡V. PUBLIC AND REFERRAL COMMENTS The Applicant has provided documentation that all required notice mailings have been completed in accordance with the LUDC. No public comments were received as a result of the public notice. Referral Comments received on the Application are attached as Exhibits and summarized below: L. Garfield County Surveyor: a. lnclude a plat note indicating the purpose of the amended plat 2. Assistant Garfield County Attorney: No further comments or corrections. V. STAFF ANATYSIS AND CRITERIA L The Applicant's proposal was reviewed against the Amended Final Plat Criteria contained in Section 5-305 (C), as follows: a. Does not increase the number of lots - The proposed Amended Pløt will not increase the number of lots. b. Does not result in a major relocation of a road or add any new roads; or - The proposed Amended Plat will not result in a møjor relocøtion of a road or add new roods. c. Will correct technical errors such as surveying or drafting errors. - The Amended Plat has not been proposed to correct technical errors. 2. No conflicts with the existing underlying zoning have been noted including lot size and setbacks. 3. No changes to existing utility locations or access are proposed as part of the amended plat process. 4. The Application was referred to the County Surveyor who identified one minor issue with the proposed plat survey (see Condition of Approval 2a). 5. According to the Future Land Use Map in the Garfield County Comprehensive Plan 2030, the property is located within the Urban Growth Area of the City of Glenwood Springs. The City of Glenwood Springs Comprehensive Plan identifies the subiect property as Low J Density Residential. lt is Staff's opinion that provided the language within the City's Low Density Residential designation that states that "Appropriate development densities will be determined by, among other things, current land uses, topographic constraints, existing and future utility connect¡ons and existing road networks", the application is in general conformance with the Garfield County Comprehensive Plan 2030. Staff supports a finding that Lots 3 of the Mountain Shadow Amended Final Plat Application meets the requirements and standards of the Garfield County Land Use and Development Code as amended and is recommended for Administrative Approval by the Director of the Community Development Department subject to the following conditions of approval: Suggested Findings L. That proper public not¡ce was provided as required for the Director's Decision 2. Consideration of the Application was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested part¡es were given an opportunity to provide input prior to the Director's decision. 3. That for the above stated and other reasons, the proposed amended plat is in the best interest of the health, safety, convenience, order, prosperíty and welfare of the citizens of Garfield County. 4. That the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoption of conditions and for the above stated and other reasons the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. Recommended Conditions of Approval 1. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The proposed plat shall be updated and edited as follows prior to submittal for final review by the County: a. The plat shall include a note indicating the purpose of the amended final plat. b. The plat title shall be revised to read "Amended Final Plat of Lot 3 of Mountain Shadow Place Minor Subdivision". c.
